Responding To The Value Imperative: Learning To Create Value In The Attorney-Client Relationship, Kenneth R. Margolis Jan 1998

Responding To The Value Imperative: Learning To Create Value In The Attorney-Client Relationship, Kenneth R. Margolis

Clinical Law Review

There is widespread agreement that law schools cannot do everything necessary to prepare students for the competent practice of law. Perhaps law schools are best suited to concentrate on basic legal skills and knowledge building a foundation for the more advanced skills and knowledge that every lawyer must possess in order to represent clients effectively. Even in clinical programs, there are limits to what can be taught to novice practitioners. How to relate to clients, basic factual investigation, fundamental legal research, how to prepare a simple statement to the court, how to plan for a negotiation - let alone the …

Flexible Paradigms And Slim Course Design: Initiating A Professional Approach To Learning Advocacy Skills, Marcus Soanes

Clinical Law Review

Professional training programs in England seek to prepare students for a life-long journey of development in the world of practice. The aim is high, the students have much to learn and the tutors have a lot to teach. Many decisions have to be made about course content and the structure, form and method of the educational program. As part of the planning strategy the course designers have to ask themselves and others fundamental questions about the nature of the legal profession and the role of the lawyer in society. The answers to two such fundamental questions have influenced the way …

Adaptive Shape From Shading, Ati̇lla Gülteki̇n, Muhi̇tti̇n Gökmen Jan 1998

Adaptive Shape From Shading, Ati̇lla Gülteki̇n, Muhi̇tti̇n Gökmen

Turkish Journal of Electrical Engineering and Computer Sciences

Extracting surface orientation and surface depth from one or more images is one of the classic problems in computer vision. Shape-from-shading (SFS) deals with the recovery of 3-D shape from a single shaded image. The shape is recovered by minimizing an energy functional involving constraints such as smoothness. In this constrained problem, although the smoothness constraint helps to stabilize the minimization process, it pushes the reconstruction toward a smooth surface. In this paper, we present a new adaptive shape-from-shading method which reduces this oversmoothing by controlling the smoothness spatially over the image space. In order to improve the quality of …

A Parallel Pipelined Computer Architecture For Digital Signal Processing, Haluk Gümüşkaya, Bülent Örenci̇k Jan 1998

A Parallel Pipelined Computer Architecture For Digital Signal Processing, Haluk Gümüşkaya, Bülent Örenci̇k

Turkish Journal of Electrical Engineering and Computer Sciences

This paper presents a parallel pipelined computer architecture and its six network configurations targeted for the implementation of a wide range of digital signal processing (DSP) algorithms described by both atomic and large grain data flow graphs. The proposed architecture is considered together with programmability, yielding a system solution that combines extensive concurrency with simple programming. It is an SSIMD (Skewed Single Instruction Multiple Data) or MIMD (Multiple Instruction Multiple Data) machine depending on the algorithms implemented and the programming methodologies. The concurrency that can be exploited by the algorithms using this Parallel pipelined architecture is both temporal and spatial …

Hierarchical Interconnection Network Architecture For Real-Time Systems, Bülent Örenci̇k Jan 1998

Hierarchical Interconnection Network Architecture For Real-Time Systems, Bülent Örenci̇k

Turkish Journal of Electrical Engineering and Computer Sciences

A hierarchical network suitable for interconnection of real-time client processes in a distributed multiprocessor environment is presented in this paper. A multi-layer {\it Communication Unit} (CU) prototype is developed for this purpose. This unit offers the client processes communication services for real-time operation. These services are structured in such a way that they do not depend on the characteristics of the communication medium. The basic hardware of the CU consists of a PC compatible card connected to the VME Bus. Client processes run on target cards (Motorola MVME-162) which are attached to the same bus. Target cards together with a …

Imaging Tissue Conductivity Via Contactless Measurements: A Feasibility Study, Nevzat G. Gençer, M. Nejat Tek Jan 1998

Imaging Tissue Conductivity Via Contactless Measurements: A Feasibility Study, Nevzat G. Gençer, M. Nejat Tek

Turkish Journal of Electrical Engineering and Computer Sciences

The feasibility of a new imaging system is investigated. This system will be used to image electrical conductivity distribution of biological tissues via contactless measurements. This will be achieved by introducing currents in the conductive medium using time-varying magnetic fields and measuring the magnetic fields of the induced currents. Consequently, the imaging system consists of transmitter and receiver coils placed nearby the conductive body. In this study, the basic features of the coplanar and coaxial coils are studied. The validity of the simplifying assumptions for the governing field equations is investigated. It is found that, for operating frequency of 100 …

Human Cloning: A Choice Or An Echo, George J. Annas Jan 1998

Human Cloning: A Choice Or An Echo, George J. Annas

Faculty Scholarship

The chant is "cloning, cloning, cloning"; but the echo is "choice, choice, choice." From all the hoopla about human cloning as a human choice it would seem that cloning must be the most important scientific issue of our age. My intent in this Commentary is not to join this chorus, but to take advantage of cloning's high visibility to explore the nature of the choice it offers. What is it that makes human cloning at once so appealing to a few and so repulsive to most? The answer, I think, can be found in Roman mythology: Cloning recalls Ovid's myth …

Protecting Soldiers From Friendly Fire: The Consent Requirement For Using Investigational Drugs And Vaccines In Combat, George J. Annas Jan 1998

Protecting Soldiers From Friendly Fire: The Consent Requirement For Using Investigational Drugs And Vaccines In Combat, George J. Annas

