The Jury And Scientific Evidence, Richard O. Lempert Sep 1999

The Jury And Scientific Evidence, Richard O. Lempert

Articles

Read court decisions and commentaries from 100, or evenfive years ago, and you will find that experts and scientific evidence were causing problems then just as they are causing problems now. I do not think that Daubert, Kumho Tire, or any change in a rule of evidence will keep expert scientific testimony from being a difficult area for the legal system. Yet we must still ask: "What are the best terms on which to deal with scientific experts, and how can weimprove the system?"

Moderating Effects Of Station Isolation On Antecedents And Consequences Of Fraternization, Tonya M. Luther

Theses and Dissertations

The purpose of this study is to analyze any differences in reported incidents of fraternization based on relative isolation of location. To fulfill this purpose, a variety of types of fraternization cases were reviewed and analyzed. All data extracted was coded across five factors of fraternization and punishment. Statistical tests determined whether differences in fraternization factors were due to common error or to true differences based on relative isolation of location. Seven different hypotheses relating fraternization and location were tested. Statistical analysis showed that reported fraternization incidents are more likely to be of a sexual nature and involve people of …

Operational Risk Management And Military Aviation Safety, Park D. Ashley Sep 1999

Operational Risk Management And Military Aviation Safety, Park D. Ashley

Theses and Dissertations

The Air Force Class A aviation mishap rate has hovered around 1.5 mishaps per 100,000 flight hours since 1985. Recent attention on Air Force accidents has caused the leadership to seek to reduce its mishap rate. The Army's Class A aviation mishap rate declined after it implemented risk management (RM) principles in 1987. This reduction caught the attention of Air Force leadership who have since stated that the application of operational risk management (ORM) is how the Air Force will reduce, even eliminate, mishaps. With current budget constraints, ORM is considered to be the most cost-effective way the Air Force …

The Effect Of Action Workouts On Aircraft Mission Capability Measurements, Michael P. Allison Sep 1999

The Effect Of Action Workouts On Aircraft Mission Capability Measurements, Michael P. Allison

Theses and Dissertations

Previous studies concerning quality improvement and the Action Workout Process attempted to define and describe the difficult concept of quality. A logical next step is to study to what extent implementation of a quality improvement program, such as ACC's Action Workout Process, positively or negatively affects performance factors within an Air Force organization. This study focused on exploring the fundamental question of whether there was, as a result of the Action Workout, a noticeable, statistically verifiable, positive or negative change in the mission capability of aircraft assigned to the units carrying out this quality improvement initiative. Research questions were developed …

Pollution Prevention Cost Savings Using Supply Chain Reengineering, Gregory S. Webb Sep 1999

Pollution Prevention Cost Savings Using Supply Chain Reengineering, Gregory S. Webb

Theses and Dissertations

Supply chain management was explored as a tool to prevent hazardous waste and reduce operating costs. Previous research had shown that pollution prevention measures were often costly and no expectation of cost savings could be realized. The reengineering of the Air Force hazardous material supply chain brought about by the Hazardous Material Pharmacy Program was tested to evaluate if hazardous waste had been precluded in this effort and if costs had also been avoided. To date, no research had explored the use of supply chain management as a source reducer of hazardous waste. Consequently, little was known or understood of …

Comparison Of The Effects Of Eight-Hour And Twelve-Hour Shifts On Air Force Aircraft Maintenance Production Levels, David P. Collette

Theses and Dissertations

his is a follow-on study that examined the effects of converting a large aircraft maintenance squadron from 8-hour shifts to 12-hour shifts. The squadron studied converted its 24-hour maintenance work force from three 8-hour work shifts to two 12-hour work shifts. Data was collected from four different time periods. Three time periods were used for a primary analysis and all four time periods were used for trend analysis. To determine if the 12-hour work shift was effective, workforce productivity was measured during the different work shift periods. Results showed an increase in two productivity measurements, no-change in two productivity measurements, …

Workplace Violence: Exploring The Dangers For Air Force Leadership, Shawn R. Jones Sep 1999

Workplace Violence: Exploring The Dangers For Air Force Leadership, Shawn R. Jones

Theses and Dissertations

The repeated occurrences of workplace violence throughout society today require the Air Force to evaluate its own workplaces and determine if a threat exists. This research explored violence in the workplace and established the possibility that workplace violence can affect the Air Force. Additionally, Air Force Climate Assessment Surveys were evaluated to find information that could be useful in detecting early warning signs of potential workplace violence. A number of examples of violence that occurred within Air Force workplaces highlighted the threat for Air Force leadership. With over 1,680 incidents of workplace violence reported to the AFOSI in a 5-year …

A Methodology For The Analysis And Prediction Of Air Force Enlisted Aircraft Maintenance Personnel Retention Rates Using Economic Statistics, Peter D. Lommen Sep 1999

A Methodology For The Analysis And Prediction Of Air Force Enlisted Aircraft Maintenance Personnel Retention Rates Using Economic Statistics, Peter D. Lommen

