Where We Stand: An Analysis Of America's Family Law Adjudicatory Systems And The Mandate To Establish Unified Family Courts, Barbara A. Babb Apr 1998

Where We Stand: An Analysis Of America's Family Law Adjudicatory Systems And The Mandate To Establish Unified Family Courts, Barbara A. Babb

All Faculty Scholarship

The volume and scope of family law cases in contemporary American society, as well as their unending nature both individually and systemically, exacerbate the difficulty of their resolution. To address this crisis, the American Bar Association and others have recommended court reform, specifically, the establishment of unified family courts in all jurisdictions. A unified family court is a single forum within which to adjudicate the full range of family law issues, based on the notion that court effectiveness and efficiency increase when the court resolves a family's legal problems in as few appearances as possible. The model is based on …

Transgressing Goodness In Breaking The Waves, Irena S. M. Makarushka Phd Apr 1998

Transgressing Goodness In Breaking The Waves, Irena S. M. Makarushka Phd

Journal of Religion & Film

This analysis of Breaking the Waves falls into two sections: 1) the 'good'; and 2) transgressing goodness. The focus is Bess, her status as woman in a patriarchal culture and her struggle to be 'good'. The reading that I propose explores von Trier's meditation on competing notions of goodness and the cultural assumptions that inform them. In the first section, I explore how Bess negotiates the moral landscape within which she lives as daughter, sister-in-law, member of a religious community, and wife. The church elders and Bess represent von Trier's vision of the two extremes of the contested notion of …

While touring the Frascati vineyards outside ofRome with a business associate and as we learned the basic techniques of winemaking, our in-between conversation was focused on the difficulties and change our industry and his country were facing. We pondered and discussed our positions and responsibilities for our organization. during this time. We were well aware of the many industry challenges facing us and our board ofdirectors. It was upon reflection ofthat conversation and the memory of that beautiful scenario of those luscious vineyards that it struck me how similar the management ofthe fruit·ofthe grapevine is to the management of organizations. …

Factors Affecting Leadership Styles Of Prison Wardens: A Case Study Of Public Adult Prisons Within Virginia, Nancy Elizabeth Santiago Apr 1998

Factors Affecting Leadership Styles Of Prison Wardens: A Case Study Of Public Adult Prisons Within Virginia, Nancy Elizabeth Santiago

Theses and Dissertations in Urban Services - Urban Management

This study attempts to identify the leadership styles of Virginia prison wardens within public adult prisons, and to determine which factors contribute to the development of their leadership styles. The two instruments used in this study to assess leadership style were the Leadership Practices Inventory (LPI, which measures "transformational" leadership), and the Leader Behavior Analysis II Self (LBAII Self, which measures "transactional" leadership). Both instruments have been used in prior research with correctional personnel, and comparisons of this research study is made with previous dissertations utilizing the LPI and LBAII.

Also developed for this study was a set of questions …

Racial Differences In Rape Myth Acceptance Among College Women, Lekeshia M. Washington Apr 1998

Racial Differences In Rape Myth Acceptance Among College Women, Lekeshia M. Washington

Sociology & Criminal Justice Theses & Dissertations

This study investigates the racial differences in rape myth acceptance among college women. There has been little research on the topic of rape which examines solely the opinions of women. Black and white college women {N=623) completed a survey which measured the degree of acceptance or rejection of false beliefs about rape, rape victims, or rapists. These false beliefs were termed rape myths. The myths demean the victim and support stereotypes about rape. Past research suggests that blacks accept rape myths more than whites, and that victims accept rape myths more than nonvictims. This study's analyses suggest that women as …

Bodies Of Law, Moira Mcconnell Apr 1998

Bodies Of Law, Moira Mcconnell

Dalhousie Law Journal

"Don't judge a book by its cover" is a maxim most frequently recited to children by adults to explain the idea that one should not judge people on the basis of appearance. This maxim captures the gist of the topic explored in Alan Hyde's Bodies of Law. Bodies of Law seeks to expose the fact that we simultaneously view a person as an entity distinct from her or his physical manifestation while our understanding and response to a person is affected by our perceptions and judgments regarding their physical characteristics.

