The First Amendment of the United States Constitution, made applicable to the states through the Fourteenth Amendment, protects a person's right to the free exercise of religion. This protection, however, fails to provide a framework with which to reconcile the freedom of religious conduct with the need for government to regulate conduct. All three branches of government, as created in the Constitution, create and refine this framework. Traditionally, the judiciary has been the final interpreter of the Constitution and, in this capacity, has defined the powers of the other branches of government. By 1800 the United States had emerged from the turmoil of its Revolutionary era to begin focusing on economic growth and westward expansion. To open up the vast trans-Appalachian region the federal government in 1802 began formulating plans to fund and build a "national road to connect the eastern seaboard with the "western waters. After considerable debate, Congress in 1806 passed an act that called for laying out and making a road from the Potomac River at Cumberland, Maryland, to the Ohio River at Wheeling, (West) Virginia. Very few studies have examined the concept of fear in older adults. Moreover, there is no self-report measure of fear that has been shown to be psychometrically sound for use with older individuals. The primary purposes of the present study were: (a) to develop a measure of self-reported fear that includes fears relevant to older adulthood, (b) to develop a measure for assessing daily interference associated with fears, and (c) to examine the psychometric properties of this new instrument. At the end of the fifteenth century, Emperor Maximilian I of the Germany Empire was trying to unite his country. He also tried to force the Swiss Confederation to become closer members of the empire. This lead to the Swabian War of 1499. In a series of battles and campaigns, the Swiss were successful in defeating the famous Swabian Landsknechte who had learned to fight in the Swiss manner. As an outcome of the war, the Swiss Confederation were even more independent of the German Empire.

This study evaluated the effectiveness of prompting and non-prompting in a testing format as an instructional technique using computer-based flashcards. The instructional content was four sets of flashcards, ten questions in each set, pertaining to the software program Authorware. Eight graduate students, four females and four males, served as participants. Groups 1 and 2 consisted of four participants each with Group 1 receiving Sets 1 and 4 with the prompting option and Sets 2 and 3 without the prompting option. Group 2 received Sets 1 and 4 without the prompting option and Sets 2 and 3 with the prompting option. …

Recent Scholarship in geography explores the cultural identity of place by analyzing literature, music and art, but few scholars have studied pottery art, one of the oldest forms of art making. This study of Seagrove, a small central North Carolina town with a long tradition of locally produced pottery, examines the way place identity develops, is presented, takes multiple forms, and is contested through pottery art. Further, it explores the concept of institutionalized place identity by analyzing the impact of a new Pottery Center and Museum in this town. The performance of N-Halamine polymers in eliminating bacteria from water streams was studied in this research. Numerous experiments were performed to determine the efficacy of both pure N-Halamine polymer and polymer coated on carrier particles to remove Escherichia coli from water streams. The results for this research were inconclusive for a number of reasons. First, the polymer used in this research was not active. It lacked the correct chemical structure to kill bacteria effectively. Additionally, when active polymer was received, insufficient quantities were available to produce viable coated carrier particles. Embalming fluid, formaldehyde, is commonly used to preserve the body following death. Yet, this practice may confound forensic toxicology studies because of its potential reactivity with drugs. The few studies that have been conducted have focused on the tricyclic antidepressants, nortriptyline and desipramine, demonstrating that these compounds undergo methylation to form amitriptyline and imipramine in the presence of formaldehyde. The present study was designed to investigate several classes of common forensic drugs for their reaction in the presence of formaldehyde. Research points to a combination of genetic, physiological, and environmental factors in the origin of anxiety and depressive disorders. These factors are adversely impacted by stress and can be influenced by both the prenatal and postnatal environments. Our research shows that offspring of mothers stressed during the last week of gestation appear to be normal in basal behavioral states. However, upon the presentation of stressful stimuli in the forms of anxiogenic drugs (e.g. yohimbine and idazoxan), prenatally stressed offspring respond differentially in comparison with control (normal) offspring. Doses of yohimbine and idazoxan that increased acoustic startle in control animals were …

Endemic foci of human African trypanosomiasis are present in southern Sudan. In 1996 and 1997, trypanosomiasis increased sharply in Tambura County. To define the magnitude and geographic distribution of the outbreak, we conducted a prevalence survey using population-based cluster sampling in 16 villages: 1,358 participants answered questions about routine activities and tsetse fly contact and received serologic testing. Seroprevalence in the surveyed area was 19.4% (95% confidence interval = 16.9%, 21.8%). We confirmed infection in 66% of seropositive persons who received one parasitologic examination and in 95% of those who had serial examinations of lymph node fluid and blood. Activities …

This study was designed to investigate the effects of (a) the presence of an obvious disability, (b) physical attractiveness, and (c) the sex of peers on children's attitudes towards accepting a peer. A 2 X 2 x 2 factorial design was used in which the three between-subject variables were (a) whether or not the subject had a disability, {b) whether the subject was attractive or unattractive, and (c) the sex of the respondent. The study compared the perceptions of Malaysians, representing Asian culture, and Australians, representing Western culture, for four Web design characteristics (atmospherics, news stories, signs, products and services), as part of the Integrated Internet Marketing model. Under controlled laboratory conditions, two groupings of thirty subjects evaluated eight Web sites in the retail and services sectors located equally in Malaysia and Australia. This study hypothesised that the predominant culture would not be generalised to another culture. Significant differences found for Web design characteristics were typically for one site only and not across all sites. In other words, consistent differences did not eventuate. …

It is widely accepted in the literature that internalised childhood psychopathology including anx1cty is best identified by child self-report, followed by observations by parents and then to a lesser extent, by teachers. Although anxiety scales are a useful way to quantify anxiety symptomatology and progress through treatment, changes to classification systems (e.g., DSM-111-R to DSM-IV) make their ability to screen for the presence of psychiatric problems difficult. The X-Files is a television program that first screened on Australian television in 1993. This thesis will investigate the role of The X-Files as a cultural text. The X-Files is a significant program, and has contributed to a shift in the way in which television texts represent ideas about society, knowledge and truth. Satus Creek provides critical habitat for the Yakima River Basin steelhead. A diverse community of riparian vegetation is important for healthy fish habitat; vegetation changes can affect shade, cover, channel structure, water quality, and food availability. The purpose of this thesis is to analyze and illustrate riparian vegetation change, both temporally and spatially, along three separate reaches of Satus Creek. A Geographic Information Systems approach was applied to assess the vegetation change by comparing plant species composition and density on 1949 and 1995 aerial photographs. Does Akhil Amar's The Bill of Rights: Creation and Reconstruction ("The Bill of Rights") say anything about what the law should be today? The answer is not clear. The book is a study of the original meaning of the Bill of Rights and the transformation of that meaning by the Fourteenth Amendment. Its project is archaeological rather than prescriptive. It focuses on what the Constitution meant in 1791 and in 1866, not what it means now. I start from the rather obvious proposition that in recent years the American public has placed a high value on the right of privacy. This general commitment to privacy was what kept Robert Bork, despite his qualifications, off the Supreme Court, and more recently it was what kept William Clinton, despite his behavior, in the White House. The Virginia General Assembly once again acted in a very restrained fashion in addressing juvenile justice issues in the lengthening wake after the extensive statutory changes in 1994 and 1996. The newly enacted juvenile competency statute is an important innovation contained in the new article 18 oftitle 16.1 of the Virginia Code, and a study by the Virginia Bar Association on the applicability of the insanity defense in juvenile delinquency proceedings will further address the implications of mental health problems for children in trouble.
