Taking Notes: Subpoenas And Just Compensation, Gary Lawson, Guy Seidman Sep 1999

Taking Notes: Subpoenas And Just Compensation, Gary Lawson, Guy Seidman

University of Chicago Law Review

When the government enforces a subpoena duces tecum for the production of physical evidence, why isn't it taking the target's property within the meaning of the Constitution's just compensation requirement? Professor Lawson and Mr. Seidman argue that enforcement of such subpoenas are indeed takings, but that the Constitution's just compensation requirement can be satisfied in most instances through implicit in-kind compensation. There may be exceptional circumstances, however, where the prospect of implicit compensation from a general scheme of forced production of evidence is insufficient to compensate the target for its losses, in which case direct compensation may be constitutionally required.

A Defense Of Analogical Reasoning In Law, Emily Sherwin Sep 1999

A Defense Of Analogical Reasoning In Law, Emily Sherwin

University of Chicago Law Review

This Article defends the practice of reasoning by analogy on the basis of its epistemic and institutional advantages. The advantages identified for analogical reasoning include that it produces a wealth of data for decisonmaking; it represents the collaborative effort of a number of judges over time; it tends to correct biases that might lead judges to discount the force of prior decisions; and it exerts a conservative force in law, holding the development of law to a gradual pace. Notably, these advantages do not depend on the rational force of analogical reasoning. Rather, the author contends that, as open-ended reasoning …

The Effect Of Acorn Weevils (Curculionidae: Curculioninae) As Seed Predators Of Quercus Insignis (Fagaceae) In A Tropical Montane Forest, September 1999, Timothy R. Kuhman Sep 1999

The Effect Of Acorn Weevils (Curculionidae: Curculioninae) As Seed Predators Of Quercus Insignis (Fagaceae) In A Tropical Montane Forest, September 1999, Timothy R. Kuhman

Monteverde Institute: Tropical Ecology and Conservation

The effect of seed predation by acorn weevils on the acorns of Quercus insignis was assessed in the context of frequency of infestation and the extent of damage incurred by the larvae on individual acorns. The effect of such damage on early fruit abscission and germination potential of infested acorns was also examined in this study. Acorns were collected from five Q. insignis trees in the lower montane forest of the Cordillera de Tilarán in Costa Rica. Frequencies of infestation varied greatly among the five trees, from 3.3% to 75%. However, there was no evidence for early abscission of infested …

Critical Factors Affecting Nigeria's Foreign Exchange Flows, Peter I. Nwaoba Sep 1999

Critical Factors Affecting Nigeria's Foreign Exchange Flows, Peter I. Nwaoba

Economic and Financial Review

This study articulates main factors that affected foreign exchange flows in Nigeria between 1987 and 1997. Foreign exchange inflow is made up of autonomous receipts. gifts and borrowed resources. Factors such as exchange rate, monetary expansion and fiscal imbalances, capital flight, excessive and spurious demand for foreign exchange and debt service burden, were identified in the study as factors which affect foreign exchange. Results from the regression analysis indicated that all the variables met a priori expectations in terms of statistical significance and correctness of signs. The study also established a significant impact of imports and external debt burden on …

Money And Output Interaction In Nigeria An Econometric Investigation Using Multivarate Cointegration Technique, Godwin C. Nwaobi

Economic and Financial Review

This paper derives and estimates a Barro-type reduced-form equahonfor domestic real output from a simple structural model ofan open developing economy in which markets clear continuously and expectations are rational. The form in which open economy variables appeared was explicitly derived from an underlying structural model. The model was adapted to Nigerian economy by according an important role to imported intermediate goods. The empirical result provided support for the open economy model of output determination in Nigeria.

The Capital Market And Equity Failure In Nigeria, Rose Mbatomon Ako

Economic and Financial Review

The capital Markel is recognized in the literature as an important barometer for economic growth and development in a nation via its allocative efficiency properties. In investigating equity failure in Nigeria, the paper applied the predictive models developed for discriminant and logistic analyses for selecting equity stocks lo invest in. In the study relating to a sample of 47 Equity Issues from 45 Nigerian companies over the period 1988-92, two classificalion models were applied on a data set comprising macro and micro economic indicators, an industry variable and various accounting ratios. The models were the multiple discriminant and logistic regression …

Manufacturing Strategy And New Venture Performance: A Comparison Of Independent And Corporate Ventures In The Biotechnology Industry, Shaker A. Zahra, Gerard George

Research Collection Lee Kong Chian School Of Business

Little empirical research has compared the manufacturing strategies of corporate and independent new ventures. This study explores these differences with data from the young, science-based biotechnology industry, and examines the performance effects of manufacturing strategy variables including scope, competitive thrust, and capabilities. The results show that the corporate and independent biotechnology new ventures pursue significantly different manufacturing strategies, and that different dimensions of manufacturing strategies affect the performance of corporate vs. independent ventures quite differently.

Guaranteed Bandwidth Implementation Of Message Passing Interface On Workstation Clusters, Ali Atalay Sep 1999

Guaranteed Bandwidth Implementation Of Message Passing Interface On Workstation Clusters, Ali Atalay

Theses

Due to their wide availability, networks of workstations (NOW) are an attractive platform for parallel processing. Parallel programming environments such as Parallel Virtual Machine (PVM), and Message Passing Interface (MPI) offer the user a convenient way to express parallel computing and communication for a network of workstations. Currently, a number of MPI implementations are available that offer low (average ) latency and high bandwidth environments to users by utilizing an efficient MPI library specification and high speed networks. In addition to high bandwidth and low average latency requirements, mission critical distributed applications, audio/video communications require a completely different type of …

Host-Driven Population Dynamics In An Herbivorous Insect, Tiina Ylioja, Heikki Roininen, Matthew P. Ayres, Matti Rousi, Peter W. Price

Dartmouth Scholarship

Understanding the nature and relative importance of endogenous (density-dependent) and exogenous (density-independent) effects on population dynamics remains a central problem in ecology. Evaluation of these forces has been constrained by the lack of long time series of population densities and largely limited to populations chosen for their unique dynamics (e.g., outbreak insects). Especially in herbivore populations, the relative contributions of bottom-up and top-down effects (resources and natural enemies, respectively) have been difficult to compare because population data have rarely been combined with resource measurements. The feeding scars of a wood-mining herbivorous insect (Phytobia betulae Kangas; Diptera: Agromyzidae) of birch …

Identity Politics In Atwood, Kogawa, And Wolf, Jean Wilson Sep 1999

Identity Politics In Atwood, Kogawa, And Wolf, Jean Wilson

CLCWeb: Comparative Literature and Culture

Jean Wilson's article, "Identity Politics in Atwood, Kogawa, and Wolf," is a comparative study of three texts published in the early 1980s: Atwood's "Significant Moments in the Life of My Mother," Kogawa's Obasan, and Wolf's Cassandra. Identity politics figure prominently in all three literary works, whose common poetic project is one of demythologization and of enabling at the same time the emergence of a new, liberating articulation, a language perhaps "never heard before." These writings interrogate the construction of identities in a patriarchal culture and contribute to a more complex understanding of identity formation. All three works, albeit in different …
