The State And The Post-Cold War Refugee Regime: New Models, New Questions, Julie Mertus

Michigan Journal of International Law

The thesis of this essay is that within the refugee regime the move away from states and adherence to states are two sides of the same coin. To some degree the new refugee regime reflects the trend away from both the state and strict notions of sovereignty. Nonetheless, the new regime also exposes the staying power of the statist paradigm. In many respects, the role of states has indeed been altered, but states have retained their role as important and often essential actors. After describing Bellum Americanum at some length, the article turns to the "stressors" it presents for the current law of armed conflict. The term stressors is used to suggest that law evolves as it is stressed by changing circumstances. Much as water seeks a constant level, law inevitably moves to fill normative lacunae. Correspondingly, law loses its normative valence when it no longer serves "community"-a relative concept-ends. Thus, law is contextual and directional. It is contextual in the sense that it is understood and applied based upon the specific social, economic, political, and military milieu in which it operates. …

This Article discusses the contours of the prohibition of crimes against humanity with reference to proceedings before the International Criminal Tribunal for the Former Yugoslavia (ICTY) and deliberations at the Diplomatic Conference of Plenipotentiaries on the Establishment of an International Criminal Court (ICC). Because the contemporary status of this offense under international law cannot be understood or appreciated without reference to its history, this Article traces the evolution of the concept of crimes against humanity with particular reference to the genesis and re-interpretation of the war nexus requirement. Afrocentric Ideologies And Gendered Resistance In Daughters Of The Dust And Malcolm X: Setting, Scene, And Spectatorship, David Jones

Ethnic Studies Review

This study of scenes from the films Daughters of the Dust and Malcolm X, describes images of myth, gender, and resistance familiar to African-American interpretive communities. Key thematic and technical elements of these films are opposed to familiar Hollywood practices, indicating the directors' effort to address resisting spectators. Both filmmakers, Julie Dash and Spike Lee respectively, chose subjects with an ideological resonance in African-American collective memory: Malcolm X, eulogized by Ossie Davis as "our living black manhood"(i) and the women of the Gullah Sea Islands, a site often celebrated for its authentically African cultural survivals. The first chapter of this study of the 95th examines the long struggle through the eighteenth century to create an adequately trained and equipped corps of riflemen in the British Army, culminating in the creation of the Experimental Rifle Corps in 1800. Experiences in North America, the West Indies and Europe that bear relevance will be examined along with those individuals whose experience or works influenced the creation of the 95th. The idea that income tax rate brackets should be flattened has gained some support among neoclassical economists, right-wing think-tanks and Canadian politicians. Those propounding the idea argue that flattening the rate structure will simplify the tax system and reduce tax avoidance and evasion. They also argue that it would usher in an era of increased economic prosperity by encouraging talented Canadians to work harder, save and invest more, and remain in Canada. In defending progressive taxation, this article takes issue with each of these claims. It concludes that the fundamental differences between those who support flat taxes and those who …

Trade patterns in the Near East are the subject of conflicting interpretations. Researchers debate whether Galilean cities utilized trade routes along the Sea of Galilee and the Mediterranean or were self-sufficient, with little access to trade. An analysis of material culture found at specific sites can most efficiently determine the extent of trade in the region. If commerce is extensive, a significant assemblage of foreign goods will be found; an overwhelming majority of provincial artifacts will suggest minimal trade.

The number of skilled practitioners of computer security who are able to address the complexities of modern technology and are familiar with successful approaches to system security is very small. People want security but are faced with two difficulties. First, they do not know how to achieve it in the context of their enterprises. They may not even know of a way to translate organizational procedures into policies, much less implement a set of mechanisms to enforce those policies. This Article is an attempt to create a preliminary and tentative analysis of the technology of cloning from a Jewish law perspective.
