The Role Of Rights In Benefit Cost Methodology: The Example Of Salmon And Hydroelectric Dams, Richard O. Zerbe Jr., Linda J. Graham Jul 1999

The Role Of Rights In Benefit Cost Methodology: The Example Of Salmon And Hydroelectric Dams, Richard O. Zerbe Jr., Linda J. Graham

Washington Law Review

Benefit cost analysis is a well-established technique for assessing the impacts of proposed actions. Accurate benefit cost analysis is essential to making informed decisions through an understanding of the trade-offs involved in alternative actions. This Article presents a methodology for improving current benefit cost techniques and hence the usefulness of benefit cost analysis to decisionmakers. The proposed methodology is based on recognition of the roles of legal rights and psychological expectations in benefit cost analysis. Proper consideration of these rights and expectations is critical to an accurate determination of how benefits and costs are measured and whose interests are included …

Environmental Behavior Of Hafnium: The Impact On The Disposition Of Weapons-Grade Plutonium, Gary S. Cerefice '89 Jul 1999

Environmental Behavior Of Hafnium: The Impact On The Disposition Of Weapons-Grade Plutonium, Gary S. Cerefice '89

Doctoral Dissertations

Experimental and analytical studies were performed to examine the environmental behavior of hafnium and its utility as a neutron poison for the disposition of weapons-grade plutonium in Yucca Mountain. The hydrolysis of hafnium was investigated by potentiometric titration in solutions of varying ionic strength to determine the stability constants for the first four monomeric hydrolysis products. The specific ion interaction theory is used to extrapolate these results to infinite dilution. The solubility of hafnium hydroxide and a meta-stable hafnium carbonate solid phase are studied via solubility experiments using ICP-AES. An upper bound for the stability constant of the first carbonate …

Challenges For Directors Of University Natural Science Museums, Hugh H. Genoways Jul 1999

Challenges For Directors Of University Natural Science Museums, Hugh H. Genoways

University of Nebraska State Museum: Mammalogy Papers

Universities and natural science museums have a long, productive history; however, this has been an uneasy alliance in the United States at least since the 1880s. Decreasing resources and increasing expectations have made the position of all museum directors extremely difficult, but the situation for university natural science museum directors is probably the most complicated among these because they direct museums that are small administrative units within larger university organizations. Some of their challenges include conflict between museum and university missions, governance issues, relationship between director and the university administrator/board member, lack of understanding of museum functions, middle management role …

The Impact Of Homeownership On The Life Satisfaction Of African-Americans, Edward Scanlon Jul 1999

The Impact Of Homeownership On The Life Satisfaction Of African-Americans, Edward Scanlon

Center for Social Development Research

The federal government has begun to move homeownership to the center of US housing policy. Economic recovery and minority homeownership programs have increased African-American homeownership to an all-time high in 1999. a primary assertion of homeownership advocates is that the life satisfaction of owner-occupiers is greater than that of renters. However, there is little literature to support this assertion, and little is known about whether homeownership is related to life satisfaction among African-Americans. This study tests that hypothesis and evaluates whether the impact of homeownership on life satisfaction is mediated by housing quality, residential stability, perceived neighborhood safety, and neighborhood …

The Subsidy Dependence Index And Recent Attempts To Adjust It, Mark Schreiner, Jacob Yaron Jul 1999

The Subsidy Dependence Index And Recent Attempts To Adjust It, Mark Schreiner, Jacob Yaron

Center for Social Development Research

The Subsidy Dependence Index (SDI) is the most common way to measure the importance of public support for Development Finance Institutions (DFIs). We present the SDI and show its equivalence to a subsidy-adjusted measure of return on equity. We then review recent attempts to adjust the SDI. As a whole, the recent measures are either meaningless or answer unimportant questions. Their use does not lead to a better understanding of the social cost of a DFI.

Economic Poverty Reconsidered: The Case For "Direct" Measures, Sondra G. Beverly Jul 1999

Economic Poverty Reconsidered: The Case For "Direct" Measures, Sondra G. Beverly

Center for Social Development Research

Although there has been much discussion in the United States regarding the definition of economic poverty, we continue to measure poverty almost exclusively in terms of current income. However, there are many reasons to supplement measures of income-poverty with “direct” measures of poverty, that is, with measures that capture the inadequate consumption of particular goods and services. First, direct and indirect measures of poverty represent alternative conceptions of poverty. Second, experiences of “direct” poverty are of both normative and instrumental concern. Third, direct measures of poverty have a number of practical uses, particularly in the context of welfare reform.

Competing On Quality Of Care: The Need To Develop A Competition Policy For Health Care Markets, William M. Sage, Peter J. Hammer

Law Faculty Research Publications

As American health care moves from a professionally dominated to a marketdominated model, concerns have been voiced that competition, once unleashed, will focus on price to the detriment of quality. Although quality has been extensively analyzed in health services research, the role of quality in competition policy has not been elucidated. While economists may theorize about non-price competition, courts in antitrust cases often follow simpler models of competition based on price and output, either ignoring quality as a competitive dimension or assuming that it will occur in tandem with price competition. This unsystematic approach is inadequate for the formulation of …

Appellate Practice And Procedure, William M. Droze, Andrea L. Siedlecki Jul 1999

Appellate Practice And Procedure, William M. Droze, Andrea L. Siedlecki

Mercer Law Review

Appellate practice and procedure often dictates the resolution of cases presented for review. Although procedural rules are not implemented in a vacuum, and the particular facts and legal questions raised by each case necessarily determine their application, an analysis of appellate practice provides a valuable tool in assessing judicial trends by portraying the judicial character in a manner that transcends the peculiar circumstances of a given case.

An evaluation of recent appellate practice reveals an increased emphasis on judicial economy and efficiency. During 1998, the Eleventh Circuit appeared aware of the necessity of providing practitioners, parties, and lower courts with …

Federal Sentencing Guidelines, James T. Skuthan, Rosemary T. Cakmis Jul 1999

Federal Sentencing Guidelines, James T. Skuthan, Rosemary T. Cakmis

Mercer Law Review

The Eleventh Circuit decided several cases this past year covering a broad range of United States Sentencing Guidelines ("U.S.S.G.") issues. Two areas of particular concern were firearms and departures.

Due to the 1995 Supreme Court decision in Bailey v. United States, several defendants had their firearm convictions vacated and were resentenced. Thus, the Eleventh Circuit in 1998 was faced with reviewing these resentencings to determine the applicability of guideline enhancements for firearms.

The court also decided several cases relating to downward departures based on cultural differences, a defendant's impulse control disorder, the over-representation of a career offender's prior record, …

Environmental Justice: Is Disparate Impact Enough?, Jimmy White Jul 1999

Environmental Justice: Is Disparate Impact Enough?, Jimmy White

Mercer Law Review

"Not in my backyard!" This simple statement and the vigorous efforts to enforce it have resulted over the last sixteen years in a growing movement in minority communities in search of what has been termed "environmental justice." It is claimed by activists, and proven in numerous studies, that minorities are more likely to be affected by the siting of hazardous waste facilities and the permitting of other hazardous waste producers than are whites. The causes of these inequities are neither uniform nor easily identifiable. Unfortunately, remedies may be equally elusive. Lack of resources, political power, and practical knowledge have proven …
