Past, Present And Future Constitutional Challenges To Transferable Development Rights, Jennifer Frankel Jul 1999

Past, Present And Future Constitutional Challenges To Transferable Development Rights, Jennifer Frankel

Washington Law Review

Seattle's transfer of development rights (TDR) system, an innovative land use device, has so far avoided many of the problems that have plagued other TDR systems. Although the system's voluntary participation avoids a takings challenge, it is still vulnerable to attack on due process grounds. In addition, two U.S. Supreme Court cases held that conditions in land use regulations must closely mirror the harms sought to be prevented, suggesting new constitutional problems for Seattle's TDR system. This Comment describes Seattle's current TDR system and examines its vulnerability to constitutional challenges. This paper concludes that while Seattle's TDR system will probably …

Minerva Teichert's Manti Temple Murals, Doris R. Dant Jul 1999

Minerva Teichert's Manti Temple Murals, Doris R. Dant

BYU Studies

President Gordon B. Hinckley's initiative to build many more temples around the world underscores how far many Latter-day Saints reside from their sacred buildings. In particular, travel to Utah's pioneer temples is frequently prohibitive. In the spirit of making temples accessible to all Latter-day Saints, this article brings to Saints worldwide an appreciative view of some of the Manti Temple murals.

Focus, Larry Burke (Editor) Jul 1999

Focus, Larry Burke (Editor)

FOCUS on Boise State

The danger, the excitement, the sheer rebellion of it all. In this issue, FOCUS examines the outdoor adventure sports revolution that is booming in Boise and across the nation. As the Treasure Valley becomes more urbanized, it may become more important to find ways to escape. Our fast-paced, technology-driven lifestyles also may push us to seek recreation that is highly stimulating. And some pursuits may appear less intimidating as they become more popular; encouraging even more of us to give them a try. On the cover; rock climber Tracy Goff scales a cliff overlooking the Boise River near Diversion Dam. …

Successive Causes And The Enigma Of Duplicated Harm, David A. Fischer Jul 1999

Successive Causes And The Enigma Of Duplicated Harm, David A. Fischer

Faculty Publications

Some of the most intriguing brain teasers in tort law involve the valuation of damages for harm arising from wrongfully inflicted injury to person or property. Consider the following example: A wrongdoer shoots and instantly kills a person in the path of an avalanche that would have killed the person a few seconds later. The person's survivors bring a wrongful death action against the shooter, seeking compensation for the loss of support they would have received from the decedent if she had lived. Should the court require the shooter to pay for loss of support beyond the time that the …
