Saving The Lost Sheep: Bringing Environmental Values Back Into The Fold With A New Epa Decisionmaking Paradigm, Victor B. Flatt Jan 1999

Saving The Lost Sheep: Bringing Environmental Values Back Into The Fold With A New Epa Decisionmaking Paradigm, Victor B. Flatt

Washington Law Review

Currently, the Environmental Protection Agency (EPA) uses benefit-cost analysis in making many of its regulatory and enforcement decisions. This Article argues that, although required in some instances, the EPA's benefit-cost analysis procedure is incomplete, deeply flawed, and may even violate statutes in some respects. Much of the controversy surrounding environmental regulation can be attributed to this flawed benefit-cost analysis. This Article proposes a new paradigm for EPA regulatory decisionmaking. The proposed paradigm is a four-step decisionmaking process that enhances the outcome of the EPA's decisions by highlighting values that are often ignored or outside the traditional benefit-cost analysis but are …

The Dangerous Patient Exception To The Psychotherapist-Patient Privilege: The Tarasoff Duty And The Jaffee Footnote, George C. Harris Jan 1999

The Dangerous Patient Exception To The Psychotherapist-Patient Privilege: The Tarasoff Duty And The Jaffee Footnote, George C. Harris

Washington Law Review

With the U.S. Supreme Court's 1996 decision in Jaffee v. Redmond, all U.S. jurisdictions have now adopted some form of evidentiary privilege for confidential statements by patients to psychotherapists for the purpose of seeking treatment. The majority of states, following the decision of the Supreme Court of California in Tarasoff v. Regents of the University of Calfornia, have also adopted some form of duty by psychotherapists to breach confidentiality and warn potential victims against foreseeable violence by their patients. Largely unresolved is whether there should be a dangerous patient exception to the evidentiary privilege parallel to the Tarasoff …

Book Review: Pigs, Profits, And Rural Communities, Edited By Kendall M. Thu And E. Paul Durrenberger, E. Wesley F. Peterson Jan 1999

Book Review: Pigs, Profits, And Rural Communities, Edited By Kendall M. Thu And E. Paul Durrenberger, E. Wesley F. Peterson

Department of Agricultural Economics: Faculty Publications

Early in their introductory comments, the editors of this book claim that they “are not political activists and that [they] neither promote nor defend industrial agriculture based on any political agenda” (p. 4). Industrial agriculture, as understood in this book, includes large corporations, vertically integrated firms, multinationals, and anything else that seems to differ from what might be thought of as a traditional family farm. The editors suggest that their goal is to provide objective assessments of one example of industrial agriculture, large-scale hog confinement operations. However, as the introduction progresses, strange things seem to happen to this perfectly sensible …

American Indians And Crime, Lawrence A. Greenfeld, Steven K. Smith

United States Public Health Resources

This report represents a compilation and new analysis of data on the effects and consequences of violent crime among American Indians. The report uses data from a wide variety of sources, including statistical series maintained by the Bureau of Justice Statistics (BJS), the FBI, and the Bureau of the Census. Data are reported from American Indian crime victims on how they were affected by the victimization and about who victimized them. The report also includes the first BJS estimates of the total number of American Indians under the custody or supervision of the justice system.
The findings reveal a disturbing …

Hepatitis C Virus And Other Flaviviridae Viruses Enter Cells Via Low Density Lipoprotein Receptor, Vincent Agnello, György Ábel, Mutasim Elfahal, Glenn B. Knight, Qing-Xiu Zhang Jan 1999

Hepatitis C Virus And Other Flaviviridae Viruses Enter Cells Via Low Density Lipoprotein Receptor, Vincent Agnello, György Ábel, Mutasim Elfahal, Glenn B. Knight, Qing-Xiu Zhang

United States Public Health Resources

Endocytosis of the Flaviviridae viruses, hepatitis C virus, GB virus Cyhepatitis G virus, and bovine viral diarrheal virus (BVDV) was shown to be mediated by low density lipoprotein (LDL) receptors on cultured cells by several lines of evidence: by the demonstration that endocytosis of these virus correlated with LDL receptor activity, by complete inhibition of detectable endocytosis by anti-LDL receptor antibody, by inhibition with anti-apolipoprotein E and -apolipoprotein B antibodies, by chemical methods abrogating lipoproteinyLDL receptor interactions, and by inhibition with the endocytosis inhibitor phenylarsine oxide. Confirmatory evidence was provided by the lack of detectable LDL receptor on cells known …

Preventing Hepatitis B And Hepatitis C Virus Infections In End-Stage Renal Disease Patients: Back To Basics, Scott Kellerman, Miriam Alter Jan 1999

Preventing Hepatitis B And Hepatitis C Virus Infections In End-Stage Renal Disease Patients: Back To Basics, Scott Kellerman, Miriam Alter

United States Public Health Resources

In this issue of HEPATOLOGY, Mathurin et al. report the results of a 10-year retrospective study of kidney transplant recipients that compared rates of patient and graft survival among patients with and without chronic hepatitis B virus (HBV) or hepatitis C virus (HCV) infection.1 Following this cohort of patients at intervals of 5 and 10 years, the investigators found a statistically significant decrease in survival in the HBV-infected group at both 5 and 10 years and a similar decrease at 10 years in the HCV-infected group. The findings of this study underscore the importance of preventing these infections in …

