The Alleged Distinction Between Euthanasia And The Withdrawal Of Life-Sustaining Treatment: Conceptually Incoherent And Impossible To Maintain, David Orentlicher

Scholarly Works

Richard Epstein, in his book Mortal Peril, supports euthanasia and assisted suicide and rejects the distinction between them and withdrawal of treatment. In this essay, Professor Orentlicher argues that Epstein is correct in finding no meaningful moral distinction between euthanasia and treatment withdrawal, examines the reasons why the distinction has persisted in American jurisprudence, and explains why the distinction has eroded.

Epstein also concludes in his book that there is no constitutional right to euthanasia or assisted suicide. Professor Orentlicher's response is that constitutionality is not the appropriate inquiry; rather, the better question is whether to recognize a right to …

The Relationship Of Physical Activity To Self-Concept And Perceived Stress In Adolescent Females, Anne C. Dineen

Open Access Dissertations

Three major hypotheses regarding physical activity, stress and self-concept in adolescent females were tested using 214 high school students as subjects. These hypotheses generated four predictions: 1) Females who are more physically active will report that experienced stressful events are less upsetting than will females participating in less activity; 2) Females who are more physically active will have higher physical ability self-concept scores than those females who are less physically active; and 3) Certain factors such as age and physical ability self-concept are more likely to result in girls' participation in physical activity; 4) Certain factors such as age and …

Examining The Association Between Personal And Cultural Values And Cross-National Customer Satisfaction, Adel A. Al-Weqaiyan Jan 1998

Examining The Association Between Personal And Cultural Values And Cross-National Customer Satisfaction, Adel A. Al-Weqaiyan

Open Access Dissertations

Although most marketing scholars agree that customer satisfaction is a critical determinant of post purchase attitude and product choice, research has remained largely confined to the US and few Western European countries. Given the increasing size of markets in developing countries, and that customer satisfaction is at the heart of all marketing activities, international marketers should have a deeper understanding of the determinants of satisfaction responses of the international customer.

A review of present satisfaction literature reveals the domination of the expectation-disconfirmation paradigm. Proponents of this paradigm suggest that satisfaction following a product experience depends on the magnitude and direction …

Teach In Context: Responding To Diverse Student Voices Helps All Students Learn, Paula Lustbader Jan 1998

Teach In Context: Responding To Diverse Student Voices Helps All Students Learn, Paula Lustbader

Faculty Articles

This article uses quotes from interviews with diverse students as a spring board to discuss contextualized learning theory and teaching strategies to enhance student learning. Students must relate new information to their own experience; develop ideas about the new information; and articulate their understanding of it. In other words, to fully understand something, students must be able to relate to it, own it, and translate it. To help students do this, the article discusses and provides examples of three concrete teaching strategies: experiential learning exercises, writing exercises, and collaborative exercises.

Lawyer Discrimination Against Clients: Outright Rejection--No; Limitations On Issues And Arguments-Yes, Sam Stonefield Jan 1998

Lawyer Discrimination Against Clients: Outright Rejection--No; Limitations On Issues And Arguments-Yes, Sam Stonefield

Faculty Scholarship

The issue of lawyer discrimination brings new perspectives to traditional topics like the practice of law, the role of the lawyer and the relationship with, and rights of, the client. It forces us to examine the nature of lawyer discretion, the limits of that discretion and the consequences of trying to regulate that discretion. The examinationis a daunting task. This essay offers an approach that attempts to protect both the prohibition against discrimination and the practice of law and to accommodate the tension that necessarily accompanies this effort. It suggests that the best solution is to prohibit lawyers from discriminating …

Toward A Contractarian Account Of Family Governance, Marsha Garrison Jan 1998

Toward A Contractarian Account Of Family Governance, Marsha Garrison

Utah Law Review

Families have governments; family governments are characterized by a significant level of state involvement; state prescriptions for family governance are embodied in family law, which lays out a kind of "constitution" describing the powers of family authorities and a "Bill of Rights" for family members. An awareness of this underlying governance scheme is useful because it can illuminate linkages between seemingly disparate areas of law; it can also provide a basis for evaluating specific legislative enactments and judicial pronouncements. But given the rapidity with which family law has moved toward an egalitarian, democratic model of family governance, the model embedded …

Susanna And The Elders: A Note On The Regulation Of Families, Carol Weisbrod Jan 1998

Susanna And The Elders: A Note On The Regulation Of Families, Carol Weisbrod

Utah Law Review

The title of Robert Dahl's book, Who Governs, seems to capture the approach of many conversations on family governance. In an approach which parallels our dominant political theory, we focus on the question who, as an individual, governs, and ask how that power to govern can be better shared with others. Often the goal is equality in the family, at least as between adults, and when we consider this, we use a model of democratic political decision making. The focus is on individuals in a nuclear family. The approach is not new. It is the stance that John Stuart Mill …

What Do Young Children Know About Numerosity? : Implications For Teachers, Keely J. Beam Jan 1998

What Do Young Children Know About Numerosity? : Implications For Teachers, Keely J. Beam

Graduate Research Papers

"Numerosity" is the ability to count a set of objects using the correct number names in the proper order. Fuson and Hall (1983) assert that the use of cardinal words is one measure of the development of number knowledge. Using words in a cardinal context indicates that children are beginning to understand the "manyiness" of objects. The use of cardinal words is one of the best indicators that a child is beginning to understand counting and the underlying principles involved.

