Transfer Pricing, Anders Leif Allvin Jan 1999

Transfer Pricing, Anders Leif Allvin

LLM Theses and Essays

Transfer pricing is one of the principal international taxation issues of the 1990s and potentially of future decades as well. For corporate enterprises, it can be difficult enough to do business in just one country, but it gets even more complex when they go international. The growth of multinational enterprises (MNEs) creates complex taxation issues for both the tax administrations as well for the MNE. Transfer pricing concerns allocation of income earned within affiliated corporate groups in different countries, which must satisfy tax authorities that they are not evading taxes through the use of transfer pricing. The main problem with …

Poison And Dead Hand Pills, Markets For Corporate Control, And Implications For An Emerging Market Like China, Shueiqing Zhou

LLM Theses and Essays

In the past twenty years, the Chinese government has been adopting open door and economic reform policies. Because of historical, economic, legal, and cultural traditions, a modern corporation system is far from being established in China. There are lots of things that need to do to establish a perfect corporate system. This thesis reviews diverse interpretations of the function of poison pills in light of recent judicial decisions and underlying empirical evidence. It also reviews recent judicial decisions regarding the new version of poison and dead hand pill. The author discusses the recent trend of by-law restrictions in an attempt …

Application-Centered Internet Analysis, Tim Wu Jan 1999

Application-Centered Internet Analysis, Tim Wu

Faculty Scholarship

There is a now-standard debate about law and the Internet. One side asserts that the Internet is so new and different that it calls for new legal approaches, even its own sovereign law. The other side argues that, although it is a new technology, the Internet nonetheless presents familiar legal problems. It is a battle of analogies: One side refers to Cyberspace as a place, while the other essentially equates the Internet and the telephone.

In my view, these two positions are both wrong and right: wrong in their characterization of the Internet as a whole, yet potentially right about …

Using A Personal Construct Approach To Explore Quality Of Life Issues With People With Learning Disabilities, Claire Marie Boyes Jan 1999

Using A Personal Construct Approach To Explore Quality Of Life Issues With People With Learning Disabilities, Claire Marie Boyes

School of Psychology Theses

While an agreed definition of quality of life rennains elusive, research into the quality of life of people with learning disabilities has developed significantly. Following a discussion of this work, the author argues that these assessment processes should be refocused towards the views of people with learning disabilities themselves, particularly given the idiosyncratic nature of the quality of life issue. This study explores the use of the Personal Construct Psychology (PCP) approach in assessing quality of life with people with learning disabilities.'Ideal'elements were introduced into repertory grid production to measure differences between ideal and actual situations. The results indicate the …

Theory Of Mind In Children With Autism: Is There A Need For Better Tests Of What They Know?, Alex Karen Proto Jan 1999

Theory Of Mind In Children With Autism: Is There A Need For Better Tests Of What They Know?, Alex Karen Proto

School of Psychology Theses

This research looked at the ability of children with autism to understand theory of mind. This is the ability to attribute mental states (e.g. believing, thinking, knowing etc.) to oneself and to others. The main aim of the study was to provide evidence, contrary to a large body of previous research, that individuals with autism can exhibit a theory of mind, when the standard tests used in the past are simplified for this population. A further aim of the study was to show that language ability is significant in terms of theory of mind task performance. It was hypothesised, because …

Libraries Face Internet Filter Question, Pat Newcombe Jan 1999

Libraries Face Internet Filter Question, Pat Newcombe

Faculty Scholarship

The Author describes how libraries electronically bar access to objectionable Internet sites and the legal trouble encountered with this policy by free-speech advocates. The ALA, the American Civil Liberties Union, and other free-speech advocates have strongly resisted having libraries play the role of lnternet censor. But parents and patrons who use the libraries on a regular basis have pressured libraries in a growing number of communities to devise some kind of barrier to viewing sexually explicit material from the Internet on library PCs.

Guarding The Treasure: Protection Of Student Religious Speech In The Classroom, Chad Allred Jan 1999

Guarding The Treasure: Protection Of Student Religious Speech In The Classroom, Chad Allred

Seattle University Law Review

This Article makes two observations, both in Parts II and III, that have received insufficient attention in the academic literature and in the courts. First, students in public school classrooms are "captive speakers." Due to compulsory attendance laws, students are "captive" not only when hearing speech, but also when they wish to speak. Adhering to the First Amendment means protecting not only captive listeners, but also captive speakers. Second, in the face of the potential misperception of students that their school endorses the speech of a fellow student, teachers have an extraordinary opportunity to simultaneously disclaim endorsement and teach the …

Getting Ahead With Washington's Workfirst Program: Are Battered Women Left Behind?, Wendy Davis Jan 1999

Getting Ahead With Washington's Workfirst Program: Are Battered Women Left Behind?, Wendy Davis

Seattle University Law Review

This Comment will suggest that although the structure of Washington's WorkFirst Act could help victims become self-sufficient, the current implementation of the Act does not adequately address the particular needs of victims. As a result, a victim's chances of achieving financial independence from either the state or her abuser are minimal. Part II of this Comment will give a brief summary of the federal guidelines under which Washington's WorkFirst Act was developed. Part III will outline the requirements of the WorkFirst Act, and in particular, the Act's provisions that address or affect domestic violence victims. Included in this section will …

Critiquing And Evaluating Law Students' Writing: Advice From Thirty-Five Experts, Anne Enquist Jan 1999

Critiquing And Evaluating Law Students' Writing: Advice From Thirty-Five Experts, Anne Enquist

Seattle University Law Review

While there are some differences of opinion about what is the best way to comment on and grade law students' writing, a consensus seems to be developing based on the experience and insights of those in the profession who have done the job the longest and survived to tell about it. To help articulate this consensus, I selected thirty-seven experienced legal writing professors and asked them to respond to a questionnaire about critiquing and evaluating law students' writing. My goal was to gather and record their wisdom, insights, and experience for other legal writing professors, particularly those who are new …

