Regulatory Protectionism And The Law Of International Trade, Alan O. Sykes

A wide array of policy instruments can protect domestic firms against foreign competition. Regulatory measures that raise the costs of foreign firms relative to domestic firms are exceptionally wasteful protectionist devices, however, with deadweight costs that can greatly exceed those of traditional protectionist instruments such as tariffs and quotas. This Article develops the welfare economics of regulatory protectionism and a related political economy analysis of the national and international legal systems that must confront it, including the WTO, the NAFTA, the European Union, and the United States federal system. Alpha-Chloralose Immobilization Of Rock Doves In Ohio, Jerrold L. Belant, Thomas W. Seamans

To improve capture efficacy of rock doves (Columba livia) in nuisance situations, we reevaluated the effectiveness of three dosages (60, 120 and 180 mg/kg) of alpha-chloralose (AC). Responses to immobilization using 180 mg/kg AC also were compared in rock doves deprived of food for 16 hr and not food deprived. Mean (±SE) time to first effects (33 ± 2 min) and mean time to capture (94 ± 5 min) were significantly less for rock doves receiving 180 mg/kg than for rock doves receiving lower dosages (≥53 ± 3 min and ≥153 ± 17 min, respectively). Demonstration Of Tritrichomonas Foetus In The External Genitalia And Of Specific Antibodies In Preputial Secretions Of Naturally Infected Bulls, J. C. Rhyan, K. L. Wilson, B. Wagner, M. L. Anderson, R. H. Bondurant, D. E. Burgess, G. K. Mutwiri, L. B. Corbeil

Portions of penis and prepuce were collected from 24 bulls with current or recent Tritrichomonas foetus infection. Epididymides were collected from seven of the bulls, and seminal vesicles and prostate were collected from four. Following immunohistochemical staining with two monoclonal antibodies (34.7C4.4 and TF1.15) prepared against T. foetus surface antigens, trichomonads were identified in sections from 15 of the bulls. Organisms were most often located in penile crypts in the midshaft and caudal regions and less often in preputial crypts. Trichomonads were not observed in sections from other genitalia or in subepithelial tissue. T. foetus antigen, however, was present in …

Federalism, Welfare Reform And The Minority Poor: Accounting For The Tyranny Of State Majorities, Sheryll D. Cashin

The ideals of federalism contributed significantly to the passage of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, which repealed the AFDC entitlement program and devolved broad authority to the states to design and administer programs for welfare reform. Professor Cashin challenges the federalist, a priori assumption that states are the natural situs of policy authority concerning the poor. She argues that the Act is likely to yield harmful consequences for the poor-especially the minority poor-because the political economy of state decisionmaking is more hostile to redistributive aims than is that of national decisionmaking.

Despite over two decades of reform, fundamental failures persist in the justice system's response to domestic violence. Society now widely accepts elimination of intrafamily abuse as a crucial goal, and it has been illegal in most states since the late nineteenth century. But the problem remains one of epidemic proportions. As documented in Part I of this Article, battering by husbands, ex-husbands, or lovers is the single largest cause of injury to women in the United States, and accounts for approximately thirty percent of all murders of women. Rawls’ Political Constructivism As A Judicial Heuristic: A Response To Professor Allen, Heidi Li Feldman

In her Dunwody Lecture, Professor Anita Allen insightfully calls our attention to the social contract tropes that pepper American case law. She claims that these tropes function ideologically, disguising politics, biases, and raw power in judicial decision-making. To examine this claim, I distinguish two versions of social contract theory Professor Allen groups together. Metaphors drawn from classical social contract theory-epitomized by the work of John Locke and Jean-Jacques Rousseau may well function as Professor Allen suspects. Tools taken from twentieth century neo-Kantian social contract theory-inaugurated and developed by John Rawls-could have precisely the opposite effect. Rawlsian social contract theory might …

Traditional notions and rules of professionalism in the legal profession have been premised on particular conceptions of the lawyer's role, usually as an advocate, occasionally as a counselor, advisor, transaction planner, government official, decision maker and in the recent parlance of one of this symposium's participants-a "statesman [sic]. '" As we examine what professionalism means and what rules should be used to regulate its activity, it is important to ask some foundational questions: For what ends should our profession be used? What does law offer society? How should lawyers exercise their particular skills and competencies?

The Vertical Separation Of Powers, Victoria Nourse

Standard understandings of the separation of powers begin with the concept of function. The author argues that function alone cannot predict important changes in structural incentives and thus serves as a poor proxy for assessing real risks to governmental structure. To illustrate this point, the article returns to proposals considered at the Constitutional Convention and considers difficult contemporary cases such as Morrison v. Olson, Clinton v. Jones, and the Supreme Court's more recent federalism decisions. Dignity And Discrimination: Toward A Pluralistic Understanding Of Workplace Harassment, Rosa Ehrenreich Brooks

Part I of this article briefly examines some of the drawbacks and inconsistencies of Title VII sexual harassment jurisprudence and shows that Title VII does not provide an adequate framework for understanding many common forms of workplace harassment. Title VII is unquestionably a critical means of fighting against workplace discrimination; however, by emphasizing discrimination at the expense of dignity, the Title VII workplace harassment paradigm provides an incomplete understanding of the wrongs of workplace harassment.

The Peel-Harvey Coastal Plain Catchment is located immediately south of Perth in Western Australia and covers approximately 190,000 ha. It extends from Forrestdale in the north to Harvey in the south, and west from the Darling Scarp to Mandurah on the coast. The boundary of the catchment, as illustrated in Figure 1, represents the area which has been approved by the DEP for the broadscale application of Alkaloam as a soil amendment. This Comment argues that the parties to the International Conference on Harmonization of Technical Requirements for Regulation of Pharmaceutical Drugs (ITCH) should adopt more specific guidelines for pediatric research than those included in its Good Clinical Practice Guidelines (ICH GCP), and analyzes their attempt to do so in the Draft Guideline on Pediatric Trials. Part I of this Comment outlines the genesis of the current international guidelines for human research and how they relate to pediatric subjects. The topic for this thesis examines the utilization of senatorial websites by United States Senators as a new communication tool. Three different areas of content will be examined: informational content, interactive content and audio-visual content. Those three areas will be used to examine the differences between Senators in several different ways: gender and race, party affiliation, length of service in the senate, region of the country they represent, urban and rural states, and age of the Senators. Contemporary Romanian Theatre: Artistry, Honesty, And Adaptation In The Plays Of Iosif Naghiu, Dumitru Radu Popescu And Marin Sorescu, Eric Pourchot

Dissertations, Theses, and Capstone Projects

This study examines the plays and productions of three contemporary Romanian playwrights—Iosif Naghiu, Dumitru Radu Popescu, and Marin Sorescu—as they reflect the changing cultural policies and climate of Romania from 1968 to 1998. The three case studies demonstrate that, faced with harsh political censorship during the Ceausescu years and economic difficulties since the overthrow of communism in 1989, contemporary Romanian drama and theatre has nevertheless maintained an artistic merit and integrity deserving of wider acknowledgment. Romanian directors are well-known internationally but, paradoxically, the drama of Romania, despite close linguistic connections to Western Europe, has received far less attention than has …
