Humpty Dumpty On Mens Rea Standards: A Proposed Methodology For Interpretation, Katherine R. Tromble Mar 1999

Humpty Dumpty On Mens Rea Standards: A Proposed Methodology For Interpretation, Katherine R. Tromble

Vanderbilt Law Review

"When I use a word.., it means just what I choose it to mean-neither more nor less.", This statement by Humpty Dumpty sets forth the argument of this Note: words used to describe mens rea in federal criminal statutes have plain, ordinary meanings. When the United States Supreme Court interprets these statutes, it should do so according to the words' plain meanings. Because the Court has not used this approach in past cases, the law of mens rea on the federal level is confusing and inconsistent.

The Court has tried to repair poorly drafted statutes by interpreting them in various …

The last half-century has seen momentous and accelerating changes in humankind's economic activities, political relations, and social and demographic profile. A prominent feature of this change is the increasing scale of human impact on Earth's natural biophysical systems: the climate system, stratospheric ozone, biodiversity, terrestrial and marine food-producing ecosystems, and the great cycles of water, nitrogen, and sulfur (Meyer 1996, Vitousek et al. 1997). These systems sustain the conditions on which life depends, and their weakening may therefore have profound long-term implications for human population health (McMichael 1993, Last 1997).

Interpreting Patterns Of Gene Expression With Self-Organizing Maps: Methods And Application To Hematopoietic Differentiation, Pablo Tamayo, Donna Slonim, Jill Mesirov, Qing Zhu, Sutisak Kitareewan, Ethan Dmitrovsky Mar 1999

Interpreting Patterns Of Gene Expression With Self-Organizing Maps: Methods And Application To Hematopoietic Differentiation, Pablo Tamayo, Donna Slonim, Jill Mesirov, Qing Zhu, Sutisak Kitareewan, Ethan Dmitrovsky

Dartmouth Scholarship

Array technologies have made it straightforward to monitor simultaneously the expression pattern of thousands of genes. The challenge now is to interpret such massive data sets. The first step is to extract the fundamental patterns of gene expression inherent in the data. This paper describes the application of self-organizing maps, a type of mathematical cluster analysis that is particularly well suited for recognizing and classifying features in complex, multidimensional data. The method has been implemented in a publicly available computer package, GENECLUSTER, that performs the analytical calculations and provides easy data visualization. To illustrate the value of such analysis, the …

Beyond "Marbury": Jurisdictional Self-Dealing In "Seminole Tribe", Laura S. Fitzgerald Mar 1999

Beyond "Marbury": Jurisdictional Self-Dealing In "Seminole Tribe", Laura S. Fitzgerald

Vanderbilt Law Review

In Seminole Tribe v. Florida, the Supreme Court held that the Constitution's Article III embodies a principle of state sovereign immunity which so constrains the federal judicial power that it prohibits Congress from granting federal courts subject matter jurisdiction over private lawsuits to enforce Article I legislation against states. At the same time, however, and again in Idaho v. Coeur d'Alene Tribe, the Court reaffirmed its own Ex parte Young doctrine, under which the Court itself unilaterally granted federal courts subject matter jurisdiction over private lawsuits to coerce states to comply with federal law despite state sovereign immunity. Neither in …

The Use Of The Nonprofit "Defense" Under Section 7 Of The Clayton Act, Amanda J. Vaughn Mar 1999

The Use Of The Nonprofit "Defense" Under Section 7 Of The Clayton Act, Amanda J. Vaughn

Vanderbilt Law Review

Since the early 1980s, for-profit and nonprofit hospitals have undergone an unprecedented number of mergers,' reflecting the dramatic changes in the health care industry. The Federal Trade Commission ("FTC") and Department of Justice ("DOJ") have challenged mergers of both types of hospitals. Recently, however, a handful of nonprofit hospitals have offered nonprofit status as a "defense" to federal challenges to nonprofit hospital mergers. Although not a complete defense-nonprofit status alone does not remove the entity from antitrust scrutiny-a limited "defense" has evolved as nonprofit hospitals claim that a nonprofit merger is less likely to have anti- competitive effects than an …

In Defense Of The Good Samaritan, Hanoch Dagan Mar 1999

In Defense Of The Good Samaritan, Hanoch Dagan

Michigan Law Review

In the year 1880, in Dalles City, Oregon, a large and valuable load of lumber fell into the Columbia River and was about to be carried away by the river's waters. Since Savage, the owner of this lumber, was absent from the scene, Glenn - who, at that time, was doing construction work for Savage - "furnished help and did service" in saving the lumber "from being washed away and lost." Seven years later, the Supreme Court of Oregon rejected Glenn's claim that Savage owed him "the reasonable value" of his services as well as of the services of the …

This qualitative research study has explored the lives of 13 women who were widowed before the age of 55, who are professionals, educators, businesswomen, and community activists, to learn how their lives have been transformed since the death of their spouse. For this study, the death of a spouse was seen as a transforming event in the life of a married woman. The nature of this transformation varied with each respondent. Portraiture was the primary biographical methodology used. Purposive sampling provided the opportunity to interview women from diverse backgrounds. Five global, open-ended interview questions were used and demographic data were …

The Practitioner From Within: Revisiting The Virtues, Frances Grodzinsky Mar 1999

The Practitioner From Within: Revisiting The Virtues, Frances Grodzinsky

School of Computer Science & Engineering Faculty Publications

Traditionally the study of computer ethics involves taking students who are not philosophically trained, exposing them to action-guiding theories, presenting them with the codes of ethics of several companies and professional organizations and asking them to make ethical decisions in scenario-based cases. This approach is deliberately action-based and focuses on doing. "What would you do?" is the traditional question we ask our students. While this pedagogical methodology forces them to examine situations and argue from a particular point of view, it does little to influence their character. They see the utilitarian or deontologist as someone other than themselves. There seems …

The First Hong Kong Special Administrative Region Legislative Council Elections, James T. H. Tang Mar 1999

The First Hong Kong Special Administrative Region Legislative Council Elections, James T. H. Tang

Research Collection School of Social Sciences

The Legislative Council (Legco) Elections in Hong Kong on May 24, 1998, isthe first open multiparty electoral competition in the People's Republic of China(PRC). Since Chinese leaders have repeatedly rejected Western-style democracyor multiparty competition for China, the extent to which the Hong Kong experiencewould serve as a model for political developments on the mainland isclearly limited. Nonetheless, political changes in Hong Kong has to be seen aspart of China's experience following their reunion. Under the "one country, twosystems" formula, Hong Kong is given the freedom to conduct its own internalaffairs as a Special Administrative Region (SAR), but the formation of …

Relational And Physical Forms Of Peer Victimization In Preschool, Nikki R. Crick, Juan F. Casas, Hyon-Chin Ku Mar 1999

Relational And Physical Forms Of Peer Victimization In Preschool, Nikki R. Crick, Juan F. Casas, Hyon-Chin Ku

Psychology Faculty Publications

Recent studies of peer victimization have demonstrated the importance of studying relational as well as physical forms of peer maltreatment for understanding children's social-psychological adjustment problems. Studies in this area have been limited thus far by a focus on school-age children (9–12-year olds). Given the significance of early identification of children's social difficulties for intervention and prevention efforts, this research was designed to assess relational and physical peer victimization among preschool-age children (3–5-year-olds). Results indicated that boys were significantly more physically victimized than girls whereas girls were more relationally victimized. Both relational and physical victims experienced greater adjustment problems than …
