Face-Ing The Other: An Ethics Of Encounter And Solidarity In Legal Services Practice, Marie Failinger Jan 1999

Face-Ing The Other: An Ethics Of Encounter And Solidarity In Legal Services Practice, Marie Failinger

Faculty Scholarship

In this article, the author proposes that those who work in any capacity with impoverished clients and embattled minority communities imagine practice from within Levinas' key images. First, that ethics is first philosophy - that knowledge of the self, the Other and the context in which ethical action is possible does not precede ethical understanding, decision-making and action, but that rather that we become human in the ethical encounter with the incommensurable Other. Second, that representing a client is in each moment an encounter with the face of the Other. We look up into the face of the Other calling …

Count The Brown Faces: Where Is The “Family” In The Family Law Of Child Protective Services, Ana M. Novoa Jan 1999

Count The Brown Faces: Where Is The “Family” In The Family Law Of Child Protective Services, Ana M. Novoa

Faculty Articles

Can a system developed from intrusion into the lives of the poor be reconstituted to provide services that will nurture the quality of the lives of all children? If not, then the system should be scrapped and start over.
Child Protective Services (CPS) has never recovered from its roots in distrust and discrimination against the poor and its mistaken defense of a false moral high-ground, which is perceived from the narrow focus of child-saving rather than on the legitimate and long term needs of children. The foster care system’s lack of concern for natural parents reflects centuries of a dual …

Living Expressions: An Initial Understanding, Martin Bennett Landa Jan 1999

Living Expressions: An Initial Understanding, Martin Bennett Landa

UNLV Retrospective Theses & Dissertations

Living Expressions is a term that was created to describe a unique, formalized process of interpersonal communication, in which individuals share often unexpressed feelings of appreciation with one another. This qualitative study explored a single case, single process event, based on interviews with the participants. A constructivist paradigm guides the research with intentional avoidance of a priori theory, and institutes an emergent design with the human as instrument. The purpose of the study was to foster a greater understanding of a new and unusual formal process that holds numerous potentially positive implications in its widespread application. The review of the …

The Glint Of Gold: Press Coverage Of The Discovery Of Tutankhamun's Tomb, Jon S Arakaki Jan 1999

The Glint Of Gold: Press Coverage Of The Discovery Of Tutankhamun's Tomb, Jon S Arakaki

UNLV Retrospective Theses & Dissertations

Press coverage of the discovery of Tutankhamun's tomb, through articles published in the London Times and New York Times from November 30, 1922 to January 31, 1923, will be analyzed. A contract between the excavators and the London Times provided the newspaper with exclusive reports and information, while the New York Times and others initially relied mainly on eye-witness accounts and second hand gossip; This study compares and contrasts different accounts of the same discovery in terms of the themes, tone, and language of relevant articles in the two newspapers. Additionally, the study includes a survey of the relationship between …

Massacre, Memoir, And Myth: The 1866 Fetterman Fight, A Reconstruction, Richard S Haynes Jan 1999

Massacre, Memoir, And Myth: The 1866 Fetterman Fight, A Reconstruction, Richard S Haynes

UNLV Retrospective Theses & Dissertations

Myths permeate histories of the 1866 Fetterman Fight, or Massacre. Thesis foci include myths of the 1866 Fort Laramie Treaty, the July 1866 Skirmish at Crazy Woman's Fork, Jim Bridger's role from May 1866 to spring 1867, and the December 1866 Fetterman Fight. Beginning in 1867, Colonel Carrington, Captain Fetterman's commanding officer, shifted blame from himself to Fetterman. Based upon Carrington's allegations, historical consensus indicts Captain Fetterman for arrogantly disobeying orders, foolishly leading eighty men into a fatal ambush by 1,800 Lakota, Cheyenne, and Araphoe warriors, and committing mutual suicide with Captain Brown when hope was gone. In his 1991 …

The Effects Of Acute Exercise On Cognitions Related To Depression, Julia M. Lash Jan 1999

The Effects Of Acute Exercise On Cognitions Related To Depression, Julia M. Lash

All-Inclusive List of Electronic Theses and Dissertations

Exercise is known to improve mood and reduce depression. However, the mechanism(s) responsible for the antidepressent effects of exercise are not known. Cognitive therapy, one of the most effective psychological treatments of depression, is based on the assumption that changes in a person's negative thoughts will result in a remission of depression. The purpose of this study was to determine if a similar change in cognitions might occur with exercise. Self-report measures of mood (Profile of Mood States and Visual Analog Mood Scale) and depressive cognitions (Automatic Thoughts Questionnaire, Beck Self-Concept Test and Dysfunctional Attitudes Scale) were measured before and …

