Spoiling The Surprise: Constraints Facing Random Regulatory Inspections In Japan And The United States, Andrew Chin Jan 1999

Spoiling The Surprise: Constraints Facing Random Regulatory Inspections In Japan And The United States, Andrew Chin

Northwestern Journal of International Law & Business

This Article is organized as follows. Part I presents a rational actor model of legal compliance under an enforcement regime based on random inspections and identifies two classes of reforms that can be applied in combination to improve aggregate compliance. Part II introduces the problem of corrupt tip-offs into the model and argues that exogenous reforms are necessary to combat corruption. Part III surveys the use of random administrative inspections in the United States, reviews the approaches taken by four such programs to improve compliance and fight corruption, and describes the various constraints under which they must operate. Part IV …

Entrenching Interests: State Supermajority Requirements To Raise Taxes, Max Minzner Jan 1999

Entrenching Interests: State Supermajority Requirements To Raise Taxes, Max Minzner

Akron Tax Journal

This article attempts to answer the question of supermajority design. If alterations in the tax code are to be restricted, how should they be limited? To what type of bills should a supermajority requirement apply? At what level should the requirement be implemented? When and how should the legislature be allowed to avoid the rule? Part II discusses the current House rule and considers why it was imposed, whether or not it is constitutional, and the effect the rule has had in practice. Part III moves to the states' experiences with supermajority requirements, and examines both the de jure limitations …

Preserving The History Of Boston's Diversity, Nancy Richard, Joan D. Krizack Jan 1999

Preserving The History Of Boston's Diversity, Nancy Richard, Joan D. Krizack

Provenance, Journal of the Society of Georgia Archivists

These headlines appeared in Boston newspapers. The articles they introduce tell each story from the journalist's point of view. Mainstream institutions involved in the events-the courts, law enforcement, schools, and businesses--created records that provide additional information from a mainstream point of view. Often these sources are the only documentation preserved in archives and libraries that are available to researchers. Individuals from the communities involved generally pass on their perspectives on the events by word of mouth. Occasionally, members of the community or the individuals who were present create oral or written sources in which to preserve their story. Unless mainstream …

Allen D. Breck Award Winner: “Ples Acsep Thes My Skrybled Lynes”: The Construction And Conventions Of Women’S Letters In England, 1540–1603, James Daybell

Quidditas

The central themes of this essay are delineated by the contrasting examples of two female correspondents. Both women are from similar gentry backgrounds and wrote in the late 1570s to early 1590s. The first is Mary Harding, the court maid of Lady Bridget Manners, herself the daughter of Elizabeth, countess of Rutland, famed for her marriage to Robert Tyrwhit in 1594, which so greatly incurred the wrath of Elizabeth I. Only four of Mary Harding’s letters have survived, all of which were sent to her mistress’s mother in order to keep her abreast of court news, her daughter’s progress, and …

In Vitro Comparative Biocompatibility Testing Of Carbofilm Coated And Uncoated Polyetherimide For Cardiovascular Application, M. Bosetti, S. Mazzarelli, L. Nicolais, L. Ambrosio, M. Cannas

Cells and Materials

When blood contacts the surface of a material, several processes take place including the activation of coagulation and immune systems. The aim of this work is to study in vitro the biological reactions seen from the point of view of hemocompatibility and cytocompatibility of a new polymer suggested as an artificial surface for cardiovascular applications: Carbofilm® coated polyetherimide (C®PEI) in comparison to polyetherimide (PEI), the uncoated form. PEI and C®PEI showed no signs of acute cytotoxicity although following long term incubation with PEI cytotoxicity was somewhat increased; both materials supported good endothelial cell adhesion with a higher level of cell …

When Is Command-And-Control Efficient? Institutions, Technology And The Comparative Efficiency Of Alternative Regulatory Regimes For Environmental Protection, Peter Z. Grossman, Daniel H. Cole Jan 1999

When Is Command-And-Control Efficient? Institutions, Technology And The Comparative Efficiency Of Alternative Regulatory Regimes For Environmental Protection, Peter Z. Grossman, Daniel H. Cole

Scholarship and Professional Work - Business

The nominal efficiency of a regulatory regime is determined by comparing its social costs and benefits; the regime is nominally efficient if it produces benefits in excess of its costs. Thus, a regulatory regime can be at once nominally efficient and relatively inefficient. A regulatory regime that is nominally efficient in the early days of pollution-control efforts, when increments of environmental quality are relatively cheap, may (but will not necessarily) grow less efficient over time - producing less return on each dollar invested - as increments of environmental quality grow increasingly expensive. A regulatory regime that is more efficient in …

Collaborative Strategies For Teachers And Parents In Achieving Washington State Essential Academic Learning Requirements In Reading And Language, Theresa Laffey Jan 1999

Collaborative Strategies For Teachers And Parents In Achieving Washington State Essential Academic Learning Requirements In Reading And Language, Theresa Laffey

All Graduate Projects

A teacher handbook containing suggestions and activities teachers can recommend to parents to assist their children in achieving the State Essential Learning Requirements for Kindergarten was developed. Activities and suggestions were based on 25 Expectations set by the State within the Essential Learning Requirements at the Kindergarten level. Each suggestion or activity was supported by research and directly linked to a specific Expectation. The suggestions and activities were selected based upon parent/ child interest, materials required to implement and ease for parents to follow instructions.

The Design And Development Of A Model Program That Integrates Arts, Social Studies And The Washington State Essential Academic Learning Requirements For The Seventh Grade Students And Manson Secondary School, Kenneth L. Nelson

All Graduate Projects

Relatively little research was encountered which attempted to measure the effectiveness of an integrated curriculum over a more traditional course of studies. The results that were articulated seemed to indicate that students in classrooms using an integrated curriculum approach did as well or better than students experiencing a more traditional approach. This was especially true in the area of conceptual understanding. The purpose of this project was to design and develop a model program that integrated Language Arts, Social Studies and the Washington State Essential Academic Learning Requirements for the seventh grade students at Manson Secondary School.
