Some Questions And Answers Concerning Justice Blackmun In Federalism And Separation Of Powers Cases, Vikram David Amar

UC Law Constitutional Quarterly

In this short article, Professor Amar analyzes some of Justice Blackmun's intellectual contributions in the fields of federalism and separation of powers. Professor Amar does, however, express some misgivings about the way these questions have been answered by the Court.

Of Text, Technique, And The Tangible: Drafting Patent Claims Around Patent Rules, 17 J. Marshall J. Computer & Info. L. 219 (1998), John R. Thomas

UIC John Marshall Journal of Information Technology & Privacy Law

Courts have long recognized and policed attempts to contract around the patent code. Settled law establishes that the proprietor of a patent which enjoys market power cannot extend that patent beyond its statutory term or restrain competition in an unpatented product via contract. Yet today a far more subtle and fundamental mechanism for drafting around the statute has materialized: the humble patent instrument itself. Patent drafters have only partially realized the remarkable set of tools they now possess for expanding the scope of patent-eligible subject matter, augmenting the market power of issued patents, and avoiding core precepts of the patent …

A Perspective On Leadership In Technology And Curriculum : A Reflective Essay, Lori J. Seawel Jan 1998

A Perspective On Leadership In Technology And Curriculum : A Reflective Essay, Lori J. Seawel

Graduate Research Papers

I believe my experiences with technology will play an equally important role as a principal or curriculum coordinator. In this paper, I focused on the role I feel technology must have in education. I addressed the following areas relative to administrative responsibilities concerning technology: school and community relations, school reform, technology's role in the restructuring process, strategic planning for technology infusion, curriculum as the driving force for technology integration, the technology coordinator, and professional development.

G98-1365 Don't Let Stress Get You Down!, Herbert G. Lingren, Ladeane Jha, Judith A. Schwab, Barbara L. Schmidt, Connie Francis, Jeanette Friesen, Janet S. Hanna

University of Nebraska-Lincoln Extension: Historical Materials

This NebGuide defines stress and its relationship to anger. It discusses a stress management model, stress-busting technique and helps the reader develop a stress management plan.

What is Stress?

Stress has become a catch-all term to describe events or circumstances that make us feel tense or angry. Stress often is caused by events over which we have no control (destruction of home by tornado or sudden death of a family member) or by a positive event (birth of child). However, most stress comes from the daily pile-up of small aggravations and frustrations.

It is not "things" or events themselves, however, …

Is it possible to look out over the Ural Mountains and see Appalachia? To find the character of the American West in the vast open space of Siberia? To smell the citrus and feel the warm sun of the Black Sea coast and be struck with a sense of Florida?

This book is based on just such an idea: that we can look beyond our borders and discover fundamental realities about places that transcend differences of culture, language, and politics. Five American and four Russian geographers wrote this book to provide glimpses of understanding about the United States and Russia. …

Workplace Spirituality: What Is It?, Edward Canavan

Regis University Student Publications (comprehensive collection)

If we had to pick a few central themes of our studies at Regis University, this would be one of them. Not that we want to credit Nissan Corporation with innovative thinking in this area. But they have marketed a concept that has been very meaningful to us in our time at Regis and a concept that forms the theme of this Comprehensive Project. Let us explain. Early in our studies at Regis, we went through the "Futures Invention" process with David Thomas. This was and is a wonderful process that encourages the participants to dream dreams in various time …

Following Tradition, Simon J. Bronner Jan 1998

Following Tradition, Simon J. Bronner

All USU Press Publications

Following Tradition is an expansive examination of the history of tradition—"one of the most common as well as most contested terms in English language usage"—in Americans' thinking and discourse about culture. Tradition in use becomes problematic because of "its multiple meanings and its conceptual softness." As a term and a concept, it has been important in the development of all scholarly fields that study American culture. Folklore, history, American studies, anthropology, cultural studies, and others assign different value and meaning to tradition. It is a frequent point of reference in popular discourse concerning everything from politics to lifestyles to sports …

