The Baby Boom As It Ages: How Has It Affected Patterns Of Consumptions And Savings In The United States?, Diane J. Macunovich

Center for Policy Research

Using detailed estimates of personal consumption expenditures at the state level for 1900, 1929, 1970, and 1982 developed by Stanley Lebergott, this paper demonstrates that the passage of the Baby Boom from childhood through the teen years and into family formation would have caused market swings in patterns of aggregate consumption and savings in the United States during the past 50 years. The effect of age structure on personal consumption expenditures is estimated using population by single year of age from 0 to 85, revealing the expected pattern of life cycle consumption and savings in the adult years. In addition, …

Effects Of Diflubenzeron On The Ontogeny Of Phototaxis By Palaemonetes Pugio, J.E.H. Wilson, R.B. Forward Jr., J.D. Costlow

Gulf and Caribbean Research

The phototaxis by larvae of the grass shrimp Palaemonetes pugio that hatched from embryos which were exposed to a single pulse concentration of diflubenzuron (DFB; Dimilin®) was quantified. Stage IV embryos (6-day-old) were exposed to 0.5 µg/L of DFB for 4 days followed by transfer into clean seawater for the rest of the incubation period. The photoresponses of light-adapted larvae from untreated embryos and embryos treated with 0.5 µg/L DFB were monitored from 1 day through 8 day post hatch for phototactic responses to 500 nm light. Larvae from untreated embryos exhibited strong positive phototaxis at high light intensities (3 …

Responses Of Glossina Fuscipes Fuscipes (Diptera: Glossinidae) And Other Diptera To Carbon Dioxide In Linear And Dense Forests, M. M. Mohamed-Ahmed, S. Mihok

All Peer-Reviewed Publications

The responses of Glossina fuscipes fuscipes Newstead and other Diptera to carbon dioxide were studied in linear and dense forests along the shores of Lake Victoria, Kenya. Flies were caught in biconical traps and were intercepted with electric nets while in flight near traps. Carbon dioxide dispensed at a high rate (51 min-1) in linear forest failed to increase the numbers of tsetse attracted to or caught in traps. In contrast, catches of non-biting Muscidae, Stomoxyinae and Tabanidae were improved by up to 11 times. Inside dense forest, carbon dioxide released at half this rate increased both the numbers of …

Frustration, Richard F. Devlin Frsc Jan 1999

Frustration, Richard F. Devlin Frsc

Articles, Book Chapters, & Popular Press

As noted elsewhere in this book, "sanctity of contract" has been identified as one of the cornerstones of the classical model of contracts. However, as the previous chapter on mistake indicated, in certain limited situations parties may be excused from their contractual obligations. Frustration provides another example of an excuse from performance obligations. Whereas mistake deals with inaccurate assumptions or lack of knowledge about past or existing circumstances, frustration relates to inaccurate assumptions about future circumstances. Sometimes it is not clear whether a mistake or a frustration analysis is appropriate.

A Unified Approach To Difference Sets With Gcd(V, N) > 1, James A. Davis, Jonathan Jedwab Jan 1999

A Unified Approach To Difference Sets With Gcd(V, N) > 1, James A. Davis, Jonathan Jedwab

Department of Math & Statistics Faculty Publications

The five known families of difference sets whose parameters (v, k, λ; n) satisfy the condition gcd(v,n) > 1 are the McFarland, Spence, Davis-Jedwab, Hadamard and Chen families. We survey recent work which uses recursive techniques to unify these difference set families, placing particular emphasis on examples. This unified approach has also proved useful for studying semi-regular relative difference sets and for constructing new symmetric designs.