Theses and Dissertations

The purpose of this study is to investigate the effects of certain national economic indicators on enlisted aircraft maintenance personnel retention rates. To fulfill this purpose, this study builds a linear regression equation that can predict the retention rate using the civilian unemployment rate and the index of 11 leading economic indicators as the independent variables. Journal literature and economic texts were reviewed to identify the indicators as good predictors for changes in employee turnover. The method of linear regression was used to build the model needed to predict the changes in the retention rate. The equation developed with this …

An Ex Post Facto Analysis Of E-3 Maintenance Indicators In The 552d Air Control Wing Since Reorganization Under An Aircraft Generation Squadron Concept, Larry J. Stetz Sep 1999

An Ex Post Facto Analysis Of E-3 Maintenance Indicators In The 552d Air Control Wing Since Reorganization Under An Aircraft Generation Squadron Concept, Larry J. Stetz

Theses and Dissertations

Organizational restructuring sometimes occurs in the aircraft maintenance field, yet seldom are in-depth analyses performed after the fact to see if productivity improved. In December 1995, the 552D Air Control Wing restructured its flight line maintenance into an aircraft generation squadron concept. This study looked at before and after maintenance indicators to see if productivity improved. Maintenance data was collected from December 1993 to December 1997. Nineteen maintenance indicators were identified, and the key indicators were analyzed using means comparison and regression analysis to determine if efficiency and effectiveness had increased. The variables Mission Capable rate and Man-hours per Flying …

Space-Available Transportation: An Analysis Of The Cost Of Providing 'Free' Travel, Frank J. Long Sep 1999

Space-Available Transportation: An Analysis Of The Cost Of Providing 'Free' Travel, Frank J. Long

Theses and Dissertations

The purpose of this study is to estimate the costs borne by the government for providing space-available travel to eligible uniformed services personnel and their dependents. As the primary provider of the space-available privilege, it is important that the Air Force have an estimate of the burden that the administration of that privilege places on the budget. In January 1993, the Air Force discontinued its 15-year-old practice of charging a fee for space-available travel aboard AMC-owned or controlled aircraft. The fee had been set at $10 in 1978 and was collected to recover a portion of the costs associated with …

Multiple Comparison Pruning Of Neural Networks, Donald E. Duckro Sep 1999

Multiple Comparison Pruning Of Neural Networks, Donald E. Duckro

Theses and Dissertations

Reducing a neural network's complexity improves the ability of the network to be applied to future examples. Like an overfitted regression function, neural networks may miss their target because of the excessive degrees of freedom stored up in unnecessary parameters. Over the past decade, the subject of pruning networks has produced non-statistical algorithms like Skeletonization, Optimal Brain Damage, and Optimal Brain Surgery as methods to remove connections with the least salience. There are conflicting views as to whether more than one parameter can be removed at a time. The methods proposed in this research use statistical multiple comparison procedures to …

Formal Representation And Application Of Software Design Information, Thomas M. Schorsch Sep 1999

Formal Representation And Application Of Software Design Information, Thomas M. Schorsch

Theses and Dissertations

Formal methods for developing software use mathematical frameworks to specify, develop and verify software systems, especially safety critical systems where error free software is a necessity. A transformation system is a formal method that refines a requirement specification into an implementation by successively adding design decisions in the form of precisely verified design information. Current algebraic representations of design information (specifications, morphisms, and interpretations) and methods for applying algebraic specification design information (diagram refinement) cannot correctly represent and apply design information involving higher level design information. This investigation develops innovative methods for constructing and refining structured algebraic requirement specifications, as …

The Development Of Laser Cost Estimating Relationships (Cers) From Commercial Data, Michael J. Nolette, Steven L. Seeley Sep 1999

The Development Of Laser Cost Estimating Relationships (Cers) From Commercial Data, Michael J. Nolette, Steven L. Seeley

Theses and Dissertations

The Post Cold War acquisition environment has been marked by significant budget reductions and the greater use of commercial practices. In this austere and rapidly changing acquisition environment, accurate cost estimates are paramount to maximize the use of the DoD's critical resources. The advancement of laser technology has spawned a large variety of military laser applications such as the Airborne Laser (ABL), Space Based Laser (SBL) and a host of other smaller programs. Furthermore, the Air Force Laboratory's Directed Energy Applications for Tactical Airborne Combat (DEATAC) Study (the sponsoring activity of this thesis research) is considering a host of airborne …

The Adequacy Of The Fourteen General Systems Characteristics As Function Point Adjustment Factors, Michael D. Prater, Joseph C. Willoughby Sep 1999

The Adequacy Of The Fourteen General Systems Characteristics As Function Point Adjustment Factors, Michael D. Prater, Joseph C. Willoughby

