The Changing Politics Of American Bankruptcy Reform, Elizabeth Warren Apr 1999

The Changing Politics Of American Bankruptcy Reform, Elizabeth Warren

Osgoode Hall Law Journal

The political atmosphere in which changes to the American bankruptcy laws occur has shifted since the adoption of the 1978 amendments to the United States Bankruptcy Code. Bankruptcy professionals, who once effectively controlled much of the legislative debate, have lost ground to creditors, who have become much more powerful in influencing bankruptcy legislation. The result has been the politicization of the debate and the setting of the stage for a series of amendments that have rhetorical appeal, but that do not reflect the underlying factual reality of the bankruptcy system.

Factors Which Contribute To Successful Schools For Disadvantaged Students: An Exploratory Case Study Of Two Urban Elementary Schools In Norfolk, Virginia, Lula Saunders Sawyer Apr 1999

Factors Which Contribute To Successful Schools For Disadvantaged Students: An Exploratory Case Study Of Two Urban Elementary Schools In Norfolk, Virginia, Lula Saunders Sawyer

Theses and Dissertations in Urban Services - Urban Management

This exploratory case study examines the perceptions of parents, teachers, students and principals on eight factors of school effectiveness. Two low income elementary schools in the City of Norfolk, Virginia served as the research setting for this study. Though both schools consist almost entirely of African American students, and are otherwise similar in demographics, they have achieved at different levels. While one has been recognized as a national model, based on continuous improvement in students' academic achievement, the other has not attained the same level of achievement, based on standardized test scores.

A case study methodology has been used to …

Organochlorine Pesticide Contamination In Neotropical Avifauna From Northwest Costa Rica, Virginia L. Flanagin '99 Apr 1999

Organochlorine Pesticide Contamination In Neotropical Avifauna From Northwest Costa Rica, Virginia L. Flanagin '99

Honors Projects

We collected baseline data on organochlorine (OC) pesticide contamination in resident passerine birds from northwest Costa Rica in an area where pesticides had not been used in at least 30 years. Results were compared with a previous study of OC contamination in mayfly larvae (Euthyplocia hecuba) collected from the same region. Thirteen OC compounds were detected in the ng/g range for 19 of 56 birds sampled, and the highest OC frequencies were found in birds collected from Pitilla, the site closest to agricultural areas. Atmospheric transport could be a mechanism by which the pesticides are traveling from agricultural areas to …

Tax Reform Proposals: Which One Is The Best?, Sunil Jagwani '00 Apr 1999

Tax Reform Proposals: Which One Is The Best?, Sunil Jagwani '00

The Park Place Economist

Lawmakers from both parties are proposing sweeping changes in the income tax system, but they achieve this in significantly different ways. The question is, which approach would be best for taxpayers and the economy? In order to answer this question, it is necessary to identify what is wrong with the current system and then determine how each reform plan addresses each of these flaws. The four most popular reform proposals are the Flat Tax, the Value Added Tax, the National Retail Sales Tax, and the USA Tax. In the following discussion, I will test these proposals on the different criteria …

Disabled Former Employees Under The Ada: Unprincipled Decisions And Unpalatable Results, Austin L. Mcmullen Apr 1999

Disabled Former Employees Under The Ada: Unprincipled Decisions And Unpalatable Results, Austin L. Mcmullen

Vanderbilt Law Review

A number of disabled former employees have turned to the Americans with Disabilities Act ("ADA") to redress alleged discrimination in their termination or in the benefit plans of their former employers.' Several courts, however, have held that these plaintiffs are not "qualified individual[s] with a disability," and, therefore, may not recover under the ADA. Other courts of appeals have recently found the ADA's proscription of discrimination in the "terms, conditions, and privileges of employment" to contradict the definition of qualified individuals. These courts resolved the ambiguity by allowing disabled former employees a federal right to sue their former employers for …

Stare Decisis In Historical Perspective: From The Founding Era To The Rehnquist Court, Thomas R. Lee Apr 1999

Stare Decisis In Historical Perspective: From The Founding Era To The Rehnquist Court, Thomas R. Lee

Vanderbilt Law Review

As numerous statistical studies have noted, the modern Supreme Court has overruled itself at a rate that far exceeds that which prevailed during the Court's early years. But is the accelerated rate a result of a decay in the Court's doctrine of stare decisis? Several critics have presumed so without engaging in any historical analysis. In this Article, Professor Lee offers a detailed historical examination of the evolution of the Supreme Court's overruling rhetoric. The author traces the evolution of important strands of the Rehnquist Court's doctrine of stare decisis from founding-era treatises to early applications in the Marshall and …

Demand-Side Determinants Of Wage Inequality, Corey Lorenzen Apr 1999

Demand-Side Determinants Of Wage Inequality, Corey Lorenzen

Major Themes in Economics

Since 1979, there has been an increasing gap in earnings between skilled and unskilled workers. Supply-side factors were shown to offset the demand shifts in the 1970’s, but the supply of college graduates stabilized during the 1980’s. As the wage inequality began to grow, focus turned to demand-side factors that contributed to the wage inequality. Three main factors were highlighted: changes in the industrial structure, international trade, and increased investment in technology. These factors expanded the relative demand for skilled workers, increasing the wage gap between skilled and unskilled workers. Increased educational subsidies is recommended as the best policy response.

