Eighth Circuit: Gender Fairness Task Force, Lyle E. Strom Jan 1998

Eighth Circuit: Gender Fairness Task Force, Lyle E. Strom

University of Richmond Law Review

In July of 1993, the Judicial Council of the Eighth Circuit adopted a resolution for the creation of a task force to study and report on the impact or effect of gender in the administration of justice in the Eighth Circuit. Chief Judge Richard Arnold appointed United States District Judge Diana Murphy of Minnesota to establish the Task Force. A task force of thirty members, consisting of circuit, district, magistrate and bankruptcy judges, employees of the courts, representatives from the offices of the United States Attorneys and Federal Public Defenders, attorneys who practice in federal court, and professors of law, …

Determining Capture Zones For Three-Dimensional, Heterogeneous, Anisotropic Aquifers By Monte Carlo Analysis, Jon Paul Jones Jan 1998

Determining Capture Zones For Three-Dimensional, Heterogeneous, Anisotropic Aquifers By Monte Carlo Analysis, Jon Paul Jones

Theses and Dissertations

Most methods of delineating capture zones for pump-and-treat remedial design and wellhead protection assume a two-dimensional, homogeneous aquifer. Aquifers, however, are three-dimensional and heterogeneous, thereby introducing uncertainty in capture zone analysis. This study used a Monte Carlo analysis of three sets of statistical parameters defining aquifer heterogeneity. Each set had a different variance for the mean natural log hydraulic conductivity, which varied among the sets by a factor of four. The ensemble means of the capture zones for each set were estimated from 10 randomly generated fields with 12 layers each which were superimposed on each other for a total …

Annual Survey Of Virginia Law: Legal Issues Involving Children, Robert E. Shepherd Jr. Jan 1998

Annual Survey Of Virginia Law: Legal Issues Involving Children, Robert E. Shepherd Jr.

University of Richmond Law Review

Compared with the intensive focus on juvenile justice issues in Virginia between 1994 and 1996, and the significant statutory changes generated by that focus, the past two years have been relatively serene, at least for juvenile law. Legislative activity about juvenile justice has been subdued, and few cases have interpreted the major legislative changes wrought during that three-year period, or their effects. The 1998 legislative session did result in the demise of the family court initially created five years earlier contingent on the provision of adequate funding for the court at some future session. The provision of funding for the …

Keeping The Wto From Becoming The "World Trans-Science Organization": Scientific Uncertainty, Science Policy, And Factfinding In The Growth Hormones Dispute, Vern R. Walker Jan 1998

Keeping The Wto From Becoming The "World Trans-Science Organization": Scientific Uncertainty, Science Policy, And Factfinding In The Growth Hormones Dispute, Vern R. Walker

Hofstra Law Faculty Scholarship

In Part I of the Article, I analyze the relevant provisions of the SPS Agreement. In that context, I examine the distinction between risk assessment and risk management, as well as the concepts of scientific uncertainty and science policy. Part II sets forth my proposal for how the WTO should review the sanitary measures established by members. The focus of attention is the fact-finding process in dispute settlement proceedings and, in particular, the substantive issues that should come before a panel, the evidence that a panel should consider, and the proper standard and burdens of proof. Finally, in Part III, …

The Policy And Politics Of Charter Making: The Story Of New York City's 1989 Charter, Frederick A.O. Schwarz Jr., Eric Lane Jan 1998

The Policy And Politics Of Charter Making: The Story Of New York City's 1989 Charter, Frederick A.O. Schwarz Jr., Eric Lane

Hofstra Law Faculty Scholarship

On November 7, 1989, the voters of the City of New York approved, by a vote of fifty-five percent to forty-five percent, the broadest and most radical changes to their Charter since 1901. These changes abolished the City's historic Board of Estimate, while preserving a borough voice in government, expanding and increasing the powers of the City Council, retooling almost all of the City's significant decision-making processes, and adding a myriad of other changes. These changes were the product of a revision process that started in mid-1987 with the first hearings of an initial Charter revision commission, and moved to …

Information Vs. Commercialization: The Internet And Unsolicited Electronic Mail, Karin Mika Jan 1998

Information Vs. Commercialization: The Internet And Unsolicited Electronic Mail, Karin Mika

Richmond Journal of Law & Technology

In November of 1996, the District Court of Eastern Pennsylvania allowed America Online to prohibit a business from using the Internet for sending bulk, unsolicited electronic mail.[1] The decision highlighted some intriguing issues related to how the Internet interacts with the current legal framework and how legal standards that have adequately encompassed most business uses for emerging technologies are not a perfect fit for issues related to the Internet. This article will focus on the current struggle to fit the Internet into some type of existing legal framework, especially with respect to Internet business uses. It will focus primarily on …

