The forthcoming book, edited and with an introduction by Professor of Law Carl E. Schneider, '79, incorporates papers delivered at the conference "Courting Death: A Constitutional Right to Suicide, "held at the Law School in November 1997. The conference was devoted to follow-up discussion of two decisions in summer 1997 in which the U.S. Supreme Court rejected the right to physician-assisted suicide, Washington v. Review Of People Places: Saskatchewan And Its Names By Bill Barry, T. D. Regehr
Review Of People Places: Saskatchewan And Its Names By Bill Barry, T. D. Regehr
Great Plains Quarterly (through 2013)
Bill Barry has collected a vast amount of information on the more than 25,000 place names in Saskatchewan and made it accessible in three publications. There is, first, a comprehensive computer database, arranged alphabetically but also sortable by location, date, or class of entry, available from the author and in many Saskatchewan libraries. Barry has always had a particular interest in a thematic approach to the study of place names, however, and People Places: Saskatchewan and Its Names provides much interesting and personalized information on the naming of many, but certainly not all of the places identified in the computer …

Personal Essay Margaret Laurence's Long Journey Home "I Love The Damn Country, That's The Trouble", Lyall H. Powers
Great Plains Quarterly (through 2013)
The subtitle comes from a letter Margaret Laurence wrote to Al Purdy on 31 October 1968, when she was still vacillating over her second reconciliation with her husband.! She was also looking ahead to her return to Canada to be Writer-in Residence at the University of Toronto for the academic year 1969-70, and vacillating over that as well. There is evident reluctance in her confession to Purdy about her attitude to Canada. Resistance to any favorable attitude to that country began early in her and accounts for two persistent features of her life and career as she struggled to establish …
Review Of Kate M. Cleary: A Literary Biography With Selected Works By Susanne K. George, Sharon M. Harris
Review Of Kate M. Cleary: A Literary Biography With Selected Works By Susanne K. George, Sharon M. Harris
Great Plains Quarterly (through 2013)
"Sometimes it seemed to her that she could endure everything save the silence." Thus begins Kate McPhelim Cleary's 1893 short story, "Feet of Clay"; like many of her best stories, it captures Plains settlers'-and Cleary's-pervasive sense of isolation in the harsh environment of the Midwest at the turn of the century. Having moved nine years earlier from Chicago to Hubbell, Nebraska, Cleary in her life and writings adds to our growing understanding of middle-class homesteaders who migrated to the Midwest in the late nineteenth century, and to our recognition of the important contributions of Midwestern women writers to nineteenth-century US …
Community-Based Organizations And Neighborhood Environmental Problem-Solving: A Framework For Adoption Of Information Technologies, Wendy A. Kellogg
Community-Based Organizations And Neighborhood Environmental Problem-Solving: A Framework For Adoption Of Information Technologies, Wendy A. Kellogg
All Maxine Goodman Levin School of Urban Affairs Publications
Community-based organizations (CBOs) today seek improved capacity to address environmental problems in urban neighbourhoods. Many seek access to information technologies such as the Internet and Geographic Information Systems (GIS) to expand information about their neighbourhood's environmental quality to support their planning and service efforts. Experience with the Internet has been bolstered somewhat by programmes to create community networks. This experience and experience with GIS in planning at the municipal and state levels reveals a set of technical, organizational and personal prerequisites that bolster successful and effective adoption of information technologies. This paper reviews these prerequisites as they pertain to CBOs …

Administrative Law, Terri L. Carver
Administrative Law, Terri L. Carver
Mercer Law Review
In 1998 the Eleventh Circuit Court of Appeals decided a handful of cases dealing with administrative law issues. One of the cases concerned the suspension of an Immigration and Naturalization Service ("INS") deportation order. The Eleventh Circuit upheld the INS Board of Immigration Appeals in denying plaintiffs the opportunity to apply for suspension of deportation. The court found that plaintiffs failed to make a prima facie case for suspension of deportation and abused the immigration rules in delaying their stay in the United States.
The court decided three cases involving exhaustion of administrative remedies as a prerequisite for judicial review. …

