Mercer Law Review

One of the congratulatory letters that I received upon being selected as Mercer's dean back in 1995 was from a friend who stated that, while he was not generally familiar with the Walter F. George School of Law, he knew that Mercer had an outstanding law school because of the conflicts of law symposium published by the Mercer Law Review in 1983 and 1984. A few years later, I was informed that, at the initial meeting of the American Bar Association Commission on Separation of Powers and Judicial Independence, an ABA staff member distributed copies of the Mercer Law Review's …

Local Government Law, R. Perry Sentell Jr. Dec 1998

Local Government Law, R. Perry Sentell Jr.

Mercer Law Review

Plaintiff filed an action against the county for the repeated flooding of his home. The county attorney responded with a deft procedural maneuver:

It was my bright idea to take the plaintiff's deposition at his home. My timing was impeccable. During the deposition .... something on the order of a ten-year storm [occurred], an event which flooded [plaintiff's] property just as [he] had claimed. During our "adjournment" of the deposition, ... I [was] captured on video [by plaintiff's attorney] wading through plaintiff's front yard with my pants legs somewhere in the vicinity of my knees!

The "law" of local government, …

Chapter Extract:

The law of treaties often conjures up images of states as rotund gentlemen with whiskers, vests, and watch-chains proclaiming solemn and chivalric oaths upon their honour. Treaties are sacred in the same way that a man's word is his bond. This type of relationship among states is largely unquestioned since much of the way we live in the world depends upon the assumption of the inviolability of sovereign states and their treaties. Any challenge to these assumptions would surely evoke horror at the unmentionable void that would result-except in lawyers who make their livings shaving nuances. However, in …

Preference For Top Managerial Positions As A Result Of Utility-Maximization Behavior Under Religious Moral Prescriptions, Corneliu Munteanu Dec 1998

Preference For Top Managerial Positions As A Result Of Utility-Maximization Behavior Under Religious Moral Prescriptions, Corneliu Munteanu

Student Work

The analysis described in this study is focused on the influence of religious ethics over individuals' tendency to seek top-managerial positions in their professional activity. The analysis assumes agents maximize utility. According to religious doctrines, afterlife salvation is a goal which could be accomplished only by following certain prescribed behavioural norms. While salvation can be considered as being an identical goal for most religions, the- way of pursuing it differs from one religion to another. This difference in means of attaining salvation reflects on various aspects of human behaviour. One of these aspects is the professional conduct of people engaging …

The Molecular Basis Of Cancer, Frank Gorga Dec 1998

The Molecular Basis Of Cancer, Frank Gorga

Bridgewater Review

After cardiovascular diseases, cancer is the second leading cause of death in America. Since 1990 over half a million Americans have died each year of some form of cance1; and the number and rate is still increasing. In 1970 approximately 17 percent of all deaths were attributed to cancer, while by 1995 the figure had risen to 24 percent. In her chilling book on the meaning of illness in America, Illness as Metaphor, Susan Sontag described cancer as the sickness of the American 20th century. Learning about cancer has become more than a useful chore for those who suffer from …

Thirty-two case workers from one managed care company completed the Maslach Burnout Inventory (MBI) to assess their current level of burnout. Data analysis run on all three subscales found that there was no …
