Adams County History

The earliest European settlers in today's Adams county were basically a religious people. While probably most of them should not be described as particularly pious, they did have the fear of the Lord in their hearts and wanted to have access to the services of some religious organization, either the one to which they were accustomed in Europe or one with which they had affiliated in America. If they belonged to groups such as the Quakers, Mennonites, or Brethren, it was easy for them to develop internally the leadership necessary to function successfully as a religious community. The Demise Of Hypothetical Jurisdiction In The Federal Courts, Scott C. Idleman

This article examines the causes, nature, and potential demise of a federal judicial practice known as hypothetical jurisdiction, whereby a court renders a binding judgment in a case without first verifying that it has the power to do so. By the mid-1990s, every federal court of appeals had adopted the practice, despite the fact that it violated fundamental tenets of judicial power and, in some cases, the Constitution itself. In 1998, the Supreme Court attempted to repudiate this practice, but the scope of the repudiation was not clearly delineated and the Court left unresolved a number of questions and left …

Estate planning must be handled with care to ensure that the disabled child is adequately provided with financial resources and personal assistance throughout his or her life span. This article examines many means for doing so without jeopardizing the child's chances for receiving government assistance.

Financial Abuses Of Elderly Clients, Alison Barnes

This article identifies what is meant by financial abuse of the elderly, discusses who are the abusers and victims, and illustrates how to identify instances of financial abuse. The author then discusses the possible responses to identified financial abuse, including responses by attorneys, state agencies, and federally mandated programs and acts. She concludes that where an older person is dependent for care on a family member, financial abuse may be best controlled through oversight of the interaction between the caregiver and care receiver, as well as modification of financial arrangements to limit the exposure of the care receiver's assets.

The Erosion Of Public Policies Which Support Workplace Justice: A Review Of The Davis-Bacon Act, Susan Foregard

UNLV Retrospective Theses & Dissertations

This thesis explores the ethical foundations of public policies which support workplace justice, using the Davis-Bacon Act as the principle example. The thesis argues that Davis-Bacon is not best considered as "pro-union" legislation, nor is cost-benefit analysis the best approach to understanding its importance. Instead, primary examination of the Davis-Bacon Act should be focused upon the policy's ethical basis and should not be sacrificed in cost-benefit analysis based upon "free market" efficiency. The Davis-Bacon Act achieves distributive justice with benefits for the general pubic, construction workers and their communities, and construction companies. The Davis-Bacon Act is defended as an effective …

Subjects included 17 female college students, aged 19 to 44 yrs. Subjects were assigned to 1 of 3 specific training protocols and performed lift-assisted (LA) pull-ups (PU) and/or LA bar dips (BD) for a period of 12 weeks. PU and BD performance were compared at 0, 4, 8 and 12 weeks training. Flexed arm hang (FAH), modified pull-up (MPU) and push-up exercises were compared at 0 and 12 weeks. A 3 x 4 (group by time) repeated measures factorial was used for the PU and BD tests, and a 3 x 2 (group by time) factorial was used for the …

Hotel-casinos have exhibited financial trouble and failure rates which exceed 30%. Even so, billions of dollars have been earmarked for continual development within the industry. The purpose of this study was to examine classical theories of strategic decision-making when planning for new or expanded hotel-casinos and then determine if these theories work for the industry or if the industry is so unique that special measures must become part of the strategic-planning process; Three factors related to strategic planning were selected for study: economic indicators, the product/service life cycle, the Altman Z Factor for bankruptcy prediction.
