Food For Sport Or Faustian Bargain: Regulating Performance Enhancing Dietary Supplements, Jennifer Kay Braman Jan 1999

Food For Sport Or Faustian Bargain: Regulating Performance Enhancing Dietary Supplements, Jennifer Kay Braman

Cleveland State Law Review

The defining line between legal and illegal substance-between dietary supplement and drug is horribly skewed. Accordingly, Part I of this Note will investigate the complexities that exist with regard to the classification and regulation of dietary supplements, looking at the history leading to the passage of the governing Dietary Health and Supplement Act of 1994. Part II will focus on supplements that consumers may use for performance enhancement purposes, and the regulation of sports products. Part III will look at the regulatory debate over dietary supplements, the andro product example and the interrelationship between drugs and sport. Part IV will …

The Abortion Right, Originalism, And The Fourteenth Amendment, Steven Graines, Justin Wyatt Jan 1999

The Abortion Right, Originalism, And The Fourteenth Amendment, Steven Graines, Justin Wyatt

Cleveland State Law Review

In this article, the Privileges or Immunities Clause will be re-conceived in its original context, at the center of the Fourteenth Amendment. This re-conception includes the assumption that The Slaughter-House Cases" were decided incorrectly.'" The contention of the article is that abortion restrictions, as a specific originalist matter, can be considered economic legislation and that they also economically burden women, such that they unconstitutionally abridge two privileges or immunities, the Lochnerian liberties to contract and the engagement in any of the common occupations. Specifically, abortion restrictions violate "the prohibition on redistributive 'class' legislation ... that was deeply rooted in the …

Ion Transport Processes Of Crustacean Epithelial Cells, Gregory A. Ahearn, Jeff Duerr, Zhenpeng Zhuang, Richard J. Brown, Amy Aslamkhan, Deirdre A. Killebrew

Faculty Publications - Department of Biological & Molecular Science

Epithelial cells of the gut, antennal glands, integument, and gills of crustaceans regulate the movements of ions into and across these structures and thereby influence the concentrations of ions in the hemolymph. Specific transport proteins serving cations and anions are found on apical and basolateral cell membranes of epithelia in these tissues. In recent years, a considerable research effort has been directed at elucidating their physiological and molecular properties and relating these characteristics to the overall biology of the organisms. Efforts to describe ion transport in crustaceans have focused on the membrane transfer properties of Na1/H1 exchange, calcium uptake as …

Models Of Securities Regulation In The United States, Arthur B. Laby Jan 1999

Models Of Securities Regulation In The United States, Arthur B. Laby

Fordham International Law Journal

Parts I and II discuss the regulation of advisers and brokers in the United States through first a historical and then a functional prism. Part III illustrates these two approaches by looking at one particular rule regulating investment advisers — the performance fee rule — which challenges the assumptions I am making about the regulation of advisers and brokers. Part IV discusses recent regulatory initiatives at the SEC in light of these two approaches.

Profit From Pastures, Mark Callow, Martin Van Houtert Jan 1999

Profit From Pastures, Mark Callow, Martin Van Houtert

Journal of the Department of Agriculture, Western Australia, Series 4

The research program has made a major contribution to the improvement of pasture management techniques, which has, in turn, led to a gain in productivity for dairy farms in the south-west of Western Australia. Analysis has shown a 25 per cent improvement in pasture utilisation, an increase in the average number of cows milked from 155 to 192, an increase in average stocking rates from 0.9 to 1.2 cows per hectare, and increased income from milk sales by $600 per hectare. There are still areas for improvement in sustainability, productivity, and profitability, but the success to date is a credit …

Eradicating Virulent Footrot From Western Australia, R K. Mitchell Jan 1999

Eradicating Virulent Footrot From Western Australia, R K. Mitchell

Journal of the Department of Agriculture, Western Australia, Series 4

Western Australia has a unique opportunity to eradicate virulent footrot from the State's sheep flock, with only 62 properties or 0.6 per cent of sheep properties currently in quarantine. The majority of Western Australian flocks are now free of virulent footrot, with targeted on-farm and abattoir surveillance used to detect the remaining properties affected by the disease. Bob Mitchell reports on how farmers, industry, and government are working together, with research playing an important part in the eradication campaign.

