A Defense Of Analogical Reasoning In Law, Emily Sherwin Sep 1999

A Defense Of Analogical Reasoning In Law, Emily Sherwin

University of Chicago Law Review

This Article defends the practice of reasoning by analogy on the basis of its epistemic and institutional advantages. The advantages identified for analogical reasoning include that it produces a wealth of data for decisonmaking; it represents the collaborative effort of a number of judges over time; it tends to correct biases that might lead judges to discount the force of prior decisions; and it exerts a conservative force in law, holding the development of law to a gradual pace. Notably, these advantages do not depend on the rational force of analogical reasoning. Rather, the author contends that, as open-ended reasoning …

A Theory Of Customary International Law, Jack L. Goldsmith, Eric A. Posner Sep 1999

A Theory Of Customary International Law, Jack L. Goldsmith, Eric A. Posner

University of Chicago Law Review

This Article presents a theory of customary international law ("CIL") that seeks to resolve the many well-known difficulties with standard accounts of CIL. The theory uses simple game theoretical concepts to explain how CIL arises, why nations "comply" with CIL as commonly understood, and how CIL changes. This theory rejects the usual explanations of CIL based on opinio juris, legality, morality, and related concepts. States do not comply with norms of CIL because of a sense of moral or legal obligation; rather, their compliance and the norms themselves emerge from the states' pursuit of self-interested policies on the international stage. …

Operational Risk Management And Military Aviation Safety, Park D. Ashley Sep 1999

Operational Risk Management And Military Aviation Safety, Park D. Ashley

Theses and Dissertations

The Air Force Class A aviation mishap rate has hovered around 1.5 mishaps per 100,000 flight hours since 1985. Recent attention on Air Force accidents has caused the leadership to seek to reduce its mishap rate. The Army's Class A aviation mishap rate declined after it implemented risk management (RM) principles in 1987. This reduction caught the attention of Air Force leadership who have since stated that the application of operational risk management (ORM) is how the Air Force will reduce, even eliminate, mishaps. With current budget constraints, ORM is considered to be the most cost-effective way the Air Force …

A number of examples of violence that occurred within Air Force workplaces highlighted the threat for Air Force leadership. With over 1,680 incidents of workplace violence reported to the AFOSI in a 5-year …

Loma Linda University Electronic Theses, Dissertations & Projects

This study addresses the use of scales and subscales from prehire MMPI’s to predict levels of aggression and stress among law enforcement professionals in the field (n=75). Multiple regression analysis revealed promising results in support of the MMPI’s predictive utility.

Two scales, Aggression (AGR) and Stress Vulnerability (SYS) were developed as outcome measures through a three step validation process: (a) theoretical-substantive, through a literature review and analysis of pilot data (n = 202); (b) internal-structural, statistical analysis on sample data and (c) criterion-external, through corelational analysis with externally derived departmental assessments of each officer. From Comparative Literature Today Toward Comparative Cultural Studies, Steven Tötösy De Zepetnek

CLCWeb: Comparative Literature and Culture

In his article "From Comparative Literature Today Toward Comparative Cultural Studies" Steven Tötösy de Zepetnek proposes a theoretical approximation of already established and current aspects of the discipline of comparative literature and the field of cultural studies. "Comparative cultural studies" is conceived as an approach with three areas of theoretical content: 1) To study literature (text and/or literary system) with and in the context of culture and the discipline of cultural studies; 2) In cultural studies itself to study literature with borrowed elements (theories and methods) from comparative literature; and 3) To study culture and its composite parts and aspects …

A qualitative inquiry in four Early Head Start Research sites explored the question of how low-income mothers and fathers view the role of fathers in their families. Role perceptions were gathered from a total of 56 parents of infants and toddlers across the four sites, using multiple data collection methods that included focus groups, open-ended interviews, and one case study. The data were analyzed to identify common themes across sites. Intermunicipal Agreements: The Metamorphosis Of Home Rule , Mary E. Mohnach

Pace Environmental Law Review

This Comment discusses the use of intermunicipal agreements in New York State. Until recently, Home Rule Authority governed most, if not all of the municipalities in New York. Intermunicipal agreements have suddenly become a useful instrument in the regulation of wetlands and other precious resources extending beyond municipality borders. This Comment examines a variety of different intermunicipal agreements that have been entered into by numerous communities in an effort to preserve or protect an area of their community that expands beyond the authority granted to them under Home Rule Authority. This Comment suggests the most effective and efficient mechanisms for …

Why Al Gore Will Not Be Elected President In 2000, Aubrey Immelman Sep 1999

Why Al Gore Will Not Be Elected President In 2000, Aubrey Immelman

Psychology Faculty Publications

This article highlights the key role of extraversion with reference to electoral success in U.S. presidential elections since the advent of television and argues that the introverted Al Gore will therefore not be elected president in 2000. Starting with Franklin D. Roosevelt, nearly every U.S. president has been extraverted relative to other U.S. presidents, except for Richard Nixon, Gerald Ford, and Jimmy Carter. Moreover, since the first televised presidential debate (between John F. Kennedy and Richard Nixon) in 1960, the more outgoing candidate has consistently won the election, with the exception of Nixon in 1968 and 1972.

The Place Of Historical Research In Social Work, Robert Fisher, Phillip Dybicz Sep 1999

The Place Of Historical Research In Social Work, Robert Fisher, Phillip Dybicz

The Journal of Sociology & Social Welfare

This study addresses the incidence, persistence, decline, and marginalization of historical research in social work by examining one indicator of that research, social work dissertations. This study reveals that despite the dominance of other research methods, historical research was a legitimate method for doctoral research in social work, but its use has declined over time. Before World War II historical dissertations were common. Through the 1950s almost 13% of all social work dissertations were historical. In the 1960s and 1970s interest in history as a research method declined, but social welfare history was still a legitimate option for doctoral research. …
