Corporate directors have a fiduciary duty to make decisions in the best interests of the shareholders. This aspect of fiduciary duty is often called the shareholder primacy norm. Legal scholars generally assume that the shareholder primacy norm is a major factor considered by boards of directors of publicly traded corporations in making ordinary business decisions and that changing the shareholder primacy norm would have an effect on the substance of those decisions. This Article challenges this view and argues that the shareholder primacy norm was never equipped to mediate conflicts between shareholders and nonshareholder constituencies of a corporation. Professors Dukeminier and Krier's property casebook is reputed to be the market leader in Property casebooks; I have heard estimates that it has as much as a fifty percent market share. This position is well-deserved-the casebook is thorough, comprehensive, well-written, error free, and, a significant feature for new teachers, has the best teacher's manual I have encountered for any casebook in any subject. IBM once sold computers because "No one ever got fired for choosing IBM." An analogous claim can be made for this casebook-no one ever provoked significant faculty or student unrest by choosing Dukeminier and Krier.

Absorption Efficiencies And Biochemical Fractionation Of Assimilated Compounds In The Cold Water Appendicularian Oikopleura Vanhoeffeni, Alexander B. Bochdansky, Don Deibel, Richard B. Rivkin

Using Ge-68:C-14 dual-labeling, we investigated the absorption efficiency of diatom carbon for the cold water appendicularian Oikopleura vanhoeffeni. The absorption efficiency of bulk carbon (mean = 67%) was not influenced by body size or ingestion rate. For the first time for a pelagic tunicate, food and feces were fractionated into their major biochemical constituents (i.e., low-molecular-weight compounds, lipid, protein, and polysaccharide), allowing calculation of absorption efficiencies for each fraction. Low-molecular-weight compounds and proteins were preferentially absorbed over lipids and polysaccharides. However, predicted C:N ratios of the fecal pellets of O. vanhoeffeni were in the lower range of C:N ratios …

Are Ends Subject To Deliberation In Aristotle's Nicomachean Ethics? A Reply To David Wiggins, Anthony Crifasi

We focus upon the difficulties involved in Wiggin's interpretation of deliberation, since these form the basis for his later analyses. Wiggins grounds his thesis that ends are subject to deliberation upon the view that the various virtues are constituents of happiness. As constituents of the ultimate end itself, they would not be ordered to any higher end. Consequently, the virtues would be incommensurable with one another, since conflicts between virtues would not be resolvable in terms of any common end. Are Ends Subject To Deliberation In Aristotle's Nicomachean Ethics? A Reply To David Wiggins, Anthony Crifasi

Conflicts between virtues would not result in the radical incommensurability described by Wiggins (having no common end at all). Such a highest end would by no means be a “universal rule” in the sense criticized by Wiggins in his reply to Allan, since particular circumstances could, as always, affect or prevent altogether the manner and means by which the end would be actualized. The “situational appreciation” of practical wisdom would therefore still play a vital role in the practical actualization of any virtue. Much contemporary philosophy o f language has shown considerable interest in the relation between our linguistic practice and our metaphysical commitments, and this interest has begun to influence work in the history of philosophy as well. In his Categories and De interpretatione, Aristotle presents an analysis of language that can be read as intended to illustrate an isomorphism between the ontology of the real world and how we talk about that world. Survey Of The Labor Market For New Ph.D. Hires In Economics 1999-2000, William P. Curington, Craig T. Schulman

Labor Market Survey

This year, the survey questionnaire was sent to 362 organizations. Questionnaires were returned by 190 (52.5 percent) for a response rate that was slightly higher than the 1998-99 survey response rate of 51.7 percent. Of this year's responses, 139 (73.2 percent) were from those who responded to last year's survey; 51 (26.8 percent) came from new respondents. Among the academic institutions responding, the highest degree offered was: Ph.D.- 46.3 percent; Master - 17.9 percent; Bachelor - 28.9 percent. The remaining 5.3 percent did not indicate their highest degree offered. Two of the responders were non-academic organizations. The responses are reported …

Fundamental And Magnetic-Hardening Studies Of Nanocrystalline And Naaocomposite Magnets, David J. Sellmyer, George C. Hadjipanayis

David Sellmyer Publications

In this project we study new nanocrystalline and nanocomposite structures that have high potential for permanent-magnet development. These materials, which can be synthesized to have either very high or intermediate coercivities, have many applications in electric power, transportation, and information-storage industries. There is great interest in further development of understanding and application of these materials. Following are brief discussions of recent research highlights for the present grant.
