Establishing New Legal Doctrine In Managed Care: A Model Of Judicial Response To Industrial Change, Peter D. Jacobson, Scott D. Pomfret Jul 1999

Establishing New Legal Doctrine In Managed Care: A Model Of Judicial Response To Industrial Change, Peter D. Jacobson, Scott D. Pomfret

University of Michigan Journal of Law Reform

Courts are struggling with how to develop legal doctrine in challenges to the new managed care environment. In this Article, we examine how courts have responded in the past to new industries or radical transformations of existing industries. We analyze two historical antecedents, the emergence of railroads in the nineteenth century and mass production in the twentieth century, to explore how courts might react to the current transformation of the health care industry.

In doing so, we offer a model of how courts confront issues of developing legal doctrine, especially regarding liability, associated with nascent or dramatically transformed industries. Our …

The Competitive Impact Of Small Group Health Insurance Reform Laws, Mark A. Hall Jul 1999

The Competitive Impact Of Small Group Health Insurance Reform Laws, Mark A. Hall

University of Michigan Journal of Law Reform

This Article reports on findings from an extensive study of small group health insurance market reforms in seven states, enacted during the early 1990s. After summarizing the content and purpose of these reforms, this evaluation focuses on the impact these reforms have had on the nature and degree of market competition. The principal findings are: (1) small group health insurance markets are highly competitive, both in price and in product innovation and diversity; (2) although some insurers have left some or all of these states in part because of these reforms, an ample number of active competitors remain, even in …

Evaluation/Reflection

In 1993, the Nalional and Community Service Trust Act (PL. 103-82) established the Learn and Serve America School and Community-Based Programs to support school and Community-Based efforts to involve school-aged youth in community service. The Learn and Serve program is administered by the Corporation for National Service and funded through grants to states and national organizations, and through them to individual school districts, schools, and community organizations. In 1994-95, the first year of the program, the Corporation awarded approximately $30 million in grants supporting over 2,000 local efforts involving over 750,000 school-aged youth.

In Vivo Electrical Stimulation Of Motor Nerves, Robert B. Szlavik Jul 1999

In Vivo Electrical Stimulation Of Motor Nerves, Robert B. Szlavik

Biomedical Engineering

Stimulus waveform parameters and stimulation protocols are fundamental to the use of electrical stimulation in medical applications. This thesis presents new simulation and experimental procedures that for the first time can quantify the effects on nerve fiber recruitment patterns of variable stimulus waveform parameters, such as pulse width and changes in the stimulation protocol with respect to electrode orientation. The study of the effect of variable electrical stimulus waveform parameters and stimulation protocols is important from the perspective of therapeutic and diagnostic medicine. Variations in the stimulus waveform such as stimulus pulse width have been shown to offer some promise …

Bulletin 4369 - Ord River Irrigation Area - Kununurra Western Australia, Agriculture Western Australia

Bulletins 4000 -

The Ord River Irrigation Area (ORIA) in the Kimberley Province of Western Australia is the product of a bold and imaginative plan to develop part of the nation's tropical north for intensive agriculture by harnessing the waters of the Ord River. The principal features of the scheme are:

* A major storage reservoir formed by a dam constructed where the Ord River enters the Carr-Boyd Ranges, 160 kilometres south-east of Wyndham.

* A diversion dam, 50 kilometres further downstream, to raise the river level and divert water to be released from the major storage reservoir onto the irrigable lands.

* …

Dietary Assimilation Of Cadmium Associated With Bacterial Exopolymer Sediment Coatings By The Estuarine Amphipod Leptocheirus Plumulosus: Effects Of Cd Concentration And Salinity, Christian E. Schlekat, Alan W. Decho, G. Thomas Chandler Jul 1999

Decho, G. Thomas Chandler

Faculty Publications

Bacterial extracellular substances (also known as exopolysaccharides, or EPS) may serve as vectors for trophic transfer of metals in benthic systems because these ubiquitous sediment coatings can sorb high concentrations of toxic metals, and because many benthic invertebrates assimilate EPS sediment coatings upon ingestion. We conducted 3 sets of experiments to determine the assimilative bioavailability of EPS-associated Cd to the benthic amphipod Leptocheirus plumulosus as a function of Cd concentration and salinity. Bioavailability was measured as L. plumulosus Cd assimilation efficiency (AE) from EPS-coated silica (EPS●Si) and from uncoated silica (NC●Si) using modified pulse-chase methods with the gamma-emitting radioisotope 109 …

Morphogenesis Is Coordinated With Nuclear Division In Germinating Aspergillus Nidulans Conidiospores, Steven D. Harris Jul 1999

Morphogenesis Is Coordinated With Nuclear Division In Germinating Aspergillus Nidulans Conidiospores, Steven D. Harris