Contextualism: The Supreme Court's New Standard Of Judicial Analysis And Accountability, Shalin Sugunasiri Apr 1999

Contextualism: The Supreme Court's New Standard Of Judicial Analysis And Accountability, Shalin Sugunasiri

Dalhousie Law Journal

Over the past few years, the "contextual approach" to law has acquired considerable cachet in juridical discourses across the country. In the Supreme Court of Canada, contextualism is now the new standard of judicial analysis and accountability This article analyzes a decade of Supreme court jurisprudence on Charter interpretation, statutory interpretation and the common law in order to fully explicate what contextualism in law is, where it came from, and how it has achieved its current pre-eminent status. The future promise of the contextual approach is also here canvassed through a dialectical engagement with postmodernist concerns respecting inherent legal indeterminacies.

A Comparative Policy Analysis On The Effectiveness Of Implementing Student Uniforms In Public School Districts Within The United State From 1993 Through 1998, Desiree Hiestand Apr 1999

A Comparative Policy Analysis On The Effectiveness Of Implementing Student Uniforms In Public School Districts Within The United State From 1993 Through 1998, Desiree Hiestand

UNLV Theses, Dissertations, Professional Papers, and Capstones

The purpose of this study is to compare and analyze student uniform policies in public school districts within the United States and to ascertain whether or not they are effective. Available information from America's 70 largest school districts is collected and compared to determine if the policies are feasible. Findings indicate there is a broad spectrum of ways in which the districts address student attire and imply that most of the districts are not adapting uniform policies, but are leaving the decision up to individual schools and to the parents. Districts that are adapting policies boast favorable results. Although statistical …

Parental Attachment And Schizophrenia: Is There A Relationship?, Madonna Marie Terbock Apr 1999

Parental Attachment And Schizophrenia: Is There A Relationship?, Madonna Marie Terbock

Theses

Although current research has studied the relationship between parental attachment and mental disorders, the results have been inconclusive. This study attempted to further previous research and focus on the relationship between parental attachment and schizophrenia in specific. The subjects consisted of two groups, adults that have been diagnosed with schizophrenia, and adults that are mentally healthy. Subjects from both groups completed Parker's Parental Bonding Instrument (1979). The two groups' scores were compared in an attempt to establish a relationship between parental attachment and schizophrenia. The schizophrenic group reported significantly less care than the normal group. There was no significant difference …

Effects Of Organic Matter And Iron-Rich Clay On Mobility Of Trace Metals From Flue Dust Contaminated Soil, Scott Ephraim Lewis

OES Theses and Dissertations

The enhanced leaching of trace metals through soil becomes a concern for human health if dissolved trace metals reach groundwater and migrate into a public water system. A serial batch extraction procedure was implemented to determine the effects of Vitagrow © organic matter and Fe-Rich TM clay on the mobility of trace metals (Zn, Pb, and Cd) from a flue dust treated (0, 600, 1200, and 2400 μgig Zn) Appling soil.

The addition of an organic matter (OM) amendment to the Appling soil enhanced Pb mobility and reduced soluble Zn and Cd. In general, average solution concentrations of trace metals …

The methodology explores the application of the Travel and Tourism Satellite Accounts (TTSA's) to county level economic information in an attempt to develop a simplified method of estimating visitor spending at the local level. For this study, visitor spending reflects both Montana residents who reside outside of Missoula County as well as nonresident visitors to Montana.

Essay On Place The Map As Big As The World, Thomas Fox Averill Apr 1999

Essay On Place The Map As Big As The World, Thomas Fox Averill

Great Plains Quarterly (through 2013)

I have spent a lot of time looking at Kansas maps. Once, I memorized the shapes and names of all lOS counties. On another map, I drew in red magic marker over each highway after I had traveled it, hoping, someday, to have traveled every mile in this 200-by-400-mile rectangle. A huge old school map of Kansas, published by A. J. Nystrom & Co., Chicago, hangs in my east study windows instead of curtains or shades. On sunny mornings, it glows, and since its color comes from elevation- the "3,000 to 4,000 Feet" in western Kansas, to the "Under 1,000 …

Introduction Imagining Literary Landscapes, Susan J. Rosowski Apr 1999

Introduction Imagining Literary Landscapes, Susan J. Rosowski

Great Plains Quarterly (through 2013)

In compiling this issue of Great Plains Quarterly, Charlene Porsild responds to issues at the heart of the rising "new regionalism." One premise of the renewed interest in regionalism is that learning to navigate the virtual world of cyberspace means needing to know place in the actual world, and understanding mapping means learning how to orient oneself, how to read a landscape, and how to move from one place to another. The four essays presented here offer complementary responses to that challenge.

