Reasons For Home Schooling As Cited By Selected Parents In Central Illinois, Douglas A. Taylor Jan 1999

Reasons For Home Schooling As Cited By Selected Parents In Central Illinois, Douglas A. Taylor

Masters Theses

The purpose of this study was to determine the specific reasons the home-schooling option was chosen by some parents in central Illinois. The number of parents who home school their children has increased significantly in recent years. Understanding the motives behind parents' decisions can provide important information on the home-schooling movement and these parents' perceptions about public education. By knowing the reasons the home-schooling option was selected, legislators, public school educators, and parents can initiate any changes that may be warranted.

The study took place in the fall of 1998 utilizing a survey instrument that was developed using information gleaned …

Garbage Picking With Salman Rushdie, Tara Hubschmitt Jan 1999

Garbage Picking With Salman Rushdie, Tara Hubschmitt

Masters Theses

Salman Rushdie's voice is one of the most powerful in postmodern and post-colonial literature. He stands as a primary spokesman for the displaced personality of those caught between the conflicting influences of traditional cultures and the contemporary west. In Midnight's Children (1980), The Satanic Verses (1989), and The Ground Beneath Her Feet (1999), Rushdie appears to reveal himself as a proponent of a garbage aesthetic. The garbage metaphor, as explained by Ella Shohat and Robert Stam in Unthinking Eurocentricism (1994), develops from Brazilian filmmakers of the 1960s and is generally used to highlight the omnipresent influence of western culture upon …

South African Distance Runners: Issues Involving Their International Careers During And After Apartheid, Carrie A. Lane Jan 1999

South African Distance Runners: Issues Involving Their International Careers During And After Apartheid, Carrie A. Lane

Masters Theses

While some sports in South Africa have a distinct racial identity, distance running is one of the most popular sports in the country for people of all ethnic backgrounds. This study examined the issues that South African distance runners faced from the time the country was banned from Olympic competition, in 1968, to the present day. It profiled 21 male and female elite and collegiate runners who have competed in the United States from 1980 to 1999.

Because of South Africa's apartheid government, which legalized racial segregation and inequality, South African sport was excluded from international competition for 32 years. …

Second Generation Law And Economics Of Conflict Of Laws: Baxter's Comparative Impairment And Beyond, Erin O'Connor Jan 1999

Second Generation Law And Economics Of Conflict Of Laws: Baxter's Comparative Impairment And Beyond, Erin O'Connor

Vanderbilt Law School Faculty Publications

In his 1963 article in the Stanford Law Review, "Choice of Law and the Federal System," Professor William F. Baxter criticized the choice-of-law approach of the First Restatement of the Conflict of Laws. According to the Restatement, courts should apply the law of the state where the last act or event deemed necessary to create a cause of action occurred. In contrast, Baxter advocated a comparative-impairment approach, whereby judges were obligated to apply the law of the state whose public policy would suffer the greatest impairment if its law was not applied. The authors contend that although Baxter's approach caries …

The American Criminal Jury, Nancy J. King Jan 1999

The American Criminal Jury, Nancy J. King

Vanderbilt Law School Faculty Publications

As juries become both less common and more expensive, some have questioned the wisdom of preserving the criminal jury in its present form. The benefits of the jury are difficult to quantify, but jury verdicts continue to earn widespread acceptance by the public and trial by jury remains a cherished right of most Americans. In any event, many basic features of the criminal jury in the United States cannot be modified without either constitutional amendment or radical reinterpretations of the Bill of Rights. Judges and legislators continue to tinker within constitutional confines, some hoping to improve the jury trial by …

The Development Of A Noncommercial Community Television Delivery System: A Model For Small Rural Community Colleges, Rudolf H. Timmerman Jan 1999

The Development Of A Noncommercial Community Television Delivery System: A Model For Small Rural Community Colleges, Rudolf H. Timmerman

Theses and Dissertations

Information can empower as well as unite people. A primary source of information was found to be the media, specifically television. The literature indicated that in rural areas the information provided by the media was not germane to the residents and, considering the rather broad mission of community colleges, the investigator proposed the development of a noncommercial television delivery system using the assets of the college. It was further hypothesized that this development could serve as a model for other rural colleges. While the literature supported the proposition that local television access had a positive effect on the community, little …

Existence Of Solutions To A Class Of Nonlinear Convergent Chattering-Free Sliding Mode Control Systems, Pushkin Kachroo Jan 1999

Existence Of Solutions To A Class Of Nonlinear Convergent Chattering-Free Sliding Mode Control Systems, Pushkin Kachroo