Codes, Correlations And Power Control In Ofdm, James A. Davis, Jonathan Jedwab, Kenneth G. Paterson Jan 1999

Codes, Correlations And Power Control In Ofdm, James A. Davis, Jonathan Jedwab, Kenneth G. Paterson

Department of Math & Statistics Faculty Publications

Practical communications engineering is continually producing problems of interest to the coding theory community. A recent example is the power-control problem in Orthogonal Frequency Division Multiplexing (OFDM). We report recent work which gives a mathematical framework for generating solutions to this notorious problem that are suited to low-cost wireless applications. The key result is a connection between Golay complementary sequences and Reed-Muller codes. The former are almost ideal for OFDM transmissions because they have a very low peak-to-mean envelope power ratio (PMEPR), while the latter have efficient encoding and decoding algorithms and good error correction capability. This result is then …

A Model For Arbitration: Autonomy, Cooperation And Curtailment Of State Power, Kenneth Jan 1999

A Model For Arbitration: Autonomy, Cooperation And Curtailment Of State Power, Kenneth

Fordham Urban Law Journal

As compared with the formal pleadings, massive discovery, aggressive motion practice, and endless appeals of litigation, arbitration is undoubtedly more efficient as a dispute resolution mechanism. However, efficiency is only one of many advantages of arbitration. Arbitration empowers disputing parties, promotes individual autonomy and cooperation, and curtails the power of government in the process. Still, the state should not wholly limit its involvement in arbitral processes; the courts do and should have a substantial role in determining the enforceability of arbitration agreements and awards in a few select contexts. Overall, courts should enforce arbitration agreements and only limit enforceability that …

Mother Still Knows Best: Cancer-Related Gene Mutations, Familial Privacy, And A Physician's Duty To Warn, Alissa Jan 1999

Mother Still Knows Best: Cancer-Related Gene Mutations, Familial Privacy, And A Physician's Duty To Warn, Alissa

Fordham Urban Law Journal

The vows of the Hippocratic Oath which include a vow to abstain from sharing a patient's personal information remains an important tenet of medical care today. Physician-patient confidentiality even abstains sharing information with patients' families. However, when medical information affects the health of the patient's relatives, many medical professionals assert that they have a duty to share the information, with or without the patient's consent, particularly in the context of children of patients with genetic diseases and disorders, where forewarning may significantly decrease the risks or increase prevention of the effects of the disease or disorder. Currently, while physicians respect …

We Have Seen The Enemy: Scenes From A Trial, Robert E. Precht Jan 1999

We Have Seen The Enemy: Scenes From A Trial, Robert E. Precht

Fordham Urban Law Journal

This Article examines two traps that are particularly likely to undermine prosecutorial decision-making--the confirming-evidence trap and the anchoring trap. During the World Trade Center bombing trial, at which the author served as defense counsel, prosecutors stumbled into both of these traps. Part I of this Article examines the confirming-evidence trap in the context of the prosecution's failure to accept contradictory evidence regarding the material used in the bomb. Part II similarly examines the anchoring trap in light of the debacle that occurred during testimony by the prosecution's main witness. In addition to examining these episodes, the Article concludes that prosecutors …

Working Outside The Rules: The Undefined Responsibilities Of Federal Prosecutors, Laurie L. Levenson Jan 1999

Working Outside The Rules: The Undefined Responsibilities Of Federal Prosecutors, Laurie L. Levenson

Fordham Urban Law Journal

This Article discusses the undefined responsibilities of federal prosecutors. For purposes of example, the essay focuses primarily on five situations in which federal prosecutors are often expected to operate "outside" of the rules, including: charging and investigative decisions, discovery, plea bargaining, dealing with the press, and sentencing decisions. While there are "rules" in each of these areas, they take a back seat to the discretionary powers prosecutors are expected to exercise wisely when performing their duties. In judging whether there has been an appropriate exercise of those powers, it is not the rules that will govern society's judgment. Rather, the …

Is Sexual Orientation Immutable?: Presenting Scientific Evidence In Litigation To Gain Strict Scrutiny, Dan Brook, Suzanne Goldberg, Kate Diaz

Fordham Urban Law Journal

The panelists discussed the issue of immutability. Professor Goldberg explored the legal landscape, the use of scientific evidence related to immutability at trial, with a particular focus on Romer v. Evans, and critiqued the use of science-based immutability evidence in litigation. Dr. Brook looked at a number of studies in the etiology of homosexuality, and concluded that the best method of determining immutability scientifically is looking at studies that seek to determine if, and how easily, sexuality can be changed. Finally, Ms. Diaz discussed the political economy of theories of homosexuality, looking at the examples of the political economy and …

