Qualified Immunity: Ignorance Excused, Barbara E. Armacost Apr 1998

Qualified Immunity: Ignorance Excused, Barbara E. Armacost

Vanderbilt Law Review

Public officials receive qualified immunity from damages liability for constitutional violations if they reasonably could have believed their actions were constitutional under clearly established law. In this regard qualified immunity is quite unusual. In most other legal contexts, failure to know the law is virtually never excused. The only other context where notice or knowledge of illegality plays any role is in criminal law, but even mistakes of penal law are rarely excused.

In this Article, Professor Armacost uses fair notice in criminal law as a paradigm for analyzing the role of notice in constitutional damages actions. She argues that …

Mechanomorphosis: Science, Management, And “Human Machinery” In Industrial Canada, 1900–45, Cynthia Comacchio Apr 1998

Mechanomorphosis: Science, Management, And “Human Machinery” In Industrial Canada, 1900–45, Cynthia Comacchio

History Faculty Publications

By the early 20th century, the changes taking place in western industrial capitalist nations prompted an adaptive shift in the socioeconomic delineation of human bodies, and in scientific theories about how they worked and how they could be put to work. Just as the rising social sciences borrowed from medicine to convey images of social malaise, medicine increasingly appropriated an industrial vocabulary to conceptualize bodily health. Depicted variously as a machine, a motor, a factory in itself, the human body absorbed industrial symbolism. Modern industry demanded an intensification of labour that made bodily efficiency paramount. The corresponding definition of health …

On Uneven Ground: Tracing A Slave Route From Salaga To Cape Coast, Laura Tanz Apr 1998

On Uneven Ground: Tracing A Slave Route From Salaga To Cape Coast, Laura Tanz

African Diaspora ISPs

The project I have completed consist of two elements. First of all, I traced a slave route from Salaga to Cape Coast. While following this route, I stopped in town's which were historically slave markets in an effort to interview members of the community about the current effects of the slavery. Secondly, I attempted to walk from Atebubu to Cape Coast in order to have a concrete comprehension for the distance covered by those who were forced to walk the distance before me, in addition to having a better understanding of Ghana.

Gaining The Appropriate Technology State-Of-Mind, Colette Mininger

African Diaspora ISPs

The bulk of my Independent Study Project was to study and work with the Appropriate Technology project in Cape Coast, Ghana, under the direction of Dr. Kofi Sam. Through this program I learn how to construct an "Approtech", house, meaning that the majority of the material form which it is made comes from Ghana and usually the immediate vicinity of the structure. During the course of related to the project, as well as Ghana, in general. From these combines and inseparable experiences, I began to understand the mode of thinking that is the basis of Appropriate Technology. Through researching for …

A Comparison Of Two Omaha Radio Talk Shows: Local Vs. National Issues, Jodeane F. Brownlee, Michael L. Hilt

Communication Faculty Publications

It's 9:06 a.m. in Omaha, Nebraska. A stout, forty-year-old male with sandy blond air sips a cup of coffee. The "on air" microphone turns red signaling the start of a new morning on talk radio. "Good morning you're on news/talk 1110 KFAB." Tom Becka, a three-year veteran of talk radio speaks quickly and loudly. Becka describes his show and re audience as the gang in the kitchen. "By that I mean, if you're at a party the best part of the party is the gang in the kitchen," says Becka. "They're arguing, they're fighting, they're laughing, they're discussing, they're disagreeing. …

Why Are We Here? What Are We Doing? Interdisciplinary Social Studies For The 21st Century, Ann L. Rappaport Apr 1998

Why Are We Here? What Are We Doing? Interdisciplinary Social Studies For The 21st Century, Ann L. Rappaport

School K-12

It's the interdisciplinary potential that drew many of us into social studies from the start, isn't it? Because the human condition is, in fact, interdisciplinary. We're attracted by the study of real people and their challenges. We're magnetized by the processes people use to find solutions to a variety of societal problems. It's appealing to learn how people organize to accomplish certain goals. We thrive on diversity, on relationships, on cultural artifacts, on connections. We love the drama of discovery.