Behavior Problems Of Maltreated Children Receiving In-Home Child Welfare Services, Ferol Mennen, William Meezan, Gino Aisenberg, Jacquelyn Mccroskey Jan 1999

Behavior Problems Of Maltreated Children Receiving In-Home Child Welfare Services, Ferol Mennen, William Meezan, Gino Aisenberg, Jacquelyn Mccroskey

Journal of Family Strengths

This study evaluates the level of behavior problems in a previously little studied group—children with founded cases of abuse and neglect receiving child welfare services in their own homes. A sample of 149 maltreated children, living at home, were evaluated on the CBCL as they entered a service program to which they were referred by a large public child protective service system. These children were found to have elevated levels of behavior problems, with 43.6% scoring in the problematic range, a rate similar to children entering foster care. Practice and policy implications of these findings are discussed and highlighted.

An Exploratory Study Of Minneapolis Truant Adolescents And School And County Interventions, Lois E. Lewis Jan 1999

An Exploratory Study Of Minneapolis Truant Adolescents And School And County Interventions, Lois E. Lewis

Theses and Graduate Projects

Truancy is one of the most alarming social problems schools and educators face daily. Because of the complex conditions that contribute to truancy, the etiology and development of the problem are unclear. In this study, fifty subjects ages 12-14 were described by using two measures. An intake form was used to abstract information, at the county level, on the variables gender, age, race, grade, education, number of people in the home, living situation, chemical use, mental health, prior court involvement, and other factors pertinent to this study for the 1997-98 school year. The second measure was used, at the school …

An Historical Perspective Of Mental Health And Criminal Justice Policies: Current Policies In An Urban County For Offenders With Mental Illness, Carol Cochran Jan 1999

An Historical Perspective Of Mental Health And Criminal Justice Policies: Current Policies In An Urban County For Offenders With Mental Illness, Carol Cochran

Theses and Graduate Projects

This descriptive study investigates whether offenders with mental illness are diverted from the criminal justice system to the mental health system in an urban county. Interviews were conducted with key decision makers to determine policy and procedures. Admissions to the county medical center psychiatric unit were correlated with arrests and in-custody county jail data for years 1985-87 and 1995-97.

Interviews reveal offenders with mental illness are detained in jail while awaiting mental health screening and court dispositions. If competent, offenders with mental illness can be sentenced to a corrections facility to serve their sentences with the general population. If incompetent …

Mandated Reporting In Education: Getting Through The Gray, Tara M. Dahlager Jan 1999

Mandated Reporting In Education: Getting Through The Gray, Tara M. Dahlager

Theses and Graduate Projects

Educators play a critical role in the mandated reporting of child abuse for the school is one of the few institutions where we can find almost every child for a good portion of their lives. If educators are expected to be effective mandated reporters of child abuse and neglect, it would make sense that they should receive intense training on the subject. A review of the literature indicates that this is not happening. The purpose of this research was to identify whether educators in a midsize school district are qualified to make decisions regarding the mandated reporting of child maltreatment. …

Factors Influencing Attitudes Of Social Workers Toward Spirituality In Practice, Dena M. Wheeler Jan 1999

Factors Influencing Attitudes Of Social Workers Toward Spirituality In Practice, Dena M. Wheeler

Theses and Graduate Projects

Recently, there has been growing interest in the role of spirituality in social work practice. Many practitioners support the inclusion of spirituality in social work practice, but there is a lack of understanding of how this can be accomplished. This exploratory qualitative study was undertaken to expand the understanding of social worker attitudes toward spirituality in practice. Five hospital social workers were interviewed using a structured interview schedule. The interviews focused on practitioners' definitions of spirituality, the factors that had influenced their definition, and the factors that influence how they respond to spirituality in practice. Themes of childhood experiences, academic …

Taking The High Road: A Case Study In The Value-Based Approach To Leadership, Lois J. Larson Jan 1999

Taking The High Road: A Case Study In The Value-Based Approach To Leadership, Lois J. Larson

Theses and Graduate Projects

The purpose of this qualitative study was to discover the impact of the infusion of core values in the workplace on leader/follower behavior. A hybrid of transformational leadership and servant-leadership theories called the value-based approach to leadership was used for analysis of data gathered. Conclusions indicate that infusion of core values has a positive impact on follower trust, support for followers as holistic persons builds commitment, and a positive organizational culture binds individuals into a common group with shared goals. Anecdotal evidence provided indicates transference of core values from followers to customers, influencing customer satisfaction.

Development Of A Model Of Natural Infection With Mycobacterium Bovis In White-Tailed Deer, Mitchell V. Palmer, Diana L. Whipple, Steven C. Olsen

Michigan Bovine Tuberculosis Bibliography and Database

The objective of this study was to develop a suitable experimental model of natural Mycobacterium bovis infection in white-tailed deer (Odocoileus virginianus), describe the distribution and character of tuberculous lesions, and to examine possible routes of disease transmission. In October 1997, 10 mature female white-tailed deer were inoculated by intratonsilar instillation of 2 3 103 (low dose) or 2 3 105 (high dose) colony forming units (CFU) of M. bovis. In January 1998, deer were euthanatized, examined, and tissues were collected 84 to 87 days post inoculation. Possible routes of disease transmission were evaluated by culture of nasal, …
