The Bill Of Rights As An Exclamation Point, Gary Lawson Jan 1999

The Bill Of Rights As An Exclamation Point, Gary Lawson

University of Richmond Law Review

Akhil Amar's The Bill of Rights: Creation and Reconstruction ("The Bill of Rights") is one of the best law books of the twentieth century. That is not surprising, as it grows out of two of the best law review articles of the twentieth century and was written by one of the century's premier legal scholars. I have been an unabashed Akhil Amar fan ever since our overlapping law school days more than fifteen years ago, and I am thrilled to have my perspicacity and good judgment vindicated by the publication of this remarkable work.

Annual Survey Of Virginia Law: Corporate Law, A. Eric Kauders Jr. Jan 1999

Annual Survey Of Virginia Law: Corporate Law, A. Eric Kauders Jr.

University of Richmond Law Review

Despite its widely held reputation as being a bastion of all things conservative, Virginia has long been a leader on the frontier of corporate and partnership law. As a recent example confirming its progressive reputation, one need look no further than the 1991 passage of legislation permitting the formation of limited liability companies. While the amount ofactivity in corporate law this year was far from notable, the legislation and judicial decisions from the past year continue to demonstrate Virginia's "corporate activism."

Annual Survey Of Virginia Law: Antitrust And Trade Regulation, Michael F. Urbanski, James R. Creekmore Jan 1999

Annual Survey Of Virginia Law: Antitrust And Trade Regulation, Michael F. Urbanski, James R. Creekmore

University of Richmond Law Review

During the past year, the United States Supreme Court, in two decisions of significance, refused to summarily censure conduct having legitimate, procompetitive benefits. In similar fashion, the United States Court ofAppeals for the Fourth Circuit continued to scrutinize antitrust claims, rejecting those failing to measure up to pleading and proof requirements, while also reaffirming the vitality of the state action immunity doctrine as a bar to those that did. Meanwhile, Virginia's federal district courts grappled with time worn conspiracy challenges to medical staff privileging decisions, while simultaneously forging new ground in one of the first cases to consider market definition …

Knowledge Of Aids, Perceived Risk Of Aids, And At-Risk Behaviors Among Older Adults, Cheryl Ann Maes Jan 1999

Knowledge Of Aids, Perceived Risk Of Aids, And At-Risk Behaviors Among Older Adults, Cheryl Ann Maes

UNLV Retrospective Theses & Dissertations

By using a questionnaire derived from the Health Belief Model, this study examined older adults' knowledge of AIDS, perceptions of risk to AIDS, and at-risk behaviors. A total of 166 questionnaires were received from the EXCELL and Senior Adult Theater Group members actively enrolled at the University of Nevada, Las Vegas. The results indicated the respondents were knowledgeable about the transmission and seriousness of AIDS but were less knowledgeable about AIDS transmission through casual contact and the medical aspects of AIDS. Although they recognized the seriousness of AIDS, they generally do not believe that they are susceptible to this disease. …

A Political -Economic View Of The Federal Organization Of Work, Rose Marie Richardson Jan 1999

A Political -Economic View Of The Federal Organization Of Work, Rose Marie Richardson

UNLV Retrospective Theses & Dissertations

Using a comparative historical review of changes in the organization of work, this study analyzes the changing organization of federal work in relation to the organization of work in the private sector. Following a break in 1883 with the simple control wielded by political appointees running federal agencies, federal work became more tightly controlled through a greater bureaucratic organization of government work. However, a continuing influence of private work practices on federal work, such as the incorporation of the principles of scientific management, suggests not only a relationship between private and federal work practices but one that is stronger than …

The Value Of Multimethod Qualitative/Quantitative Research Methodology In An Educational Program Evaluation: A Case Study, Catharine C. Knight, Walter J. Kuleck Jan 1999

The Value Of Multimethod Qualitative/Quantitative Research Methodology In An Educational Program Evaluation: A Case Study, Catharine C. Knight, Walter J. Kuleck

Mid-Western Educational Researcher

This paper presents the case of an evaluation of a literacy-based public school classroom intervention that had been implemented without initial regard for subsequent evaluation, to examine the value of a multimethod qualitative and quantitative approach. We show how this evaluation challenge was ad-dressed using both techniques, and how they complement each other to create richer understandings. Given the small number of participants in and the brevity of the intervention, the finding of quantitative results that support the very positive qualitative results is encouraging. Thus, the multimethod qualitative/ quantitative approach appears to have been a useful and informative one in …

Stock Index Futures Trading And Volatility In International Equity Markets, Huseyin Gulen, Stewart Mayhew Jan 1999

Stock Index Futures Trading And Volatility In International Equity Markets, Huseyin Gulen, Stewart Mayhew

Purdue CIBER Working Papers

We examine stock market volatility before and after the introduction of equity index futures trading in twenty-five countries using various models that account for asynchronous data, conditional heteroskedasticity, asymmetric volatility responses, and the joint dynamics of each country's index with the world market portfolio. We find that futures trading is related to an increase in conditional volatility in the United States and Japan, but in nearly every other country, we find either no significant effect, or volatility-dampening effect. This result appears to be robust to model specification, and is corroborated by further analysis of the relationship between volatility, trading volume …