A Preferred Vision For Administering Secondary Schools : A Reflective Essay, Julia Burton-Varn

Graduate Research Papers

Whole language; inclusion; acceleration; best practices; integrated curriculum; back-to basics; Education 2000; Carnegie Report; School-to-Work Initiative; technological course-ware; multiple intelligences; emotional intelligences; multicultural, non-sexist education; and strategic planning are all educational issues that have emerged, submerged, and in some cases re-emerged during the fifteen years that I have been teaching. As schools embrace or reject standards or movements, one can ask if the quality of education has actually changed. There are frequent reports and articles concerning the poor quality of the educational system within the United States. A continual debate surrounds the effectiveness of a system and the quality of …

Identifying Global Anatomical Differences: Deformation-Based Morphometry, J Ashburner, C Hutton, R Frackowiak, Ingrid Johnsrude, C Price, K Friston Jan 1998

Identifying Global Anatomical Differences: Deformation-Based Morphometry, J Ashburner, C Hutton, R Frackowiak, Ingrid Johnsrude, C Price, K Friston

Brain and Mind Institute Researchers' Publications

The aim of this paper is to illustrate a method for identifying macroscopic anatomical differences among the brains of different populations of subjects. The method involves spatially normalizing the structural MR images of a number of subjects so that they all conform to the same stereotactic space. Multivariate statistics are then applied to the parameters describing the estimated nonlinear deformations that ensue. To illustrate the method, we compared the gross morphometry of male and female subjects. We also assessed brain asymmetry, the effect of handedness, and interactions among these effects.

Beliefs About Consciousness And Reality Of Participants At ‘Tucson Ii’, Imants Barušs, Robert J. Moore Jan 1998

Beliefs About Consciousness And Reality Of Participants At ‘Tucson Ii’, Imants Barušs, Robert J. Moore

Psychology

In previous studies we had found correlations between the material-transcendent dimension underlying the Western intellectual tradition and the diversity of ideas concerning consciousness. In the course of our work we developed the Beliefs About Consciousness and Reality Questionnaire that could be used for measuring fundamental beliefs about consciousness and reality. A survey of participants at the scientific meeting Toward a Science of Consciousness 1996 “Tucson II” was conducted using this questionnaire. Results from 212 respondents indicated scores substantially in the transcendent direction, both for scales underlying the questionnaire as well as for some of its individual items, relative to a …

Joy Harjo, Rhonda Pettit Jan 1998

Joy Harjo, Rhonda Pettit

Western Writers Series Digital Editions

Who is Joy Harjo? To anyone familiar with Native American writing and/or contemporary poetry, the obvious answer to this question might be: a Native American poet. Readers familiar with her work might also consider her a Western U. S. writer, since she lives in the Southwest and uses Western landscapes and locales as settings, as vehicles for psychological probing, and as subjects endowed with transcendent power. If these labels seem reductive, other cultural and literary locations Harjo occupies complicate the issue of her identity.

Chapter 7 - Reflections On The Scholarship Of Elizabeth B. Clark, Kristin Olbertson, Carol Weisbrod, Christine Stansell, Martha Minow Jan 1998

Chapter 7 - Reflections On The Scholarship Of Elizabeth B. Clark, Kristin Olbertson, Carol Weisbrod, Christine Stansell, Martha Minow

Manuscript of Women, Church, and State: Religion and the Culture of Individual Rights in Nineteenth-Century America

Elizabeth Clark's essays on early nineteenth-century reform movements make a compelling case that abolitionists and feminists alike understood individual rights from a profoundly religious perspective. Clark also demonstrates how these reformers advocated the protection of so-called "natural rights" for enslaved African-Americans and white women in the vivid and fervently emotional language of evangelical revivalism. Broader cultural and intellectual trends of resistance to governmental and clerical authority, trends rooted in liberal and evangelical Protestantism, Clark argues, helped fuel attacks on slavery and gender inequality. Rejecting other historians' portrayals of the antebellum reformers as primarily secular in orientation, Clark makes the arresting, …