Assessing Child Care Need In Niles, Michigan, Lori L. Mcneil Apr 1998

Assessing Child Care Need In Niles, Michigan, Lori L. Mcneil

Masters Theses

Many parents struggle to secure adequate child care while they work and/or attend school. With the passage of welfare reform legislation, which in part requires AFDC parents to enter/reenter the workforce, locating child care options will likely become increasingly more difficult.

This study describes child care needs of one community based on a survey of parents at thirteen different sites. The research measured the discrepancy between existing child care resources and child care demand within the community.

Analysis of the data revealed that the ways in which parents provide care for their children differed considerably in Niles from the most …

Prostitution In U.S. Society: Moving Beyond Traditional Feminist Frameworks Of Analysis, Megan M. Coats Apr 1998

Prostitution In U.S. Society: Moving Beyond Traditional Feminist Frameworks Of Analysis, Megan M. Coats

Masters Theses

In this thesis, I explore the different ways that prostitute women's voices have been silenced by groups which have historically controlled the social and academic discourse on prostitution. Utilizing the research method of standpoint epistemology, I first discuss why the prostitute activist's voices must be considered as the central source for scientists theorizing on prostitution. Next, I give an account of some historical influences which have shaped the discourse on prostitution, affecting the development of legislation regulating prostitution. Then, I provide a history of the development of the liberal and radical feminist discourse on prostitution. I also include some contemporary …

The Social Diffusion Of Safe Sex Behaviors In College Women, Sherry Pagoto Apr 1998

The Social Diffusion Of Safe Sex Behaviors In College Women, Sherry Pagoto

Masters Theses

With the ever rising numbers of people becoming infected with the human immunodeficiency virus (HIV) as reported by the Centers for Disease Control (CDC, 1997) the need for preventing the spread of infection is clear. One promising intervention, based on a theory called social diffusion, involves training popular opinion leaders to act as behavior change endorsers within their community (Kelly, 1991). This study found 25-30% reductions in high-risk behaviors and 16-18% increases in safe sex behaviors in a male homosexual population as a result of this type of intervention. The current study examines the effectiveness of this intervention within a …

A Sense Of Entitlement To Self In Relationships: An Elaboration Of Attachment And Feminist Object Relations Theories, Suzanne Elaine Wolfe Apr 1998

A Sense Of Entitlement To Self In Relationships: An Elaboration Of Attachment And Feminist Object Relations Theories, Suzanne Elaine Wolfe

Dissertations

Many women who present for psychotherapy with symptoms of depression and/or anxiety describe a common pattern of involvement in current and past nonmutual relationships. This phenomenon is described and explored in light of a new conception of entitlement. It is proposed that one’s sense of entitlement is a relative relational position along a continuum from overentitlement through healthy entitlement to underentitlement, and that these women are often underentitled in their adult relationships. Their relationships are often with overentitled others, and they may hold internal convictions that their place in relationships is to be underentitled. A particular pattern contributing to underentitlement …

Neighborhood Friendship Networks And Fear Of Crime, Mandy Palmiter Apr 1998

Neighborhood Friendship Networks And Fear Of Crime, Mandy Palmiter

Mahurin Honors College Capstone Experience/Thesis Projects

This research project addresses the relationship between fear of crime and neighborhood friendship networks, and provides an examination of fear of crime models. The data used were collected using both questionnaires and interviews in a 1988 survey of residents of Nashville, Tennessee. Crosstabulation tables and correlation analyses are presented with results showing a significant relationship between some measures of neighborhood friendship networks and fear of crime. Results also indicate that relationships exist between environmental conditions, previous victimization, personal characteristics, and fear of crime. The possible reasons for these relationships are discussed.

African-American Females And The Glass Ceiling In The Defense Logistics Agency, Velma Lee Clay Apr 1998

African-American Females And The Glass Ceiling In The Defense Logistics Agency, Velma Lee Clay

Dissertations

This study explores the career advancement experiences of African American women who have successfully broken through the glass ceiling. The term “glass ceiling” refers to artificial or invisible barriers based on attitudinal or organizational bias that prevent qualified women and minorities from advancing into senior-level management positions. Studies have confirmed that a glass ceiling does exist for African American women and that they are severely underrepresented in top level government jobs, they have less opportunity for advancement, and both gender and race are perceived as factors in their limited representation (MSPB 1992).

What is the Impact of Breaking the Glass …