Skills, Labour Costs, And Vertically Differentiated Industries: A General Equilibrium Analysis, Stefan Lutz, Alessandro Turrini Jan 1999

Skills, Labour Costs, And Vertically Differentiated Industries: A General Equilibrium Analysis, Stefan Lutz, Alessandro Turrini

Purdue CIBER Working Papers

The effect of labour costs on industry profits, employment and labour income is at the heart of the current European debate on industry competitiveness. High wages paid in European countries such as Germany are generally considered harmful for industry profitability. Though, high wages appear also to be associated with high labour skills and then with superior product quality. Similarly, a reduction in labour taxes is often invoked as a tool t improve industry profitability, but this argument hardly takes into account the demand effects of such a tax reform. In this paper we analyse the trade-off between labour costs and …

The Effect Of National Culture On Partner Buyouts In Cross-Border Biotechnology Alliances, Timothy B. Folta, Walter J. Ferrier Jan 1999

The Effect Of National Culture On Partner Buyouts In Cross-Border Biotechnology Alliances, Timothy B. Folta, Walter J. Ferrier

Purdue CIBER Working Papers

This study examines how national culture influences the likelihood and rate of buyouts amont R&D equity alliances and joint ventures in the biotechnology industry. We hypothesize that the interaction of specific national culture attributes and cultural differences between alliance partners bear upon: a) the amount of endogenous uncertainty surrounding the potential integration of the target firm and b) the marginal rate of learning in hierarchical versus collaborative governance. Applying a competing hazard model to a sample of 173 joint ventures and minority equity collaborations in the biotechnology industry, we found that investing firms from high power distance and high uncertainty …

Stores, Prices, And Currency Substitution, Camera Gabriele, Johannes Winkler Jan 1999

Stores, Prices, And Currency Substitution, Camera Gabriele, Johannes Winkler

Purdue CIBER Working Papers

We study endogenous currency substitution in a decentralized trade environment. Sellers maximize profits from sales of imperfectly substitutable goods by posting prices in either one of two currencies. A unique symmetric equilibrium exists where goods are priced only in the local currency. This occurs if foreign trade is sporadic, there is sufficient but not excessive liquidity, and discounting is low. Excess or scarcity of liquidity, however, induces sellers to extract all surplus from buyers. This destroys the monetary equilibrium and shuts down trade. Equilibria with and without currency substitution coexist on some redion of the parameter space, and may be …

The Cadbury Committee, Corporate Performance And Top Management Turnover, Jay Dahya, John J. Mcconnell, Nicolaos G. Travlos Jan 1999

The Cadbury Committee, Corporate Performance And Top Management Turnover, Jay Dahya, John J. Mcconnell, Nicolaos G. Travlos

Purdue CIBER Working Papers

In December 1992, the Cadbury Committee published the Code of Best Practice which recommended that boards of publicly-traded UK corporations include at least three outside directors and that the positions of the chairman of the board and chief executive officer not be held by a single individual. The underlying presumption was that these government-sponsored recommendations would lead to enhanced board oversight. As a test of that presumption, we analyze the relation between top management turnover and corporate performance. We find that CEO turnover increased following publications of the Code, that the relationship between CEO turnover and performance was strengthened following …

Toward A Geography Of Trade Costs , David Hummels Jan 1999

Toward A Geography Of Trade Costs , David Hummels

GTAP Working Papers Archive

What are the barriers that separate nations? While recent work provides intriguing clues, we have remarkably little concrete evidence as to the nature, size, and shape of barriers. This paper offers direct and indirect evidence on trade barriers, moving us toward a comprehensive geography of trade costs. There are three main contributions.

One, we provide detailed data on freight rates for a number of importers. Rates vary substantially over exporters, and aggregate expenditures on freight are at the low end of the observed range. This suggests import choices are made so as to minimize transportation costs. Two, we estimate the …

Nightly And Seasonal Movements Of Boiga Irregularis On Guam, Mark Tobin, Robert Sugihara, Patricia Pochop, Michael Linnell Jan 1999

Nightly And Seasonal Movements Of Boiga Irregularis On Guam, Mark Tobin, Robert Sugihara, Patricia Pochop, Michael Linnell

United States Department of Agriculture Wildlife Services: Staff Publications

Brown tree snakes (Boiga irregularis, BTS), inadvertently introduced to the island of Guam shortly after World War II, have had catastrophic effects on the native fauna of this U.S. territory. We used radio-telemetry to monitor daytime refugia and nightly movements of 60 BTS (30 during each of two seasonal periods) to determine the extent of nightly, weekly, and monthly movements. Eighty-three percent of subadult daytime sightings were in trees, compared to only 49% of adult daytime sightings. Most measures of movement did not vary with seasonal period, sex, or age class. BTS moved an average of 64 m …
