The Leak And The Craft: A Hard Line Proposal To Stop Unaccountable Disclosures Of Law Enforcement Information, John Q. Barrett Jan 1999

The Leak And The Craft: A Hard Line Proposal To Stop Unaccountable Disclosures Of Law Enforcement Information, John Q. Barrett

Faculty Publications

The critics of Kenneth W. Starr accused him, in the five-plus years that he served as the multi-tasked Independent Counsel, of many failings, mistakes, and improprieties. One of the most prevalent charges was one that has significance to lawyers and resonates with the general public's sense of bad behavior by prosecutors: the allegation that Starr and/or members of his staff "leaked" information. This general accusation was, of course, imprecise. It also might have been overbroad. Prosecutorial "leaks" include such plain illegalities as disclosing grand jury information to the media or other unauthorized persons, and also the much less regulated practice …

Guarding The Gate To The Courthouse: How Trial Judges Are Using Their Evidentiary Screening Role To Remake Tort Causation Rules, Lucinda M. Finley

Journal Articles

The article looks at what trial judges are actually doing in toxic tort cases in the post-Daubert world; it reviews and critiques cases in which judges have in effect adopted a new rule of causation law that requires plaintiffs to rely on epidemiology, and in particular epidemiology that demonostrates an increase in relative risk of 2.0 or greater; the article considers the substantive as well as the normative implications of this legal treatment of epidemiology.

Dynamic Modeling Of Pwm And Single-Switch Single-Stage Power Factor Correction Converters, Guangyong Zhu Jan 1999

Dynamic Modeling Of Pwm And Single-Switch Single-Stage Power Factor Correction Converters, Guangyong Zhu

Retrospective Theses and Dissertations

The concept of averaging has been used extensively in the modeling of power electronic circuits to overcome their inherent time-variant nature. Among various methods, the PWM switch modeling approach is most widely accepted in the study of closed-loop stability and transient response because of its accuracy and simplicity. However, a non-ideal PWM switch model considering conduction losses is not available except for converters operating in continuous conduction mode (CCM) and under small ripple conditions. Modeling of conductor losses under large ripple conditions has not been reported in the open literature, especially when the converter operates in discontinuous conduction mode (DCM). …

The African Human Rights Court: A Two-Legged Stool?, Makau Wa Mutua Jan 1999

The African Human Rights Court: A Two-Legged Stool?, Makau Wa Mutua

Journal Articles

This article examines the African continental human rights system that is built on the African Charter on Human and Peoples’ Rights. It pays particular attention to the deficits of that system and argues that the establishment of the African Court on Human and Peoples’ Rights – a judicial body meant to strengthen the protection of human rights in Africa – falls far short. It exposes the normative and structural shortcomings that render the court virtually meaningless. It concludes that the court serves very little purpose except to address the enormous human rights challenges facing Africa.

"Private" Environmental Regulation, Human Rights, And Community, Errol E. Meidinger Jan 1999

"Private" Environmental Regulation, Human Rights, And Community, Errol E. Meidinger

Journal Articles

Private organizations have recently established numerous programs aimed at improving the environmental performance of industry. Many of the new programs seek to define and enforce standards for environmental management, and to make it difficult for producers not to participate in them. They claim, explicitly and implicitly, to promote the public interest. They take on functions generally performed by government regulatory programs, and may change or even displace government programs. Private programs thus have the potential to significantly reshape domestic and international policy institutions.

This paper describes three major private environmental regulatory programs applicable to forestry and discusses their implications for …

The Politics Of Immigration Control In Britain And Germany: Subnational Politicians And Social Movements, Roger Karapin Jan 1999

The Politics Of Immigration Control In Britain And Germany: Subnational Politicians And Social Movements, Roger Karapin

Publications and Research

Political backlash against immigrant minorities and restrictive immigration policies have increased in western Europe. Most explanations of the adoption of restrictions on immigration have focused on ethnic competition for material resources and on national political factors. An alternative theory of political mobilization and restrictive policy changes argues that pressure from subnational politicians and social movement organizations and signals from dramatic anti-immigrant events such as riots lead national elites to infer that public interest in anti-immigration policies is intense enough to justify a break with liberal policies. This theory is tested against four cases in Britain and Germany, where the hypothesized …

A Study Of Package Handling Drops In The United States Postal Service, Thomas Kausch Jan 1999

A Study Of Package Handling Drops In The United States Postal Service, Thomas Kausch

Theses

The objective of this study was to measure drop heights environment within the United States Postal Service. A popular belief has been that the United States Postal Service provided a handling environment that was more severe than other small parcel carriers. Previous studies of small package carriers have documented the handling environments of those carriers. The data gathered during the course of this study were compared to those results. The intent of this study was to provide data that would indicate that the Unites States Postal Service did not provide a handling environment that was more severe than competing carriers. …
