Now as Rwanda begins to mourn the firth anniversary of its genocide, it should also celebrate the fifth anniversary of its survival. As time passes, Rwanda enters a stage of social and historical development which can be referred to as the "post-genocidal" stage. Some would say that Rwanda is actually in an intra-genocidal phase, given the persistence of Hutu rebel insurrection throughout the country, specifically in the Ruhengeri prefecture of the north-west. Although the merits of this classification can be debated, fatalistically characterizing Rwanda to be intra-genocidal assumes an ability to look in the future, a task no scholar is …

Comparing Apples To Oranges: Lessons From The Failure Of U.S. Apple Exports To Japan, Dustin R. Klinger

Washington International Law Journal

In 1994, the United States and Japan agreed to permit reciprocal fresh apple imports after decades of negotiations. However, U.S. apple exports to Japan were a commercial failure. Initial sales peaked in 1995, then quickly declined, and no U.S. apples have been shipped to Japan since 1997. The United States blames unfair regulations for this failure. This Comment reviews the history of the U.S.-Japan apple dispute, analyzes Japan's apple import regulations, and concludes that those regulations aggravated, but did not cause the commercial failure of U.S. apple exports to Japan. This article initially reviews the current development of financial services that converge regulatory systems around the world. Along with focusing on banking and securities, this article assesses financial systems and regulators within China, Hong Kong, and Taiwan respectively. The evaluation of the CEA's financial system is based on recommendations issued by the Basle Committee. In addition, with respect to the principle of national treatment, this article evaluates the operations of foreign financial institutions in the CEA. If exploitation of outer space's bounty is our goal, we must establish a space property legal system that creates both incentives and predictability. Space development is a highly risky endeavor, as well as mind-bogglingly expensive. Who would expend the effort in developing a space colony, if they were not certain of the project's legality? Valuable projects -- energy collection, mining, and colonization -- are by no means inevitable. The Japan-U.S. economic relationship has been marked by tremendous friction and misunderstanding. These tensions have given rise in the past to the extraterritorial application of U.S. trade and antitrust laws to perceived public and private restrictive trade practices. In this paper, I will review the U.S. approach to the extraterritorial application of trade and antitrust laws, particularly as they apply to Japan. I will conclude that although formal coercion has given way to more bilateral negotiations, demands will grow for a return to the more aggressive U.S. posture of the past unless meaningful and effective market access is achieved. China is currently the leading source of babies for intercountry adoption in the United States. This Comment explores the causes of this phenomenon, and the ability of the 1993 Hague Convention on Protection of Children and Cooperation in Respect of Intercountry Adoption to serve the interests of both the abandoned and orphaned children, and the adoptive parents under these specific circumstances.

Russia's position and intentions regarding the settlement of the situation in the Chechen Republic (or “Republic”) are transparent and based on principle. We have nothing to hide. First, I will cover some points regarding the genesis of the tragic chain of events in and around Chechnya. Attacking The Tools Of Corruption: The Foreign Money Laundering Deterrence And Anticorruption Act Of 1999, Juli Fendo

This Comment discusses the effect that international organized crime and foreign government corruption has upon money laundering and the resultant need for the FMLDA. Part I discusses the basic elements of money laundering and the criminal actors who launder internationally, and anlyzes existing U.S. legislation designed to combat laundering and problems in the current legislation. Part II explains the legislative history, purpose, and proposed provisions of the FMLDA. Part III advocates adoption of this Act, and argues that the United States should no longer be complicit in the corruption and degradation of foreign governments via U.S. financial institutions.

This Comment examines the extent to which the Intellectual Property and International Trade Court (IPIT) satisfies the intellectual property enforcement provisions of Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs). Part I presents the legal environment of intellectual property in Thailand before TRIPs, the background of TRIPs, and the enforcement requirements of TRIPs. Part II discusses the legislation creating the IPIT Court, and assesses the enforcement procedures as prescribed by the legislation that created the IPIT Court and as employed by the IPIT Court. In this Article, the author attempts a comprehensive international legal analysis of "non-lethal" weapons to raise awareness about how many international legal issues they create and about the complexity of analyzing the international legality of the development and use of these weapons. In short, the emergence of "non-lethal" weapons does not rescue international law from its crisis in connection with controlling war. Indeed, in some respects, the coming of "non-lethal" weapons threatens to deepen that crisis in new and disturbing ways.

Towards A Market Economy: Security Devices For China, Guanghua Yu

From 1949 to 1978, China's economy was centrally directed under a very rigid system of state planning. Under the planning system, security devices were not widely used. The government drew specific plans for enterprises and the Ministry of Finance used banks to allocate the funds to enterprises or projects. The banks, however, did not have to screen projects and monitor the use of funds after disbursements. They merely distributed the money to enterprises and collected the profits. Objective: This paper examines the findings from recent studies of street children in Ethiopia. Methods: Following a discussion of the term “street children,” comparisons are drawn between Latin American and Ethiopian street children in terms of gender, age, reasons for going to the streets, family relations and structure, delinquency, drug use, groups and the outcomes of street life. In particular, the victimisation of street children in Ethiopia is examined. Results: Widespread abuse of street children was reported. More than half of the street boys questioned reported being “regularly” physically attacked. Street life is also highly victimogenic for street girls. Sexual …

This paper contributes to post-Marxist discussions on the relevance of class as a social category in a postmodern world. Rather than marginalize this issue of social positioning, the authors explore the relevance of an Althusserian perspective which acknowledges the importance of class as it articulates with other social/identity issues such as gender and ethnicity. The substantive context for this discussion is gendered labor migration from the Philippines, and the advocacy work conducted by Filipino non-government organizations (NGOs) working with migrants in Pacific Rim countries.
