Constructing A Jury That Is Both Impartial And Representative: Utilizing Cumulative Voting In Jury Selection, Edward S. Adams, Christian J. Lane Jan 1998

Constructing A Jury That Is Both Impartial And Representative: Utilizing Cumulative Voting In Jury Selection, Edward S. Adams, Christian J. Lane

Articles

One of the main and ongoing problems plaguing the American jury system has been ensuring that juries in civil and criminal trials are truly representative of the communities in which they serve. Historically, minorities have been disproportionately excluded from jury service. This shortfall results from a combination of factors at each stage of the juror identification process. At the jury pool stage, juror notification methods often fail to identify or reach minorities for tie simple reason that minorities generally are poorer and more transient. At the venire stage, those minorities who actually receive notification report to the courthouse at a …

A Strategic Approach To The Transportation Planning Process, Edward A. Mierzejewski Jan 1998

A Strategic Approach To The Transportation Planning Process, Edward A. Mierzejewski

Journal of Public Transportation

The underlying premise of the urban transportation planning process is that we can forecast the future. The process typically develops 20-year forecasts of traffic volumes on each link of the transportation network. Planners then attempt to devise a master plan that represents an optimal solution for the forecasted conditions. The reality is that we cannot predict the future. Imponderable and unpredictable events will shape the future in ways we cannot hope to anticipate. In addition, social and political bias is a strong contributor to errors in anticipating future events and to our willingness to deal with uncertainty. This paper identifies …

Perceived Service Quality Attributes In Public Transport: Inferences From Complaints And Negative Critical Incidents, Margareta Friman, Bo Edvardsson, Tommy Garling Jan 1998

Perceived Service Quality Attributes In Public Transport: Inferences From Complaints And Negative Critical Incidents, Margareta Friman, Bo Edvardsson, Tommy Garling

Journal of Public Transportation

A sample of 200 complaints filed to a public transport company and 210 negative critical incidents (NCIs) obtained from on-board interviews were analyzed with the purpose of inferring perceived service quality (PSQ) attributes of public transport. The most frequent complaints and NCIs concerned employee behavior and punctuality, followed by missing or inaccurate information and inadequate planning. In a follow-up mail survey, a representative sample of 997 respondents reported if they remembered having experienced prototypical NCIs constructed on the basis of the complaints. Confirming the validity of the inferred PSQ attributes, all NCIs were reported to have been experienced by at …

Evaluation Of The Role Of Fructosamine As An Indicator Of Diabetic Control, Katherine Hooley Jan 1998

Evaluation Of The Role Of Fructosamine As An Indicator Of Diabetic Control, Katherine Hooley

Theses

Diabetes mellitus, a common metabolic disease, is characterised by excess circulating glucose concentrations. Such a hyperglycaemic status provides the stimulus for irreversible glycation (non-enzymatically post-translational) of structural and functional proteins. Protein glycation, although a cause of complication (neuropathy, micro/macrovascular disease), provides a time-averaged index of diabetes status and control. In particular, glycated plasma proteins analysis, i.e., the fructosamine assay, has received favourable response due to its speed, simplicity, low cost, and ease of automation. However, lack of standardisation and a universally-accepted calibrant has limited technical and subsequent clinical confidence in fructosamine analysis. In response, a comprehensive technical evaluation (including novel …

Campus Safety Directors: A Leadership Frame Analysis, Ross A. Wolf Jan 1998

Campus Safety Directors: A Leadership Frame Analysis, Ross A. Wolf

Retrospective Theses and Dissertations

This study is based on leadership frame theory as developed by Drs. Lee Bolman and Terrence Deal who merged several different schools of theory into four different frames: structural, human resource, political, and symbolic. In July, 1998 the Leadership Orientation (Self) survey, developed by Bolman and Deal (1990a) was distributed to 343 campus safety directors at American public four-year postsecondary institutions. A return of 190 (55.4%) useable survey instruments was obtained in this study.

The utilization of leadership frames by campus safety directors was examined as well as the relationship between frame usage and age, education level, length of time …

Medical Paradigms For Counseling: Giving Clients Bad News, Linda F. Smith Jan 1998

Medical Paradigms For Counseling: Giving Clients Bad News, Linda F. Smith

Utah Law Faculty Scholarship

When lawyers must give clients "bad news," they should draw upon the lessons that emerge from the world of medical counseling. Lawyers must be direct and candid about the state of affairs. They must fully describe how grim the situation appears nd explain why this is their opinion. They must enter into a dialogue in which the client's questions are answered and the client's feelings are respected and responded to. Lawyers must be self-aware in order to avoid re-sponding dysfunctionally to the client's reactions. They should show empathy and communicate hope to the "whole person" who is the client. Only …

Polar Field Tent Shelters And Well-Being Of Users, James Potter, X. Winston Yan, Nathan S. Krug, Karl C. Kuivinen, Marijane E. England

Architecture Program: Faculty Scholarly and Creative Activity

Polar research teams often spend extended periods of time away from base stations, living and working in remote field camps of portable tent shelters. This article reports on a study of the design and use of portable field tent shelters being deployed in Antarctica and other circumpolar areas. The purpose of the study was to determine the effect of the shelters on health and well-being of their users from an environment-behavior perspective. Preliminary analysis indicates that although the design and use of field tent shelters were generally satisfactory, there are areas in which the shelters had some adverse bearing on …

G98-1345 Family Asset Mapping, Herbert G. Lingren Jan 1998

G98-1345 Family Asset Mapping, Herbert G. Lingren

University of Nebraska-Lincoln Extension: Historical Materials

All families have assets. Strengthening them is critical for a healthy family life. This NebGuide presents several opportunities for doing that.

The Family Relationship Bank Account

Successful family living requires two bank accounts: a financial account, which allows the purchase of goods and services, and a relationship account, which promotes sustainability, bonding and togetherness. When assets are many and the account balance is large, there is enough "money" to meet the relational demands that exist between couples, the family demands of raising children and the social demands of living in a community. At other times, when withdrawals are high, or …