Family Law And Gay And Lesbian Family Issues In The Twentieth Century, Nancy Polikoff, David Chambers Jan 1999

Family Law And Gay And Lesbian Family Issues In The Twentieth Century, Nancy Polikoff, David Chambers

Scholarly Articles in Law Reviews & Journals

Over the past thirty years, lesbians and gay men have increasingly challenged conventional definitions of marriage and the family. In this brief article, the authors tell the story of gay people and family law in the United States across this period. They divide their discussion into two sections: issues regarding the recognition of the same-sex couple relationship and issues regarding gay men and lesbians as parents. These issues overlap, of course, but since family law discussions commonly treat adult-adult issues of all sorts separately from parent-child issues, the authors believe it convenient and helpful to do so as well.

Paternity Efficiency In Turkeys Differes Extensively After Hererospermic Insemination, Ann M. Donoghue, Murray R. Bakst, Paul Drummond, Shakura Haqque, Edward J. Smith, Daniel J. Donoghue Jan 1999

Paternity Efficiency In Turkeys Differes Extensively After Hererospermic Insemination, Ann M. Donoghue, Murray R. Bakst, Paul Drummond, Shakura Haqque, Edward J. Smith, Daniel J. Donoghue

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

All commercial turkey hens in the U.S. are bred by artificial insemination (AI).  Since semen samples are pooled from 10 or more males (heterospermic inseminations), paternity of the progeny is rarely known.  Whereas it is known that sperm competition exists, the degree to which any male's sperm fertilizes ova relative to other male's remains unknown.  In this work, we determined individual male fecundity relative to that of other males in the study and attempted to establish a relationship between male fecundity and semen characteristics in turkeys.  Fingerprinting of genomic DNA from parents and offspring was used to determine parentage efficiency. …

The Relationship Between Septic Systems And Incidence Of Giardiasis And Shigellosis In Florida, Sharon Heber Jan 1999

The Relationship Between Septic Systems And Incidence Of Giardiasis And Shigellosis In Florida, Sharon Heber

All ETDs from UAB

A retrospective cohort study was conducted, to assess the relationship between onsite sewage treatment and disposal system (OSTDS) failures and giardiasis and shigellosis. Cases in close proximity to OSTDS were analyzed to ascertain any association with failed systems. It was predicted that the risk of acquiring giardiasis or shigellosis was greater than one when comparing exposure to failed versus functional OSTDS. Records of failed systems, functional systems, and disease cases were mapped using a geographical information system (GIS). Cases and households with cases around failed systems were considered exposed cases, and cases and households with cases around functional systems were …

The Effect Of Sinoaortic Denervation On Renal Wrap Hypertension, J. Mark Van Ness, Carmen Hinojosa-Laborde, Teresa Craig, Joseph R. Haywood Jan 1999

The Effect Of Sinoaortic Denervation On Renal Wrap Hypertension, J. Mark Van Ness, Carmen Hinojosa-Laborde, Teresa Craig, Joseph R. Haywood

College of the Pacific Faculty Articles

The purpose of this study was to determine whether sinoaortic deafferentation (SAD) alters the severity of hypertension or sympathoadrenal contribution to mean blood pressure (MAP) during renal wrap hypertension. Male Sprague-Dawley rats were implanted with radiotelemetry transmitters for 24-hour recording of MAP and heart rate. All rats underwent either SAD or sham SAD (Intact) surgery and were allowed to recover for 10 to 14 days. The rats were then assigned to a normotensive (Sham) group or a hypertensive (Wrap) group in which 1-kidney figure-8 renal wrap was performed. SAD increased the acute MAP response to renal wrap (Intact-Sham=5+/-1 mm Hg, …

Evaluating Bankruptcy Mediation, William J. Woodward Jr. Jan 1999

Evaluating Bankruptcy Mediation, William J. Woodward Jr.

Journal of Dispute Resolution

This Article aims to do several things. First, it will briefly describe a court sponsored mediation program developed several years ago by the court and bankruptcy bar in the Eastern District of Pennsylvania. The program depended on trained mediators who did their work on court-selected bankruptcy matters on a pro bono basis. Partly because of its "cost-free" nature, the program created a need for periodic evaluation to ensure the court and bar that it was delivering positive results without inflicting undesirable hidden costs on the participants or the local bankruptcy system as a whole.6