Theses and Dissertations

The purpose of this research is to assess the perceived adequacy of the 14 general systems characteristics (GSCs) in deriving a value adjustment factor (VAF) for calculating final function point counts. Two self-administered surveys were used to collect data. Based on the survey results, it is clear that the 14 GSCs currently do not adequately represent the applications complexity required to adjust function point counts. The current GSCs remain controversial and while this research can not conclusively state that one factor is more accurate than any other, it is evident that certain GSCs are perceived to he more useful for …

Professional Contracting Certification: An Examination And Model Development, Robert D. Lorton, Daniel I. Dunn Sep 1999

Professional Contracting Certification: An Examination And Model Development, Robert D. Lorton, Daniel I. Dunn

Theses and Dissertations

This study compared the elements of existing contracting certification programs to an ideal contracting certification model developed by experts. The expert panel responded to an open-ended electronic interview to convey their ideas regarding the individual elements for the model. Input received from the initial interviews was used to develop a survey for the panel members. The surveys were completed and results were recorded and conveyed back to the panel members. This process was repeated until a majority was reached on each individual element of the model, resulting in the ideal certification model. The final model contained elements of both the …

Before And After: Is Outsourcing A Better Value Than Organic Support: A Case Study Comparing Organic Vs. Contractor Controlled Depot-Level Maintenance Of The F-117, Harry T. Loughran, John Webb Sep 1999

Before And After: Is Outsourcing A Better Value Than Organic Support: A Case Study Comparing Organic Vs. Contractor Controlled Depot-Level Maintenance Of The F-117, Harry T. Loughran, John Webb

Theses and Dissertations

The purpose of this research was to determine whether or not outsourcing of the depot-level maintenance of the F-117 was a better value than maintaining the capability in house. Specifically, this thesis sought to answer three questions: (1) Are the contract performance metrics good indicators of "better value"; (2) Has the decision to outsource F-117 depot-level maintenance provided a better value to the Air Force? (3) if outsourcing F-117 depot maintenance is an equal or better value, do we still want to give up the potential core capability? The research questions were answered through an extensive literature review, triangulation of …

A Comparison Of Department Of Defense And Private Sector Fraternization Policies, Jeffrey L. Frye Sep 1999

A Comparison Of Department Of Defense And Private Sector Fraternization Policies, Jeffrey L. Frye

Theses and Dissertations

This thesis explores how the new Department of Defense fraternization policy compares with fraternization policies in use in the private sector. To examine this issue, a detailed discussion of the military and non-military position on fraternization is provided, specifically the non-military position towards workplace romances or dating between co-workers. This thesis then looks at the findings of several studies, surveys, and inquiries to determine how fraternization is currently regulated in the private sector. The results of this study show a majority of commercial organizations do not have written policies prohibiting employee relationships, whether they are peer-peer or supervisor-subordinate relationships. Results …

The Use Of Silica And Alumina To Catalyze The Addition Of Hydrogen Chloride To Alkenes, Ying Liu Sep 1999

The Use Of Silica And Alumina To Catalyze The Addition Of Hydrogen Chloride To Alkenes, Ying Liu

Theses

The use of pre-heated silica gel and alumina along with a chlorinating agent, generates HC1 in situ, which has been found to add to norbornadiene ( IX ). Treated in this fashion, norbornadiene readily results in the formation of two isomers, exo-5- chloronorbornene ( XI ) and 3-chloronotricyclene ( XII ) at room temperature in methylene chloride, with ejco-5-chloronorbornene being the predominant product ( 70% 1% ). In promoting the hydrohalogenation reaction, silica gel was found to be less efficient compared to alumina, but undesired diadducts appeared to be less prominent when silica gel rather than alumina was used. Deuterated …

Measurement Of Residual Stress In Electrodeposited Nickel Films, Gary Richardson Sep 1999

Measurement Of Residual Stress In Electrodeposited Nickel Films, Gary Richardson

Theses

For nearly as long as people have had the ability to create deposits by electrodeposition it has been known that the deposits are made in a state of internal stress. Throughout the past one hundred years several simple techniques used to measure these stresses have been developed. Unfortunately these methods have several shortcomings in both their formulation and interpretation, and seldom have the results from any of these tests been verified by another method. As electroplating becomes utilized to a greater extent in the high-tech applications of aerospace, optics, and electronics it is becoming ever more crucial to gain the …

Formal Legal Truth And Substantive Truth In Judicial Fact-Finding – Their Justified Divergence In Some Particular Cases, Robert S. Summers Sep 1999

Formal Legal Truth And Substantive Truth In Judicial Fact-Finding – Their Justified Divergence In Some Particular Cases, Robert S. Summers

Cornell Law Faculty Publications

Truth is a fundamental objective of adjudicative processes; ideally, ‘substantive’ as distinct from ‘formal legal’ truth. But problems of evidence, for example, may frustrate finding of substantive truth; other values may lead to exclusions of probative evidence, e.g., for the sake of fairness. ‘Jury nullification’ and ‘jury equity’. Limits of time, and definitiveness of decision, require allocation of burden of proof. Degree of truth-formality is variable within a system and across systems.