Department of Plant Pathology: Faculty Publications

Germinating Aspergillus nidulans conidiospores switch to polarized apical growth following an initial period of isotropic expansion. At the same time, they re-enter the nuclear division cycle. The relationship between spore polarization and nuclear division was investigated by testing the effect of cell cycle inhibitors and temperature-sensitive cell cycle mutations on spore morphogenesis. On rich media, it was found that spore polarization is delayed if completion of the first mitosis is blocked. The observed delay may be dependent upon the activity of the mitosis-promoting NIMA kinase. An additional mechanism appears to prevent polarization as the spore progresses through its first S …

Optimal Replication Activity Of Vesicular Stomatitis Virus Rna Polymerase Requires Phosphorylation Of A Residue(S) At Carboxy-Terminal Domain Ii Of Its Accessory Subunit, Phosphoprotein P, Leroy N. Hwang, Nathan Englund, Tapas Das, Amiya K. Florida, Asit K. Pattnaik Jul 1999

Optimal Replication Activity Of Vesicular Stomatitis Virus Rna Polymerase Requires Phosphorylation Of A Residue(S) At Carboxy-Terminal Domain Ii Of Its Accessory Subunit, Phosphoprotein P, Leroy N. Hwang, Nathan Englund, Tapas Das, Amiya K. Florida, Asit K. Pattnaik

School of Veterinary and Biomedical Sciences: Faculty Publications

The phosphoprotein, P, of vesicular stomatitis virus (VSV) is a key subunit of the viral RNA-dependent RNA polymerase complex. The protein is phosphorylated at multiple sites in two different domains. We recently showed that specific serine and threonine residues within the amino-terminal acidic domain I of P protein must be phosphorylated for in vivo transcription activity, but not for replication activity, of the polymerase complex. To examine the role of phosphorylation of the carboxy-terminal domain II residues of the P protein in transcription and replication, we have used a panel of mutant P proteins in which the phosphate acceptor sites …

Cullin-3 Targets Cyclin E For Ubiquitination And Controls S Phase In Mammalian Cells, Jeffrey D. Singer, Mark Gurian-West, Bruce Clurman, James M. Roberts Jul 1999

Cullin-3 Targets Cyclin E For Ubiquitination And Controls S Phase In Mammalian Cells, Jeffrey D. Singer, Mark Gurian-West, Bruce Clurman, James M. Roberts

Biology Faculty Publications and Presentations

Cyclin E is an unstable protein that is degraded in a ubiquitin- and proteasome- dependent pathway. Two factors stimulate cyclin E ubiquitination in vivo: when it is free of its CDK partner, and when it is phosphorylated on threonine 380. We pursued the first of these pathways by using a two-hybrid screen to identify proteins that could bind only to free cyclin E. This resulted in the isolation of human Cul-3, a member of the cullin family of E3 ubiquitin–protein ligases. We found that Cul-3 was bound to cyclin E but not to cyclin E-Cdk2 complexes in mammalian cells, and …

Regulating Doctors, Carl E. Schneider Jul 1999

Regulating Doctors, Carl E. Schneider

Articles

Alawyer today can hardly speak to a doctor--or even be treated by one-without being assailed by lawyer jokes. These jokes go well beyond good-humored badinage and pass the line into venom and gall. They reflect, I think, the sense many doctors today have that they are embattled and endangered, cruelly subject to pervasive and perverse controls. This is puzzling, almost to the point of mystery. Doctors have long been the American profession with the greatest social prestige, the greatest wealth, and the greatest control over its work. Indeed, what other profession has been as all-conquering? One may need to go …

Accelerated Reader: Does It Work?, Deborah J. Morse Jul 1999

Accelerated Reader: Does It Work?, Deborah J. Morse

Masters Theses

The purpose of this study was to determine if increased independent reading practice, as verified by 50 or more Accelerated Reader points, would significantly improve standardized reading scores. The reading practice and assessment performance of 60 first, second, and third grade students was monitored for eight months. The students were pre-tested and post-tested using the Standardized Test for the Assessment of Reading (S.T.A.R.). Descriptive statistics were used to determine if a significant difference existed between the overall mean scores of the high reading practice group who earned 50 or more Accelerated Reader points, versus the low reading practice group who …

The Relationship Between Vocabulary And Reading Comprehension In Junior High Aged Students With Learning Disabilities, Harvey Burkhour Jul 1999

The Relationship Between Vocabulary And Reading Comprehension In Junior High Aged Students With Learning Disabilities, Harvey Burkhour

Masters Theses

The purpose of this study was to investigate the relationship between the reading ability, particularly in the area of reading comprehension and the level of reading vocabulary possessed by junior high aged students with learning disabilities. Reading is a complex process involving the simultaneous integrated application of the four cuing systems: (a) graphophonic, (b) syntactic, (c) semantic, and (d) schematic. While most people learn to utilize these systems rather easily, this is not true for everyone. Failure to effectively employ any one or more of these cuing systems can spell disaster for the reader both in school and in many …