Numerosity is a concept which children often, but not always, demonstrate with overt behaviors. Understanding cardinality and numerical order, develops …

Success At Last : One Teacher's Growth In Understanding Of Writer's Workshop, Cindy L. Davis Jan 1998

Success At Last : One Teacher's Growth In Understanding Of Writer's Workshop, Cindy L. Davis

Graduate Research Papers

Writer's workshop is an approach to teaching writing that corresponds to the whole language philosophy. Much of the literature published on the topic of whole language, and specifically writer's workshop, describes the ideal classroom environment. However, "whole language in the intermediate classroom is often given less attention in professional books and journals than the primary classroom receives" (Gannon-Smith, 1991). As a reading and language arts teacher of sixth grade students, I have been interested in teaching writing through the use of writer's workshop. There are some general whole language themes which can be used to build a motivating writing environment …

Self-Monitoring With Preschoolers, Nicole Fay Kimball

Graduate Research Papers

This research paper is a review of the literature on self-monitoring as an intervention for the preschool population. Self-monitoring is defined, and its elements are described. The theoretical background of self-monitoring is provided. The development of preschoolers is discussed in the context of self-monitoring, and behaviors that may be appropriately self-monitored by preschoolers are considered. Studies of self-monitoring with these children are reviewed. Issues needing further study are presented, and recommendations concerning the need for additional research are made.

Calculators In Middle School Mathematics Classrooms, Debra Lynn Kuehne Jan 1998

Calculators In Middle School Mathematics Classrooms, Debra Lynn Kuehne

Graduate Research Papers

Calculators can be a catalyst for all mathematical learning. Arithmetic skills are necessary life tools. Doing mental math requires basic facts mastery with estimation skills. Using a calculator successfully and evaluating the answer requires an understanding of the necessary arithmetic processes and the ability to identify a reasonable solution.

Like all technology available in the K-12 school setting, calculators should be viewed as tools to facilitate learning and logical reasoning. Students need to be prepared for the jobs of the future, many of which occupations have not yet even been created. The motivation for learning any skill in life is …

The Benefits Of Using "Community" In The Elementary Classroom, Rodney Edgerton Lyons Jan 1998

The Benefits Of Using "Community" In The Elementary Classroom, Rodney Edgerton Lyons

Graduate Research Papers

The traditional teaching approach used in most American elementary schools, where the classroom teacher makes all the decisions and the conventional student is instructed to focus individual energies on assigned seatwork and ignore those who are around him or her, has become an ineffective model.

Researchers and certain educators believe that the use of "community" in the classroom will create environments where children care about one another and about learning, where students work harder, achieve more, where warm, supportive relationships are given birth -- enabling students to risk the new ideas and mistakes so critical to intellectual growth. As a …

The Concept Of Self-Directed Learning In Adult Education, Ruth Mwangangi Jan 1998

The Concept Of Self-Directed Learning In Adult Education, Ruth Mwangangi

Graduate Research Papers

The concept of self-directed learning in adult education is still not fully understood. As most scholars do not agree with the theory of andragogy, there is more confusion. However the concept of self-directed learning in adult education in the United States "contains an amazingly rich body of ideas, folk knowledge, bona fide theory and impeccable history" (Courtney, 1992, p. 158). The real question is to understand how self-directed learning motivates the adult learner to perform the various roles as demanded in the society.

The Writing Portfolio : An Authentic Assessment Tool, Sondra L. Nelson Jan 1998

The Writing Portfolio : An Authentic Assessment Tool, Sondra L. Nelson

Graduate Research Papers

Using writing portfolios as an ongoing assessment technique in the second grade classroom was a rewarding experience for my students and me. Our collaboration through conferences provided many connections between instruction and assessment. The students even though they represented a range of abilities were able to assess their own work and grow from their own reflections. Their writing abilities emerged and were captured in their portfolios. Authentic assessments were displayed with pride as each of the students shared their portfolios with their parents.

Adolescent Depression : A Review Of Theoretical Perspectives And Considerations For Assessment, Elizabeth Marie O'Neill Jan 1998

Depression is one of the most common psychological disorders shared by adolescents and adults. Thus, adolescent depression is an important area of investigation for researchers, parents, clinicians, and teachers. The purposes of this literature review are to (1) provide a critical overview of the major depressive disorder criteria for children and adolescents in the current Diagnostic and Statistical Manual of Mental Disorders, fourth edition, (DSM-IV; American Psychiatric Association, 1994), (2) provide an overview of well-articulated major theories that have attempted to explain the cause(s) of depression in adolescents, and (3) evaluate the psychometric adequacy of those self-report measures of adolescent …

Bringing Schools Closer Through Distance Learning, Shawna Paskert Jan 1998

Bringing Schools Closer Through Distance Learning, Shawna Paskert

Graduate Research Papers

Distance education takes place when a teacher and student are separated by physical distance, and technology is used to bridge the instructional gap. It is definitely a plus in a world that is constantly changing. For those who have lifestyles different than the average traditional student, distance education is the way to go. It is the more time-efficient way to handle a post-secondary education. Currently, and in the future, more students in secondary and elementary schools will be using the distance education settings than using the traditional classroom.
