Environmental Justice: Is Disparate Impact Enough?, Jimmy White

"Not in my backyard!" This simple statement and the vigorous efforts to enforce it have resulted over the last sixteen years in a growing movement in minority communities in search of what has been termed "environmental justice." It is claimed by activists, and proven in numerous studies, that minorities are more likely to be affected by the siting of hazardous waste facilities and the permitting of other hazardous waste producers than are whites. The causes of these inequities are neither uniform nor easily identifiable. Unfortunately, remedies may be equally elusive. Lack of resources, political power, and practical knowledge have proven …

Traffic congestion is always a hot topic. One solution being explored in the Bay Area is expanded ferry service. The Bay Area Council recently completed a study of the Bay Area Water Transit Initiative. In July, 1999, the California Commonwealth Club and the Mineta Transportation Institute teamed up to bring together the public and a panel of experts. Big Water, Utah is a small town located just north of the Arizona border in an area of unique scenic character. The town is strategically located as a gateway to outdoor recreation opportunities. It lies between Lake Powell, the newly designated Grand Staircase Escalante National Monument, and the Paria Wilderness. See Figure 1 for an aerial photograph of Big Water and the surrounding area. The region expects growth in the coming years, through both increased tourism and development. Current residents of the area requested planning assistance from the Landscape Architecture and Environmental Planning Department of Utah State University. The assistance …

This Article examines the extent to which the Empowerment Zones Program is properly viewed as a neutral, rational, and beneficial program for poor, inner-city communities and their residents by exploring the limits and potential of its chief mechanism, economic development, as a tool to achieve social justice for the inner cities. This Article grounds its exploration within the contested terrain of the city, not simply as a legal or juridical concept, but in terms of its reality as a lived place on the eve of the 21st century.