Filling The Black Hole Of Cyberspace: Legal Protections For Online Privacy, R. Craig Tolliver Jan 1999

Filling The Black Hole Of Cyberspace: Legal Protections For Online Privacy, R. Craig Tolliver

Vanderbilt Journal of Entertainment & Technology Law

The Internet is a unique and wholly new medium of worldwide human communication. This pronouncement of the United States Supreme Court echoes what most of the American population has known for some time. The emergence of cyberspace has dramatically changed the nature of electronic communications, and consumers are conducting online transactions at a tremendous pace. While this revolution has obviously increased the amount and types of information available to American consumers, it has also achieved a different result: businesses now have access to an unprecedented amount of personal information. In turn, there exists a danger that this information will be …

Will Aging Baby Boomers Bust The Federal Budget?, Ronald Lee, Jonathan Skinner Jan 1999

Will Aging Baby Boomers Bust The Federal Budget?, Ronald Lee, Jonathan Skinner

Dartmouth Scholarship

The authors analyze in three steps the influence of the projected mortality decline on the long-run finances of the Social Security System. First, mortality decline adds person years of life which are distributed across the life cycle. The interaction of this distribution with the age distribution of taxes minus benefits determines the steady state financial consequences of mortality decline. Second, examination of past mortality trends in the United State and of international trends in low mortality populations, suggests that mortality will decline much faster than foreseen by the SSA's forecasts. Third, based on work on stochastic demographic forecasting, stochastic forecasts …

The Constitution And Reconstitution Of The Standing Doctrine Comment., Laveta Casdorph Jan 1999

The Constitution And Reconstitution Of The Standing Doctrine Comment., Laveta Casdorph

St. Mary's Law Journal

The most effective response to the U.S. Supreme Court’s construction of Article III standards will be to revise citizen suit statutes to reaffirm its important role in giving the injured citizen a voice against the administrative state. With the rise of the administrative state in the late 1930s and 40s, the Court developed a conservative doctrine of standing to protect New Deal legislation from court-based attacks. As individual constitutional rights expanded, standing rules were liberalized, allowing litigants to challenge the actions and decisions of administrative agencies more easily. Congress passed numerous environmental statutes containing “citizen suit” provisions in the 1960s …

Patient Safety, Risk Reduction, And The Law, Larry I. Palmer Jan 1999

Patient Safety, Risk Reduction, And The Law, Larry I. Palmer

Cornell Law Faculty Publications

"Patient safety" has come of age. With the publication of several empirical studies of medical injuries and the recent Institute of Medicine Report, To Err is Human: Building a Safe Health System, scholars from a variety of disciplines are advocating "systems thinking" as a way of preventing medical accidents. These scholars have been influenced by efforts to reduce accidents in other high risk industries such as aviation and scholarship in law proposing "no fault systems" for compensating medical accident victims. This article proposes that in order to incorporate "systems thinking" about medical error reduction, legal scholarship on the health care …

Characterization Of A Simian Hemorrhagic Fever Virus Large Envelope Glycoprotein Gene And Its Product., Xiaochun Wang

LSU Historical Dissertations and Theses

The goal of this project was to determine the genome organization, replication strategy and identification of the large envelope glycoprotein (GL) gene of simian hemorrhagic fever virus (SHFV). This virus is the fourth member of the new virus family Arteriviridae. The 3' end of the RNA genome from the prototype isolate of SHFV was cloned and sequenced. This 6,314 nucleotide (nt) sequence consisted of nine complete overlapping open reading frame (ORFs 2, 2a, 3, 4, 5, 6, 7, 8, and 9). At the 5' end of this sequence is a partial ORF, ORF 1b, and the 3' end is a …

Ernest Renan And The Question Of Race., Jane Victoria Dagon Jan 1999

Ernest Renan And The Question Of Race., Jane Victoria Dagon

LSU Historical Dissertations and Theses

Racism in France can be traced back to the 1560's when the nobles claimed to be of a separate race in order to obtain special rights and privileges. Soon after in the seventeenth century, scientists started to classify humans according to physical features. With the increase in travel, the slave trade, the fear of the unknown and the fear of contamination, these factors along with physiognomy and phrenology encouraged "biological racism." During the second half of the nineteenth century, Ernest Renan (1823--1892) denounces biological racism and the existence of the so-called "pure races." He is also the first dramatist to …