Name Reporting And Partner Notification Legislation, Catherine Hanssens, Matthew Carmody, Haley Gorenberg, Mildred Pinot

Fordham Urban Law Journal

The panelists discussed the issues of names-based HIV reporting and partner notification. The discussion focused on why names reporting became such an important and controversial issue. The Centers for Disease Control and Prevention waged an aggressive campaign in states to institute a national system of HIV test reporting, arguing that it is essential to get a more accurate picture of the epidemic and facilitate individual follow-up. The panelists assessed the pros and cons of this program. Name reporting and partner notification under New York law were also addressed. Finally, the panelists provided discussion on how those contemplating getting tested or …

Section 60.41 Of The New York Criminal Procedure Law: The Sexual Assault Reform Act Of 1999 Challenges Molineux And Due Process, Brooks Holland Jan 1999

Section 60.41 Of The New York Criminal Procedure Law: The Sexual Assault Reform Act Of 1999 Challenges Molineux And Due Process, Brooks Holland

Fordham Urban Law Journal

The 1999 Sexual Assault Reform Act of 1999 proposed the addition of section 60.41 to Article 60 of the New York Criminal Procedure Law to allow prosecutors in sexual assault prosecutions to introduce evidence of a defendant's previous commission of any "offense or offenses of sexual assault.., on any matter to which it is relevant, including the defendant's propensity to commit an offense of sexual assault or the credibility of the alleged victim of the sexual assault . ." The author argues that this law would upset a century of New York law under the Molineux rule, which holds that …

A Vocation For Law? American Jewish Lawyers And Their Antecedents, Marc Galanter Jan 1999

A Vocation For Law? American Jewish Lawyers And Their Antecedents, Marc Galanter

Fordham Urban Law Journal

Louis D. Brandeis is the presiding eminence in the story of the encounter of Jewish with the American legal order. In the centuries since Brandeis started practicing law, Jews have flourished exceedingly in both the legal professional mainstream (practitioners, judiciaries, academics) and the public interest sector. Can this extravagant participation in both hemispheres of the world of American lawyering be explained by something unique to the Jewish tradition or experience? This Essay addresses that question by focusing on Brandeis, who manifests in his person both sides of this extraordinary flourishing. Brandeis seems a felicitous path to understanding, not because he …

The Spirit And The Law , Thomas W. Porter, Jr. Jan 1999

The Spirit And The Law , Thomas W. Porter, Jr.

Fordham Urban Law Journal

This Essay asserts that the practice of law is experiencing a spiritual crisis at both the personal and professional level. The Essay seeks to determine the role that the crisis in our paradigms has played in the crisis our personal and institutional lives. Although the crisis in our paradigms are not necessarily responsible for all our problems, our institutions and systems can cause us to be estranged from ourselves and that is what is happening today in the practice of law. We, as a profession, are beginning to see the limitations of our old paradigm, with retributive justice as its …

A Plumber's Guide To Lawyering, Stephen P. Wink Jan 1999

A Plumber's Guide To Lawyering, Stephen P. Wink

Fordham Urban Law Journal

We accept as the natural way that some must lose if others are to win; that some must go hungry, while others eat fully. But, Jesus taught that there is a third way that can arrest the cycle of violence and domination. A way that strikes a chord at the core of beings so that we may fully hear and see the other person we are dealing with. This is what is sometimes called nonviolent resistance. It springs from a conversation with another -- beyond just talking -- but a dialogue of being with another on a one to one …

Hiv Name Reporting And Partner Notification In New York State, Sonia Bhatnager

Fordham Urban Law Journal

This Article focuses on a 1998 New York law that required physicians and other health officials to report individuals who test positive for HIV, AIDS, or other HIV-related illnesses to the municipal health commissioner. As New York has the highest rate of reported AIDS cases, the Article notes that the state's decision to enact this law could have significant influence on other states. It begins by describing the partner notification system laws in the United States, and then presents arguments for and against partner notification. The Article ultimately argues for a modified version of the New York law. This refined …
