The Liability Of Certification Authorities To Relying Third Parties, 17 J. Marshall J. Computer & Info. L. 961 (1999), Michael J. Osty, Michael Pulcanio

UIC John Marshall Journal of Information Technology & Privacy Law

As Internet technology continues to expand and individuals continue to "log-on" at an ever-increasing rate, business transactions via computers have quickly expanded. Electronic commerce has become a widely accepted way of entering transactions and consummating deals. Consequently, millions and even billions of dollars change hands in transactions utilizing electronic commerce daily. These transactions are conducted between individuals who often have had no prior business relationship with each other. As a result, the need for a trusted third party to authenticate these transactions has become absolutely necessary. However, the laws governing the financial responsibility of these trusted third parties, or certification …

UIC John Marshall Journal of Information Technology & Privacy Law

The purpose of this Article is to establish the importance of information law and to encourage its further study. By applying information technology theory, economic theory and, and political theory insights, the Article examines the centrality of information law in open societies. Information law rests upon two premises. The first of which is that information is a legally cognizable concept- that it can be framed in legal terms and has legal significance. The second premise is that there exists a rationale for government regulation and provision of information, either explicitly or implicitly. Transparency is a flexible concept used in a …

UIC John Marshall Journal of Information Technology & Privacy Law

This article begins with a comparison of UCITA and UCC Article 2 and shows how much less restraint the drafters had while drafting the UCITA in early 1995. It was during this time that UCC Article 2 was still undergoing revision. This article continues with the author's detailed examination of the underlying major structural and policy defects in UCITA that require the drafters' attention before it is made into law. The author defines the scope of UCITA as being too broad. Furthermore, the author deconstructs and criticizes various sections of UCITA.

Measurement Of Technical Efficiency In Public Education: A Stochastic And Nonstochastic Production Function Approach, Kalyan Chakraborty, Basudeb Biswas, W. Cris Lewis Jan 1999

Measurement Of Technical Efficiency In Public Education: A Stochastic And Nonstochastic Production Function Approach, Kalyan Chakraborty, Basudeb Biswas, W. Cris Lewis

Economic Research Institute Study Papers

This paper uses both the stochastic and nonstochastic production function approach to measure technical efficiency in public education in Utah. The stochastic specification estimates technical efficiency, assuming half normal and exponential distributions. The nonstochastic specification uses two-stage DEA to separate the effects of fixed inputs on the measure of technical efficiency. The empirical analysis shows substantial variation in efficiency among school districts. While these measures are insensitive to the specific distributional assumptions about the one-sided component of the error term in stochastic specification, they are sensitive to the treatment of fixed socioeconomic inputs in the two-stage DEA.

The Stability Of Stochastic Systems: The Case Of Persistence And Resilience, Amitrajeet A. Batabyal, Hamid Beladi Jan 1999

The Stability Of Stochastic Systems: The Case Of Persistence And Resilience, Amitrajeet A. Batabyal, Hamid Beladi

Economic Research Institute Study Papers

Beginning with the seminal work of K. J. Arrow and L. Hurwicz, there now exists a vast literature in economics on the stability of economic systems. This notwithstanding, to the best of our knowledge, the economics literature does not contain any studies of the stability of jointly determined, stochastic ecological-economic systems. Consequently, the objective of this paper is to identify and mathematically characterize two stability concepts for such systems.

Children's Folklore, Brian Sutton-Smith, Jay Mechling, Thomas W. Johnson, Felicia R. Mcmahon Jan 1999

Children's Folklore, Brian Sutton-Smith, Jay Mechling, Thomas W. Johnson, Felicia R. Mcmahon

All USU Press Publications

A collection of original essays by scholars from a variety of fields—including American studies, folklore, anthropology, psychology, sociology, and education—Children's Folklore: A Source Book moves beyond traditional social-science views of child development. It reveals the complexity and artistry of interactions among children, challenging stereotypes of simple childhood innocence and conventional explanations of development that privilege sober and sensible adult outcomes. Instead, the play and lore of children is shown to be often disruptive, wayward, and irrational. The contributors variably con-sider and demonstrate "contextual" and "textual" ways of studying the folklore of children. Avoiding a narrow definition of the subject, they …

Record Of Decision Carbon Basin Coal Project, United States Department Of Interior Bureau Of Land Management

Record of Decisions (WY)

The Final Environmental Impact Statement (FEIS) for the Carbon Basin Coal Project was released to the public on January 8, 1999. This document considered and evaluated the impacts of issuing the proposed Elk Mountain/Saddleback Hills competitive coal lease (WYW139975) under the provisions of 43 CFR 3425.1, as a lease by application (LBA). The area proposed for mining is a mixture of private, state, and federal surface and coal estates. If the applicant, Ark Land Company, is the successful bidder, they propose to mine surface and underground federal coal reserves along with their privately-owned coal to make an efficient and economical …

On Species Substitutability, Resilience, And The Optimal Management Of Ecological-Economic Systems, Amitrajeet A. Batabyal Jan 1999

On Species Substitutability, Resilience, And The Optimal Management Of Ecological-Economic Systems, Amitrajeet A. Batabyal

Economic Research Institute Study Papers

The significance of the concept of resilience in determining the static and the dynamic behavior of jointly determined ecological-economic systems has been recognized by ecologists at least since Holling (1973). This notwithstanding, there are very few formal studies of such systems that analyze the ecological and the economic aspects of the problem. Consequently, this paper has two objectives. First, a new renewal theoretic measure of resilience is proposed. This measure explicitly accounts for the role of species substitutability in determining ecological resilience. Next, this measure is used to study some aspects of the optimal management of ecological-economic systems.

Quantifying The Transient Response Of Ecological-Economic Systems To Perturbations, Amitrajeet A. Batabyal Jan 1999

Quantifying The Transient Response Of Ecological-Economic Systems To Perturbations, Amitrajeet A. Batabyal

Economic Research Institute Study Papers

Ecologists and economists are increasingly in agreement that ecological and economic systems are linked and that these systems should actually be viewed as one system. Perhaps because this recognition has been very recent, neither ecologists nor economists have studied the short term behavior of jointly determined ecological-economic systems that are subject to perturbations stemming from natural events and the continuance of economic activities. Consequently, the purpose of this paper is to construct a metric that can be used to quantify the transient response of ecological-economic systems to perturbations. This metric is a non-asymptotic measure of an ecological-economic system's resilience.

This report describes West Virginia's Basic Skills/Computer Education (BS/CE) program and connects its features to gains in student test scores that are practically and statistically significant. The program consists of three components: (1) software that focuses on the state's basic skills goals in reading, language arts, and mathematics; (2) enough computers in the schools so that all students will be able to have easy and regular access to the basic skills software; and (3) professional development for teachers in the use of the software and the use of computers in general. Data were collected from all fifth graders (n=950) in …

Management For The Red Gulch Dinosaur Tracksite Big Horn County, Wyoming, Environmental Assessment, United States Department Of The Interior, Bureau Of Land Management

Environmental Assessments (WY)

A review of existing land-use planning decisions is being conducted to evaluate how to best manage public lands, resources, educational opportunities, and other values associated with the recent discovery of dinosaur tracks on BLM-administered public lands near Shell, Wyoming. The tracks were not addressed in the Washakie Resource Management Plan (RMP) which was completed in 1988. A review of BLM's planning decisions for the discovery area is needed to evaluate the adequacy of existing management prescriptions for the protection of the tracks and related values.