Including Best Available Science In The Designation And Protection Of Critical Areas Under The Growth Management Act, Alan D. Copsey Jan 1999

Including Best Available Science In The Designation And Protection Of Critical Areas Under The Growth Management Act, Alan D. Copsey

Seattle University Law Review

This Article discusses the meaning of these latter two requirements: the requirements to include best available science and to give special consideration to the conservation of anadromous fisheries. Section II defines "best available science" by examining the fundamental characteristics of scientific information applied in the context of the GMA. Expanding on the work of a technical team convened by DCTED, this Article suggests an approach useful for identifying scientific information and assessing which of that information should be considered the "best available science." Section III concludes that the requirement of RCW 36.70A. 172(1) to include best available science is a …

Legal Ethics And A Civil Action, Kevin E. Mohr Jan 1999

Legal Ethics And A Civil Action, Kevin E. Mohr

Seattle University Law Review

This Article shows how A Civil Action can be used to supplement a course in Professional Responsibility. A Civil Action contains many events that can similarly be used to introduce students to ethical dilemmas they will confront when they enter the profession. These events can breathe life into otherwise dry discussions of acceptable ethical behavior as set out in ethical codes. In accord with the Lessons from Woburn Project's goal to make A Civil Action and its associated materials into a powerful teaching tool, the book's events vividly illustrate the ethical parameters within which a lawyer must operate, ethical parameters …

How Ethical Lessons Learned Online Shape Future Research Efforts, Susan B. Barnes Jan 1999

How Ethical Lessons Learned Online Shape Future Research Efforts, Susan B. Barnes

Iowa Journal of Communication

Computer-mediated environments raise serious ethical questions for online researchers because research can occur without informing the participants under observation. This article describes a variety of ethical problems encountered by the author during her five years of online research. Additionally, it discusses the advantages and disadvantages of a number of ethical guidelines that have been applied to online research.

Ethics And The Internet Studies, Steve Jones Jan 1999

Ethics And The Internet Studies, Steve Jones

Iowa Journal of Communication

Insufficient attention has been paid to the practical as well as methodological dimensions of the ethics of online research. Though discussion of research methods for the study of online social phenomena has recently come to the fore, questions concerning the development and implementation of ethical guidelines, the conditions of research, and basic definitions of objects and subjects of study have yet to be fully engaged. This essay maps out some of the terrain of that engagement. It asks questions about the consequences of research, and notes that the Internet is not only technology but a practice that must be situated …

Effect Of Discounting On Self-Generated Attitude Change: A Person By Situtation, Fiorella Giulietta Speziani Jan 1999

Effect Of Discounting On Self-Generated Attitude Change: A Person By Situtation, Fiorella Giulietta Speziani

UNF Graduate Theses and Dissertations

This research used a trait-based impression formation task to explore the effect of instructional set and opportunity for thought on inconsistency discounting. It was predicted that attitude polarization would be attenuated, regardless of opportunity for thought, when discounting incongruent information was difficult. When discounting incongruent information was easy, attitude polarization was expected to increase as opportunity for thought increased. The relationship between discounting and opportunity for thought was expected to be accentuated when individuals are low in tolerance for ambiguity. The results did not support these predictions. Explanations for the results are discussed and directions for future research are proposed.

An Assessment Of The Collective Resources Base Of Florida Community College Library Collections: A Profile With Interpretative Analysis, Anna H. Perrault, John N. Depew, Richard Madaus, Ann Armbrister, Jeannie Dixon Jan 1999

An Assessment Of The Collective Resources Base Of Florida Community College Library Collections: A Profile With Interpretative Analysis, Anna H. Perrault, John N. Depew, Richard Madaus, Ann Armbrister, Jeannie Dixon

School of Information Faculty Publications

The Florida Community College Assessment Project is the first reported statewide assessment for community college collections using quantitative data extracted from a network information system. The collection analysis is based upon bibliometric data extracted from LINCC, the Library Information Network for Community Colleges, in Florida. The analysis of the aggregated resources base by imprint year shows that the resources of Florida community colleges are significantly out of date with outdated materials prevalent in all major subject divisions including the sciences and health sciences. This is the only reported project to analyze data from a network collective resources base of community …

Intent, Purpose And Motivation In Constitutional Litigation, Leon Friedman Jan 1999

Intent, Purpose And Motivation In Constitutional Litigation, Leon Friedman

Hofstra Law Faculty Scholarship

I will discuss the wonderful interrelation between intent, purpose and motivation. I have always loved analyzing the difference between these three concepts in the criminal procedure area. These words are used interchangeably in three different areas of the law and the words mean something different depending upon what area you are talking about.

Let me briefly get the criminal part of it out of the way. We use intent in the criminal law because at that point the key consideration is whether one volitionally wanted to do that which one was accused of doing. Intent in the criminal area is …

The Age Of Autonomy: Legal Reconceptualizations Of Childhood, Janet L. Dolgin Jan 1999

The Age Of Autonomy: Legal Reconceptualizations Of Childhood, Janet L. Dolgin

Hofstra Law Faculty Scholarship

This Article aims to explain the peculiarity involved in the law's redefining children in two contexts in which such redefinitions seem least felicitous. Toward this effort, Part II, following this introductory section, outlines the developing preference within society and within the law for individualism within American families, especially insofar as adults are concerned. Part III considers the depth of social ambivalence about that preference with regard to understandings of children and childhood. Part IV details and compares concrete legal responses to children in dysfunctional families and to children within the juvenile justice system. Part V focuses on the implications of …
