The Reauthorization Of The Elementary And Secondary Education Act In A Republican-Controlled Congress: A View From The Bishops’ Conference, William F. Davis

Journal of Catholic Education

The Elementary and Secondary Education Act (ESEA) of 1965, the largest single federal education program, is due to be reauthorized in 1999. ESEA is aimed at offering a variety of services to students and staff in public, private, and religious schools. For the first time, reauthorization will take place in a Congress with Republican majorities in both houses. The idea of the Republicans radically altering the program has been raised in many circles. This article addresses the purpose and history of ESEA as well as the prospects for any radical reshaping of the statute in the current reauthorization process.

Segmental Distribution Of Common Synaptic Inputs To Spinal Motoneurons During Fictive Swimming In The Lamprey, James T. Buchanan, Stefan Kasicki Sep 1999

Segmental Distribution Of Common Synaptic Inputs To Spinal Motoneurons During Fictive Swimming In The Lamprey, James T. Buchanan, Stefan Kasicki

Biological Sciences Faculty Research and Publications

These experiments were designed to measure the degree of shared synaptic inputs coming to pairs of myotomal motoneurons during swimming activity in the isolated spinal cord of the lamprey. In addition, the experiments measured the decrease in the degree of shared synaptic inputs with the distance between the motoneurons to assess the segmental distribution of these shared inputs. Intracellular microelectrode recordings of membrane potential were made simultaneously on pairs of myotomal motoneurons during swimming activity induced with an excitatory amino acid. The swim cycle oscillations of motoneuron membrane potentials were removed with a digital notch filter, thus leaving the fast …

Woman Battering And Welfare Reform: The View From A Welfare-To-Work Program, Lisa D. Brush Sep 1999

Woman Battering And Welfare Reform: The View From A Welfare-To-Work Program, Lisa D. Brush

The Journal of Sociology & Social Welfare

This research compares employment training program staff estimates (N = 118) and enrollee reports (N = 122) of woman battering, that is, the physical violence and other abuse men deploy against their wives and girlfriends. The vast majority of staff estimate that woman battering obstructs the transition from welfare to work for at least some of their clients. Overall, staff respondents' relative sense of the frequency of battering quite accurately reflects enrollee reports. However, staff are especially reluctant to give estimates of physical violence and injury. Moreover, many give very low estimates for those items that are obvious markers of …

A Guide To Monetary Sanctions For Environment Violations By Federal Facilities, Charles L. Green Sep 1999

A Guide To Monetary Sanctions For Environment Violations By Federal Facilities, Charles L. Green

Pace Environmental Law Review

Many federal environmental statutes require compliance by federal agencies by providing waivers of sovereign immunity. This Article explores the availability of civil penalties against the United States through an analysis of three United States Supreme Court decisions, encompassing the Clean Water Act, the Resource Conservation and Recovery Act, and the Comprehensive Environmental Response, Compensation, and Liability Act. It reviews the holdings in these cases to determine the efficacy of the waiver of federal sovereign immunity in each of these statutes, and develops a framework for analyzing the waiver available under the Clean Air Act. Ultimately, this Article concludes that the …

The Dumping Of The New Carissa: An Analysis Of The Emergency Provisions Of The London Convention, Jill S. Murakami Sep 1999

The Dumping Of The New Carissa: An Analysis Of The Emergency Provisions Of The London Convention, Jill S. Murakami

Washington International Law Journal

The London Convention prohibits the dumping of hazardous materials into the ocean. This prohibition may, however, be suspended in emergencies. The bow of the M/V New Carissa ("New Carissa "), which contained approximately 135,000 gallons of oil, was dumped into the Pacific Ocean under the emergency provisions of the London Convention. An analysis of the dumping of the New Carissa illustrates the weaknesses of these provisions. As written, the provisions are ambiguous and open to varying interpretations. As a result, nations may use the emergency provisions as loopholes to dump substances that they would otherwise be prohibited from dumping, thereby …