Faculty Scholarship

In 1990, following Iraq's invasion of Kuwait, the Department of Defense (DOD) sought a waiver of the informed consent requirements of existing human experimentation regulations from the Food and Drug Administration (FDA). With this waiver, DOD could authorize military use of investigational drugs and vaccines on soldiers involved in the Gulf War without their informed consent. The basis of the waiver request was military expediency. In DOD's words: "In all peace time applications, we believe strongly in informed consent and ethical foundations... but military combat is different." DOD's rationale was that informed consent under combat conditions was "not feasible" because …

Dangerous Crossing: State Brownfields Recycling And Federal Enterprise Zoning, Michael Allan Wolf Jan 1998

Dangerous Crossing: State Brownfields Recycling And Federal Enterprise Zoning, Michael Allan Wolf

Law Faculty Publications

Urban policymakers over the past two decades have engineered a curious and potentially dangerous intersection of late 20th Century policies designed to foster the rebirth of America's distressed urban regions. First, we find widespread enthusiasm about the potential for reusing brownfields 1 (typically contaminated urban sites), which has stimulated an impressive range of initiatives at all levels of government. 2 Second, after more than a decade of sitting on the sidelines and watching the states battle over the ideal range of incentives that will most effectively drive inner-city redevelopment, the federal government finally entered the fray in the 1990s with …

Expedient Method To Determine Active Zone Depth For Expansive Soils In The St. Louis, Missouri Area, Robert Allen Abbott Jan 1998

Expedient Method To Determine Active Zone Depth For Expansive Soils In The St. Louis, Missouri Area, Robert Allen Abbott

Masters Theses

"A laboratory testing program was developed to formulate a relationship which could be used to estimate the active zone depth at a given site with the index properties of the potentially expansive soils at the site. The testing program utilized standard consolidometers to incrementally add moisture to soil specimens to determine a swell versus soil suction index. Tests were performed on laboratory manufactured soil specimens of commercial clay to validate the testing methodology.

A QUATTRO PRO computer spreadsheet was developed to perform the calculations to determine the potential field surface heave for the soils tested provided they were at a …

In Part I of the Article, I analyze the relevant provisions of the SPS Agreement. In that context, I examine the distinction between risk assessment and risk management, as well as the concepts of scientific uncertainty and science policy. Part II sets forth my proposal for how the WTO should review the sanitary measures established by members. The focus of attention is the fact-finding process in dispute settlement proceedings and, in particular, the substantive issues that should come before a panel, the evidence that a panel should consider, and the proper standard and burdens of proof. Finally, in Part III, …

Diphtheria Toxin Fusion Proteins, Frank Foss, Mansoor Saleh, James Krueger, John Nichols, John Murphy

Haematology and Oncology, East Africa

Two different approaches have been undertaken to develop targeted biomolecules for therapeutics. The first was the construction of immunotoxins consisting of monoclonal antibodies chemically linked through a disulfide bond to a plant or bacterial toxin or radionuclide. Instability of the chemical conjugation of some of the earlier immunotoxins led to the concept of using protein engineering and recombinant DNA to assemble fusion genes combining the sequences for the enzymatically active and translocation domains of a toxin with those of a specific targeting ligand. From the outset, the prospect of using recombinant DNA methods to assemble the structural genes encoding bacterial …

Nineteenth-Century American Housekeeping Books : Women's Workplace Manuals Historical Research In Technical Writing, Melanie C. Woods

Retrospective Theses and Dissertations

This thesis analyzes three American housekeeping books—Lydia Maria Child's The American Frugal Housewife, Catherine Beecher and Harriet Beecher Stowe's The American Woman's Home, and Helen Campbell Stuart's The Easiest Way in Housekeeping and Cooking—as historical examples of technical writing. The study follows current recommendations for historical research in the field, namely, to analyze technical writing texts in consideration of their historical context. This involves determining what constituted technical writing in the nineteenth century; considering the publishing context of the study; and applying this definition to analyze three housekeeping books as technical manuals. These texts exemplify technical writing …

Castles In The Sand: Balancing Public Custom And Private Ownership Interests On Oregon’S Beaches, Steven W. Bender Jan 1998

Castles In The Sand: Balancing Public Custom And Private Ownership Interests On Oregon’S Beaches, Steven W. Bender

Faculty Articles

Although much has been written about Oregon's unique legacy of public privilege to use private beaches, scholarship has tended to focus on articulation as well as spirited critique of the custom doctrine. More recently, commentators have addressed the question of whether the public's beach rights can withstand scrutiny under the constitutional takings doctrine. In contrast, this article assumes that the custom doctrine is sufficiently embedded in Oregon's history and case law as precedent to withstand reconsideration of the doctrine and to constitute a background principle of state law for purposes of the takings doctrine. With these assumptions, the article examines …

The Continuing Relevance Of Section 8(A)(2) To The Contemporary Workplace, Michael C. Harper

Michigan Law Review

After embarking on his illustrious career as a legal academic, Theodore St. Antoine, through a multitude of roles, including those of scholar, teacher, administrator, pragmatic law reformer, and arbitrator, made innumerable contributions to the practice and development of many parts of American law. For most of us, however, as a scholar he will be associated primarily with the system of collective bargaining established and encouraged by the National Labor Relations Act (NLRA) and its progeny. During the first part of Professor St. Antoine's years as an academic, this system continued to flourish in America, as he, along with other legal …