Electrical & Computer Engineering Faculty Research

Sliding mode control is a nonlinear control technique, which is robust against some classes of uncertainties and disturbances. However, this control produces chattering which can cause instability due to unmodeled dynamics and can also cause damage to actuators or the plant. There are essentially two ways to counter the chattering phenomenon. One way is to use higher order sliding mode, and the other way is to add a boundary layer around the switching surface and use continuous control inside the boundary. The problem with the first method is that the derivative of a certain state variable is not available for …

Phase Transitions In Project Scheduling, Willy Herroelen, Bert De Reyck Jan 1999

Phase Transitions In Project Scheduling, Willy Herroelen, Bert De Reyck

Research Collection Lee Kong Chian School Of Business

Researchers in the area of artificial intelligence have recently shown that many NP-complete problems exhibit phase transitions. Often, problem instances change from being easy to being hard to solve to again being easy to solve when certain of their characteristics are modified. Most often the transitions are sharp, but sometimes they are rather continuous in the order parameters that are characteristic of the system as a whole. To the best of our knowledge, no evidence has been provided so far that similar phase transitions occur in NP-hard scheduling problems. In this paper we report on the existence of phase transitions …

“Murder Not Then The Fruit Within My Womb”: Shakespeare’S Joan, Foxe’S Guernsey Martyr, And Women Pleading Pregnancy In Early Modern English History And Culture, Carole Levin

Quidditas

When the character Joan La Pucelle has been captured and is brought before Warwick and York to be condemned at the end of Shakespeare's 1 Henry VI, she at first denies her shepherd father and proclaims both her noble birth and her virginity. She claims that she is issue “from the progeny of kings; virtuous and holy,” and adds proudly, “Joan of Arc hath been a virgin from her tender infancy,/ Chaste and immaculate in very thought” (5.4.38–39, 50–51). These assertions do not, however, impress York and Warwick, who order her to be taken away to her execution. At …

Victims' Rights: Rethinking Our "Adversary System", William T. Pizzi Jan 1999

Victims' Rights: Rethinking Our "Adversary System", William T. Pizzi

Utah Law Review

Victims are very angry at the treatment they receive in our criminal justice system and I have tried to show that they have a right to be angry. Unfortunately, anger is not a good basis on which to make important public policy decisions and it contributes to the increasing harshness we see in our system. Crime is a serious problem in all western countries and politicians have to get elected in these countries as well. But we need to ask ourselves why judges and lawyers in other countries have been more successful in fending off calls for the death penalty, …

Commercial And Corporate Lawyers 'N The Hood, Alfred Dennis Mathewson Jan 1999

Commercial And Corporate Lawyers 'N The Hood, Alfred Dennis Mathewson

Faculty Scholarship

I shall begin the development of this proposition with a theme from a "Last Lecture" I was asked to deliver by the UNM Campus Ministries several years ago. I was asked to pretend that I would die immediately after giving the lecture. I opened the lecture with a story my mother used to tell us about the time she was traveling on Trailways with two of my older brothers, then toddlers. The bus driver asked her to move to the back of the bus. She had not wanted to get up but decided that compliance with the demand was in …

Emphasizing Torts In Claims Of Discrimination Against Black Female Athletes, Alfred Dennis Mathewson Jan 1999

Emphasizing Torts In Claims Of Discrimination Against Black Female Athletes, Alfred Dennis Mathewson

Faculty Scholarship

In Black Women, Gender Equity and the Function at the Junction, I argued that an equality-based legal regime does not provide an adequate remedy for African-American female athletes. Instead I suggested that a tort-based regime may be more appropriate. I did so knowing that gender and racial discrimination are torts and I did not intend to suggest otherwise. They are statutory torts founded upon equality principles. What I intended was to draw more upon the general tort principles involved in an antidiscrimination action. I specifically invoked the notion of using mass tort theories. I wish to sketch a brief but …

A Comparative Analysis Of Women's Issues: Toward A Contextualized Approach, Antoinette M. Sedillo Lopez Jan 1999

A Comparative Analysis Of Women's Issues: Toward A Contextualized Approach, Antoinette M. Sedillo Lopez

Faculty Scholarship

"This Article proposes a methodology for comparative analysis of women's rights using insights from critical race theory and feminism. Comparative analysis by a Western scholar must reconcile a perspective developed in the United States with respect for another culture. In discussing women's rights, lawyers, judges, students and sociologists have justified certain women's situations as an inherent aspect of culture. For example, traditional "female genital surgery" has been defended as a "mere bodily mutilation" that is the "sine qua non of the whole teaching of tribal law, religion, and morality." In Mexico, "machismo" has been justified as an immutable characteristic of …