Regulatory Change In The Energy And Telecommunications Industries - Overview, Barry J. Waldman Jan 1998

Regulatory Change In The Energy And Telecommunications Industries - Overview, Barry J. Waldman

Richmond Journal of Law & Technology

Recent changes in the telecommunications industry and the emerging momentum for change in the regulation of the energy industry have provided a unique opportunity to reevaluate the regulatory models that have predominated in these fields. As these proposed changes are promulgated and begin to take effect and find practical form, crucial questions of implementation become the focus of the debate and the practice of regulatory law. Basic questions are ripe for consideration, such as: Will the regulators be State or Federal Agencies? What form should this regulatory power take? Will legislators and regulators focus on new players in the industry …

New Combinations: Changing Technologies And Infrastructures And The Business Organizations That Will Deal With Them., Alexander F. Skirpan Jr., Steven J. Rosenstock, Pat Bennett, Douglas Taylor, Alex B. Best

Richmond Journal of Law & Technology

This tale is somewhat unique. It is probably one of the few panels, or the only panel in which there is a certain level of agreement. In fact, every one in this room probably has the basic agreement with this panel, that changes in regulation and changes in policy that we are struggling with are driven by changes in technology. This panel has been put together to look at changes in technology. It has three overall goals. The first is, as you heard one of the panels this morning talk about, to talk about technology itself to try to gain …

A Brave New World Of Free Speech: Should Interactive Computer Service Providers Be Held Liable For The Information They Disseminate?, Sarah Becket Boehm

Richmond Journal of Law & Technology

Millions of people worldwide use online services to communicate via e-mail; to post and read messages on bulletin boards; to receive news, financial information and updated sports scores; and to gather information. Nearly anyone with access to the Internet can post information without having the facts verified or the content edited, so it is extremely likely that if they post defamatory material, it can find its way around the world in a matter of minutes. Due to the anonymous nature of the Internet, the author of the defamatory material may never be discovered. Assuming the author cannot be traced, the …

Remarks At Symposium On The Future Of Legal Services, Eric M. Freedman Jan 1998

Remarks At Symposium On The Future Of Legal Services, Eric M. Freedman

Hofstra Law Faculty Scholarship

I'm glad to go first on this panel, both because I need to be less clever in what I say to distinguish myself from what already has been said, and also because a couple of later speakers - who, as you will hear, have somewhat more credentials in litigation and in constitutional theory - can correct me where I go wrong. And, perhaps not coincidentally, after I say a few brief words about legal theory and the litigation outlook, my conclusion is going to be that neither of those subjects is really where the focus probably ought to be in …

Freedom Of Speech: How Does The New York Constitution Compare To The United States Constitution, Eileen R. Kaufman, Leon Friedman Jan 1998

Freedom Of Speech: How Does The New York Constitution Compare To The United States Constitution, Eileen R. Kaufman, Leon Friedman

Hofstra Law Faculty Scholarship

One of the most interesting, and certainly most litigated, defamation questions in New York State is when constitutional protection should be afforded speech that arguably would be regarded as opinion. In resolving that question, the New York Court of Appeals has decided that the New York State Constitution affords greater protection for speech than does the federal constitution. While the New York standard seems to be far more generous in protecting speech than the federal standard, it may be that in the vast majority of cases, the outcomes would be the same under either state or federal analysis. The two …

Physician Assisted Suicide, Leon Friedman Jan 1998

Physician Assisted Suicide, Leon Friedman

Hofstra Law Faculty Scholarship

As we all know and will recall, the Supreme Court decided to hear two cases precisely dealing with a narrow issue, namely, doctor assisted suicides. Ironically, the two cases are what law professors dream about encountering in practice, because one case involves substantive due process, the case out of Washington, and the other case raises the issue of equal protection. In any event, what you have to do, and as the court did for us here, is go through very detailed descriptions of these two different doctrines. However, it is not easy to distinguish between substantive due process and equal protection. …

Voting Rights, Eric Lane Jan 1998

Voting Rights, Eric Lane

Hofstra Law Faculty Scholarship

I would like start by trying to define the term "federalism." What is federalism? There are a number of definitions. The "federalists" were the ones that were supporting the new government, and the so-called "anti-federalists" were the ones opposing it. In truth, the anti-federalists were more federalistic than the federalists were. The anti-federalists feared the central power of the government, and the federalists were pushing for some level of support I like to use federalism to define the allocation of power in our scheme of government between states, localities and the federal government, and not as an identification for a …
