Brady Statute Data: Persons Who Are Subject To A Court Order Restraining Them From Threatening Or Committing Acts Of Domestic Violence Or Abuse, Cassie Atwell, Allan R. Barnes, Lawrence C. Trostle

AJSAC reports

Currently, Alaska law enforcement agencies do not obtain data on four noncriminal categories prohibited by the Brady Handgun Violence Prevention Act of 1993 from obtaining firearms. This, the second of four reports on these categories, describes how persons subject to a domestic violence restraining order can be identified within an Alaska context and discusses possible procedures, problems, and solutions associated with data collection. The state is rapidly moving to the point where all individuals who meet the Brady definition for this category will be identified, the information housed in a separate database, and reported to federal agencies. The First Step Forward—The Aids Dismissal Case And The Protection Against Aids-Based Employment Discrimination In Japan, Marc Lim Mar 1998

The First Step Forward—The Aids Dismissal Case And The Protection Against Aids-Based Employment Discrimination In Japan, Marc Lim

Washington International Law Journal

The fight against AIDS in Japan, a journey that has encountered much resistance from a Japanese public and corporate sector ill-educated on the disease, may have taken a new turn. Before 1995, employees infected with HIV or suffering from AIDS had little recourse in fighting against the discrimination they faced in their private lives and in the Japanese corporate sector. With the AIDS Dismissal Case, the Japanese judiciary, in a show of judicial activism, found the dismissal of an HIV-infected worker based upon his HIV status illegal and an infringement upon the worker's human rights. In addition, the court found …

Fashioning An Interdisciplinary Framework For Court Reform In Family Law: A Blueprint To Construct A Unified Family Court, Barbara A. Babb

All Faculty Scholarship

Family law cases focus on some of the most intimate, emotional, and all-encompassing aspects of parties' personal lives. Based on its study of unmet legal needs of children and their families, the American Bar Association has recommended the establishment of unified family courts in all jurisdictions. This article evaluates how America's courts adjudicate family law matters and advocates systemic change by offering an interdisciplinary ecological and therapeutic approach to the creation of unified family courts. The author presents a comprehensive overview of the results of her nationwide survey determining how each state's courts handle family law matters. The results of …

Alaska Justice Forum ; Vol. 15, No. 1 (Spring 1998), King N/A, N. E. Schafer

Vols 11-20 (1994-2004)

In the Spring 1998 issue of the Alaska Justice Forum, an assistant public defender who served from 1991 to 1994 in three jurisdictions in rural Alaska — Ketchikan, Kodiak, and Kotzebue — focuses on the situation of rural Alaska Natives to describe how several structural aspects of the criminal justice may contribute to the overrepresentation of Alaska Natives in the Alaska prison system. The second phase of a Justice Center study of racial disproportionality in juvenile referrals in Alaska looks at 33 youth who had five or more referrals, examining individual criminal histories and family backgrounds as revealed in the …

The History Of The Independent Counsel Provisions: How The Past Informs The Current Debate, Katy J. Harriger Mar 1998

The History Of The Independent Counsel Provisions: How The Past Informs The Current Debate, Katy J. Harriger

Mercer Law Review

The current "feeding frenzy" around the campaign finance scandal invites us to reflect upon the importance of the past. The independent counsel provisions of the Ethics in Government Act are the product of a particular time and sequence of events that determined their shape and continue to influence their implementation. If we want to understand the current controversy surrounding Attorney General Janet Reno's interpretation of the independent counsel provisions, we must look back at the legislative history of those provisions and the larger history of the time.

When we look back, we can see that the issues at the center …