Managing The Y2k Risk: Directors' And Officers' Liability For The Year 2000 Computer Bug, Barbara Elizabeth Warner Jan 1999

Managing The Y2k Risk: Directors' And Officers' Liability For The Year 2000 Computer Bug, Barbara Elizabeth Warner

Dalhousie Journal of Legal Studies

The Year 2000 computer bug is more than a technical problem: it poses grave business risks and legal liabilities for a number of actors. In this article, the author examines the potential liability of corporate directors in Canada for Year 2000 problems affecting the corporations they serve. The article focuses on the duties imposed on directors under the Canada Business Corporations Act and the remedies available to shareholders in the statute. Additionally, the author draws an analogy between the potential defenses that may be available to directors targeted in Year 2000 litigation and the due diligence defense as it is …

New Kinematic Models For Pacific-North America Motion From 3 Ma To Present, I: Evidence For Steady Motion And Biases In The Nuvel-1a Model, Charles Demets, Timothy H. Dixon Jan 1999

New Kinematic Models For Pacific-North America Motion From 3 Ma To Present, I: Evidence For Steady Motion And Biases In The Nuvel-1a Model, Charles Demets, Timothy H. Dixon

School of Geosciences Faculty and Staff Publications

We use velocities derived from 2–4.5 years of continuous GPS observations at 21 sites on the Pacific and North American plates along with a subset of the NUVEL-1A data to examine the steadiness of Pacific-North America motion since 3.16 Ma, the transfer of Baja California to the Pacific plate, and the magnitude of biases in the NUVEL-1A estimate of Pacific-North America motion. We find that Pacific-North America motion has remained steady since 3.16 Ma, but at rates significantly faster than predicted by NUVEL-1A. In the vicinity of Baja California, our GPS-derived model and recent seafloor spreading rates in the southern …

Decelerating Nazca-South America And Nazca-Pacific Plate Motions, Edmundo O. Norabuena, Timothy H. Dixon, Seth Stein, Christopher G. A. Harrison

School of Geosciences Faculty and Staff Publications

Space geodetic estimates of the rate of Nazca-South America convergence and Nazca-Pacific spreading averaging over several years show that present day rates are significantly slower than the 3 million year average NUVEL-1A model. The implied rates of deceleration are consistent with longer term trends extending back to at least 20 Ma, about the time of initiation of Andes growth, and may reflect consequences of ongoing subduction and construction of the Andes, e.g., increased friction and viscous drag on the subducted slab as the leading edge of South America thickens.

Experience As Text: The History Of Externship Pedagogy At The Washington College Of Law, American University, Peter Jaszi, Ann Shalleck, Marlana Valdez, Susan Carle

Clinical Law Review

In this article we analyze the historical development of a supervised externship program at American University, Washington College of Law ("WCL"). We trace the origins of our particular pedagogic goals and program design to the history and culture of our institution, in the hopes that this form of self-reflection will be useful to others making their own choices about these matters. Through this self-study we have realized that - contrary to the way clinical literature often conceives of program development - we did not start by articulating a complete set of goals, around which we then built a program. Instead, …

[On The] Road Back In: Community Lawyering In Indigenous Communities, Christine Zuni Cruz Jan 1999

[On The] Road Back In: Community Lawyering In Indigenous Communities, Christine Zuni Cruz

Clinical Law Review

As a communications major in film and broadcasting, I took a film making course which required the production of a super 8mm film with an accompanying soundtrack. The film I produced was based on the lyrics, "You're my lawyer, you're my doctor, yeah, but somehow you forgot about me", from the song by Gil Scott Heron and Brian Jackson. These lyrics spoke to me of professionals who forget their communities or at least their communities' perspectives, needs, and sometimes their own roots. In turn, they are not respected and become despised for their indifference by those people who had different …

Unwritten Laws And Customs, Local Legal Cultures, And Clinical Legal Education, Andrea M. Seielstad

Clinical Law Review

As a clinical teacher I have the opportunity each semester to witness third-year law students discover, in many cases for the first time in their lives, what it means to be a practitioner of law. Through representation of real clients, student interns have the opportunity to engage in a variety of typical lawyering activities, such as interviewing and counseling of clients and witnesses, case planning, preparation of written pleadings and other documents, negotiation, and trial advocacy. Informed by a law school education that emphasizes the litigation process and the study of the written law, including certain areas of substantive law …
