Supreme Court Voting Behavior: 1997 Term, Richard G. Wilkins, Scott L. Worthington, David M. Buchanan, R. Chad Hales

UC Law Constitutional Quarterly

This Article is the thirteenth consecutive annual study tabulating and analyzing the voting behavior of the United States Supreme Court. This Article examines the Court's voting behavior during the 1997 Term. The study attempts to determine whether individual Justices and the Court as a whole are voting more "conservatively," more "liberally," or about the same as compared with past Terms.

Whether a vote is considered "conservative" or "liberal" depends upon the issues being decided. Generally, votes favoring the assertion of governmental power are "conservative," while votes favoring claims of individual liberty are considered "liberal." The issues are categorized into ten …

Less Law, But More Justice?: Jury Trials And Mediation As Means Of Resolving Will Contests, Ronald Chester Jan 1999

Less Law, But More Justice?: Jury Trials And Mediation As Means Of Resolving Will Contests, Ronald Chester

Duquesne Law Review

The common law emphasis on testamentary intent and undue influence in resolving will contests may overshadow fair distribution. The author presents verdict data from various probate court systems to examine the effectiveness of jury trials and alternative dispute resolution as methods of settling will contests. The author advocates probate court systems that afford will contestants the opportunity to mediate disputes and obtain jury trials in addition to, or in place of, judicial resolutions.

Evidence - Attorney-Client Privilege - Survival Of The Privilege After The Client's Death, James F. Glunt

Duquesne Law Review

The United States Supreme Court held that the federal evidentiary attorney-client privilege survives the client's death and therefore protects an attorney's notes taken during a client meeting from discovery by a federal grand jury when the client died shortly after the meeting and the notes are sought because of their relevance to a criminal investigation conducted by the Office of Independent Counsel.

Swidler & Berlin v. United States, 118 S. Ct. 2081 (1998).

A Primer On Mdps: Should The No Rule Become A New Rule, Laurel Terry Jan 1999

A Primer On Mdps: Should The No Rule Become A New Rule, Laurel Terry

Faculty Scholarly Works

This article is the second of four major articles or book chapters that I have written about MDPs. "MDPs" refers to multidisciplinary partnerships or multidisciplinary practices between lawyers and nonlawyers. Prior to 1998, virtually all U.S. states had lawyer discipline rules that prohibited a lawyer from sharing legal fees with a nonlawyer or practicing law in partnership with a nonlawyer. In 1998, however, the American Bar Association created a Commission on Multidisciplinary Practice to reconsider these rules. One impetus for the creation of this Commission was the increasingly large numbers of lawyers who were working for the Big 5 Accounting …

Some Historical, Theoretical And Applied Aspects Of Quantitative Water Mass Analysis, Matthias Tomczak Jan 1999

Some Historical, Theoretical And Applied Aspects Of Quantitative Water Mass Analysis, Matthias Tomczak

Journal of Marine Research

The concept of water masses is reviewed from the point of view of quantitative water mass analysis. A theoretical framework is presented which describes the life history of water masses in terms of formation, consolidation, aging and decay. Water masses are described as physical entities and compared with their atmospheric counterparts (air masses). The classical temperature-salinity diagram is expanded into the mathematical concept of water types in an n-dimensional parameter space. Water types and their standard deviations are introduced as the foundation for quantitative water mass analysis. The relationship between parameter space and physical space is established through the …
