Founded on the Oxford model of a cluster of institutions, the Claremont Colleges has periodically established a new school. In the Spring of 1997, the Board of Fellows of the Claremont University Center charged with policy-making for the consortium-voted to establish a seventh college; the Keck Graduate Institute of applied life sciences. or bioengineering. Despite other landholdings, including a golf course and a non-operational gravel quarry, the Board of Fellows voted to site the New Venture on a portion-approximately eleven acres--of the Bernard Biological Field Station. (Pitzer's vote was cast against building on the Field Station.)

Is There A Private Cause Of Action Under Epa's Title Vi Regulations?: The Need To Empower Environmental Justice Plaintiffs, Bradford Mank

This article will apply the Chester three-factor test to find a private right of action implied in the administrative regulations promulgated by various agencies to implement Section 602 of Title VI. This article also proposes that it would be inconsistent to apply today's more stringent standard for inferring congressional intent in deciding whether a private right exists under Section 602. Such inconsistency arises as a result of the Supreme Court's application of a more lenient standard in recognizing a private right of action under Section 601.

These headlines appeared in Boston newspapers. The articles they introduce tell each story from the journalist's point of view. Mainstream institutions involved in the events-the courts, law enforcement, schools, and businesses--created records that provide additional information from a mainstream point of view. Often these sources are the only documentation preserved in archives and libraries that are available to researchers. Individuals from the communities involved generally pass on their perspectives on the events by word of mouth. Environmental Justice And Title Vi: Making Recipient Agencies Justify Their Siting Decisions, Bradford Mank

Title VI prohibits federal agencies from providing funds to state or local agencies that discriminate. Environmental justice advocates have filed over fifty Title VI complaints with the EPA alleging that state or local environmental agencies have granted permits that will cause disparate impacts against minority groups. In February 1998, the EPA promulgated an Interim Guidance on Title VI to help the agency resolve these complaints. A wide range of state and local officials has criticized the Guidance because its vague definition of "disparate impact" may give the EPA too much discretion to find discrimination. Saving The Lost Sheep: Bringing Environmental Values Back Into The Fold With A New Epa Decisionmaking Paradigm, Victor B. Flatt

Currently, the Environmental Protection Agency (EPA) uses benefit-cost analysis in making many of its regulatory and enforcement decisions. This Article argues that, although required in some instances, the EPA's benefit-cost analysis procedure is incomplete, deeply flawed, and may even violate statutes in some respects. Much of the controversy surrounding environmental regulation can be attributed to this flawed benefit-cost analysis. This Article proposes a new paradigm for EPA regulatory decisionmaking. The proposed paradigm is a four-step decisionmaking process that enhances the outcome of the EPA's decisions by highlighting values that are often ignored or outside the traditional benefit-cost analysis but are …