Antitrust, Michael Eric Ross, Jeffrey S. Cashdan
Mercer Law Review
In 1998 the Eleventh Circuit published eight antitrust opinions. Some of these cases turned on procedural issues; some were decided on the merits. As in previous years, defendants generally were successful, but not always. Each of these decisions is briefly summarized below.
Southern Card & Novelty, Inc. v. Lawson Mardon Label, Inc. concerned the legality of a "full-line forcing" arrangement. Defendant, Lawson Mardon Label, Inc. ("Lawson"), manufactured postcards, which it sold to distributors throughout North America for resale to retail outlets, which in turn sold them to consumers. Lawson manufactured "local view" postcards depicting nonlicensed local images (for example, …
Employment Discrimination, Peter Reed Corbin, Richard L. Ruth
Employment Discrimination, Peter Reed Corbin, Richard L. Ruth
Mercer Law Review
The 1998 survey period presented an extremely active year in the employment discrimination arena, not only for the Eleventh Circuit, but also for the United States Supreme Court.' Three key decisions were rendered by the Supreme Court on sexual harassment and same-sex discrimination, and another decision was rendered on the arbitrability of ADA claims. Yet, ironically, in this year of inordinate Supreme Court activity in the field of labor and employment law, the Court's arbitration decision did not "live up to the hype" of being a landmark decision on the legality of mandatory predispute arbitration of statutory discrimination claims. On …

This article specifically discusses decisions by the Eleventh Circuit under the Labor Management Relations Act ("LMRA"), the National Labor Relations Act ("NLRA"), the Fair Labor Standards Act of 1938 ("FLSA7), and the Employee Retirement Income Security Act of 1974 ("ERISA"). As in the years past, the Eleventh Circuit decided several cases that involved issues of interest in the area of traditional labor law. Due to page limitations, however, this Article cannot survey every …

In Defense Of Author Prominence: A Reply To Crespi And Korobkin, Tracey E. George, Chris Guthrie
Vanderbilt Law School Faculty Publications
We thank Greg Crespil and Russell Korobkin for their provocative responses to our author-prominence ranking of specialized law reviews. Crespi provides a thoughtful critique of the methodology we employ and the results we obtained. Korobkin shares some of Crespi's concerns, but he focuses his critique on the potential implications of our rankings (and rankings more generally). In this reply, we briefly address the more significant criticisms each of them raises.

Questioning Traditional Antitrust Presumptions: Price And Non-Price Competition In Hospital Markets, Peter J. Hammer
Questioning Traditional Antitrust Presumptions: Price And Non-Price Competition In Hospital Markets, Peter J. Hammer
University of Michigan Journal of Law Reform
Hospital mergers challenge basic assumptions about the effects of market power in the health care industry. Antitrust courts have struggled with claims that hospital mergers may in fact reduce costs and lower prices. This Article assesses the validity of these economic claims in the context of an industry that has undergone radical transformations in recent years. The Article also explores how such arguments should be treated as a matter of antitrust doctrine in an area of the law that relies heavily on market share presumptions and rule-based decision making. The Article contends that courts should employ a total welfare standard …
Playing Doctor: Corporate Medical Practice And Medical Malpractice, E. Haavi Morreim
Playing Doctor: Corporate Medical Practice And Medical Malpractice, E. Haavi Morreim
University of Michigan Journal of Law Reform
Although health plans once existed mainly to ensure that patients could pay for care, in recent years managed care organizations (MCOs) have attempted to limit expenditures by exercising significant influence over the kinds and levels of care provided. Some commentators argue that such influence constitutes the practice of medicine, and should subject MCOs to the same medical malpractice torts traditionally brought against physicians. Others hold that MCOs engage only in contract interpretation, and do not literally practice medicine.
This Article begins by arguing that traditional common law doctrines governing corporate practice of medicine do not precisely apply to the current …