One's stance in time undergirds one's relation to place, as Walter Isle demonstrates in "History and Nature: …

An Overview Of The Biology Of The Brown Treesnake* (Boiga Irregularis), A Costly Introduced Pest On Pacific Islands, Gordon H. Rodda, Thomas H. Fritts, Michael J. Mccoid, Earl W. Campbell Iii Apr 1999

An Overview Of The Biology Of The Brown Treesnake* (Boiga Irregularis), A Costly Introduced Pest On Pacific Islands, Gordon H. Rodda, Thomas H. Fritts, Michael J. Mccoid, Earl W. Campbell Iii

United States Department of Agriculture Wildlife Services: Staff Publications

The 20-30 species of the genus Boiga (Colubridae, Boiginae) range from tropical Africa through southern Asia to Melanesia and Australia (Leviton, 1968). Collectively, they are known as catsnakes, mangrove snakes, or treesnakes (Obst et al., 1988; Greene, 1989). The common name "catsnakes" is sometimes used for snakes in the genus Telescopus as well (Obst et 1, 1988).

Members of the genus Boiga are nocturnal, oviparous, opisthoglyphic, euryphagic, and slender; they have vertical elliptical pupils (thus “cat” snakes) set in large eyes, and short, blunt heads that are noticeably larger than their necks. With one exception they are arboreal or semiarboreal …

A Cueing Procedure To Control Impulsivity In Children With Attention Deficit Hyperactivity Disorder, Heidi D. Posavac, Susan M. Sheridan, Steven S. Posavac Apr 1999

A Cueing Procedure To Control Impulsivity In Children With Attention Deficit Hyperactivity Disorder, Heidi D. Posavac, Susan M. Sheridan, Steven S. Posavac

Department of Educational Psychology: Faculty Publications

This study tested the efficacy of a cueing procedure for improving the impulse regulation of four boys with Attention Deficit Hyperactivity Disorder (ADHD) during social skills training. Impulse regulation was defined as raising hands before speaking. Effects on collateral behaviors (i.e., talking out of turn) were also assessed. A reversal design was used. Behavioral data collected by independent observers suggested that all subjects demonstrated positive changes in impulse regulation (i.e., an increase in the frequency with which subjects raised their hand before speaking). Likewise, the treatment effects appeared to have produced positive effects on a behavior not directly targeted for …

Is The Family Disappearing? Northern Great Plains Vs. National Trends In Family Structure, Larry D. Peterson Apr 1999

Is The Family Disappearing? Northern Great Plains Vs. National Trends In Family Structure, Larry D. Peterson

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

This study compares recent trends in family structure between the nation and the northern Great Plains states of Montana, Nebraska, North Dakota, and South Dakota, using census data from 1950 to 1990. I focus on patterns in two-parent and non-two parent families, and on married women in the labor force, to evaluate Popenoe's thesis that the American family has been declining since 1960. Two explanations for the differences from national trends have been proposed for families on the Great Plains: they are exceptions to national trends or they only lag behind national trends. Analysis of the rate of change from …

Review Of Ecology And Conservation Of Great Plains Vertebrates Edited By Fritz L. Knopf And Fred B. Samson, Rolf Koford

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

Focusing on the plight of natural ecosystems in the Great Plains, Fritz Knopf and Fred Samson give prominent coverage to the region's “charismatic megafauna" and provide an excellent overview of the ecology and conservation of most vertebrate taxa. The editors granted their individual authors considerable leeway, resulting in contributions that are authoritative but unintegrated with each other. For example, in the Preface and most of the chapters, the Great Plains includes the tall grass prairie as well as the short and mixed grass prairie traditionally associated with the Great Plains region. In chapters on wetlands and fishes, tall grass prairie …

Destructive And Non-Destructive Testing Of Bridge J857 Phelps County, Missouri : Strengthening And Testing To Failure Of Bridge Decks, Tarek Alkhrdaji, Antonio Nanni, Genda Chen, Michael G. Barker

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

Concrete bridges are conventionally reinforced with steel bars and/or prestressed with steel tendons. When subjected to aggressive environments, corrosion of the reinforcing and prestressing steel occurs and eventually leads to premature structural deterioration and loss of serviceability. In addition, the increasing service loads as well as seismic upgrade requirements result in a need to strengthen many of these bridges. The use of externally bonded steel plates for flexural and shear strengthening of concrete members is well established. However, corrosion related problems have limited the use of this technique for outdoor application. Fiber reinforced polymer (FRP) composites are corrosion resistant and …
