When Is Transition Over?, Annette N. Brown Editor Jan 1999

When Is Transition Over?, Annette N. Brown Editor

Upjohn Press

The transition process in which a country moves from a planned economy to a market economy offers a unique opportunity for economists and policymakers to observe and understand the effects of major institutional, legal, and political changes on economic systems. But one feature of the process that has not been considered until now is when is the process over? When has a transition progressed far enough to ensure that a market system will survive and mature? Are there institutional, economic, and political standards that countries reach that measure the level of transition attained or, indeed, show that they have completed …

Steel Bridge Protection Policy: Life Cycle Cost Analysis And Maintenance Plan, Jon D. Fricker, Tarek Zayed, Luh M. Chang

JTRP Technical Reports

The study identifies various painting systems that are successfully used in Indiana's surrounding states and other industries. the identified systems are further screened and evaluated. After prudently comparing INDOT's inorgainc zinc/vinyl system with the waterborne acrylic system, the moisture cure urethane coating system and the 3-coat system of zinc-epoxy-urethane, the sresults show that thte new 3-coat system fulfills INDOT's needs with the most benefits. Therefore, the 3-coat system is recommended to replace INDOT present inorgaic zinc/vinyl system. To deal with the problems facing the lead-based paint, a comparison between full-removal and over-coating alternatives is made. Results show that over-coating might …

How Children In Cults May Use Emancipation Laws To Free Themselves, Robin A. Boyle Jan 1999

How Children In Cults May Use Emancipation Laws To Free Themselves, Robin A. Boyle

Faculty Publications

The author examines how children who are born into cults or brought into them at a young age can use state emancipation laws to gain independence when they are in their mid-teens, so long as they can demonstrate criteria that their states have established. Commonly, states require a showing that the minor has achieved some level of economic self-sufficiency and can live emotionally and physically independently from his or her parents. There are some difficulties for cultic children in demonstrating these criteria, but the obstacles are not insurmountable.

Diseases Of Meaning, Manifestations Of Health, And Metaphor, Peter J. Whitehouse Jan 1999

Diseases Of Meaning, Manifestations Of Health, And Metaphor, Peter J. Whitehouse

Faculty Scholarship

Disease and health are commonly thought of as distinct opposites. We propose a different view in which both may be seen to be facets of healthy functioning, each necessary for the other, each giving rise to the other. Thus, disease may be thought of as a manifestation of health. It is the healthy response of an organism striving to maintain physical, psychologic, and spiritual equilibrium. Disease is not necessarily to be avoided, blocked, or suppressed. Rather, it should be understood to be a process of transformation. The process should therefore be facilitated because it is an integral part of the …

"Half-Wracked Prejudice Leaped Forth:" Sanism, Pretextuality, And Why And How Mental Disability Law Developed As It Did, Michael L. Perlin

Articles & Chapters

Mental disability law jurisprudence is often incoherent Much of its incoherence can be explained by two concepts that dominate this area of the law: sanism (the irrational prejudices that cause, and are reflected in, prevailing social attitudes toward mentally disabled persons, and those so perceived) and pretextuality (the courts' acceptance -- either implicit or explicit -- of testimonial dishonesty and their decisions to engage in dishonest decisionmaking in mental disability law cases). Mental disability law is frequently premised on stereotypes and on prejudice, on typification and fear. These distortions reflect sanism; cases that sanction the use of such stereotypes and …

Guarding The Gate To The Courthouse: How Trial Judges Are Using Their Evidentiary Screening Role To Remake Tort Causation Rules, Lucinda M. Finley

Journal Articles

The article looks at what trial judges are actually doing in toxic tort cases in the post-Daubert world; it reviews and critiques cases in which judges have in effect adopted a new rule of causation law that requires plaintiffs to rely on epidemiology, and in particular epidemiology that demonostrates an increase in relative risk of 2.0 or greater; the article considers the substantive as well as the normative implications of this legal treatment of epidemiology.