What's The Difference? Interpretation, Identity And R. V. R.D.S., Allan Hutchinson, Kathleen Strachan

Dalhousie Law Journal

Lawyers hanker after authority. Whether it be in enforcing the law or justifying law's institutional power, there is an almost desperate yearning to establish and maintain the legitimacy of law and, therefore, of themselves, in a social world in which the whole notion of authority is challenged and undermined. When it comes to matters of legal interpretation, jurists and judges still crave some method that will ground or trace back an interpretation to a foundational or ultimate source that can confer authority on one particular interpretation over another. However, recent jurisprudential debate has done fatal damage to the notion that …

Sociometric Status And Aggression As Predictive Of Childhood Conflict, Laura Warren '98 Apr 1998

Sociometric Status And Aggression As Predictive Of Childhood Conflict, Laura Warren '98

Honors Projects

Following recent trends in the study of children's conflict, researchers compared relationship strength between conflict resolution style and the personal variables of aggression and sociometric status. Participants consisted of 136 fourth-and fifth-grade students, who completed assessments measuring sociometric status and aggression, as well as reports on both hypothetical and real-life conflict resolution styles. Results revealed aggression levels to be more strongly associated with antisocial styles of conflict management, while sociometric status was a stronger predictor of assertive styles of resolution. In contrast to previous research, children's reported use of prosocial methods was consistent across all measures of conflict. Implications of …

The Protestant Church In East Germany, Sara Lieb '98 Apr 1998

The Protestant Church In East Germany, Sara Lieb '98

Honors Projects

In 1996, I spent four months studying in what was formerly East Berlin. During that time, I met people from across the United States as well as Germany. I made many friends who are either agnostic or atheist. The reasons for these beliefs among Americans were most often based on negative experiences with a church, anger towards God because of various tragedies, or on a misunderstanding of Christianity. In my conversations with citizens of the former East Germany, I discovered that their communist beliefs did not allow them room for loyalty to the Church or even to God; as one …

European Security And Nato Enlargement: A View From Central Europe, Stephen J. Blank Dr.

Books, Monographs & Collaborative Studies

On August 4-5, 1997, the Strategic Studies Institute (SSI), together with the Reserve Officers Association, cosponsored a conference in Prague on "Eurasian Security in the Era of NATO Enlargement." In order to clarify fully the emerging security agenda in Europe and hear from member states and other interested parties, SSI invited analysts and officials from all of the Central and East European countries, including those invited to join NATO, those not invited, and those former Soviet states with a vital interest in the outcome, e.g., Ukraine, Belarus, and Russia. The panelists provided assessments of their respective countries' perspectives, of their …

How Occupational Therapists Teach Older Patients To Use Bathing And Dressing Devices In Rehabilitation., Ruth Levine Schemm, Laura N. Gitlin

Department of Occupational Therapy Faculty Papers

OBJECTIVE: This article describes the methods occupational therapists use to teach bathing and dressing device use to older patients in rehabilitation programs. The relationship of three patient characteristics to five aspects of assistive device instruction was examined.

METHOD: The study sample included 86 patients and 19 occupational therapists who provided the assistive device training. Patients were 55 years of age or older and in rehabilitation for an orthopedic deficit, cerebrovascular accident, or lower limb amputation. Therapists recorded information on teaching methods, perceptions of patient knowledge, and expectations for future device use after each treatment session.

RESULTS: Patients received an average …

The United States And The Netherlands: A Study Of Early Cold War Cooperation, Michael R. Hirman Apr 1998

The United States And The Netherlands: A Study Of Early Cold War Cooperation, Michael R. Hirman

History Theses & Dissertations

This thesis examines the policy that the United States utilized between 1945 and 1950 to enlist Dutch support for post-war European organizations and the place of this relationship within United States overall Cold War policy. The Netherlands willingness to cooperate and further United States objectives significantly contributed to the development of economic reconstruction and military security in Western Europe. In addition the United States unprecedented vision for a multilateral defense treaty came to fruition in part through Dutch support and compliance. However, the Dutch also had to make some historic changes. The United States opposed the Dutch attempt to retake …

Visible Minorities In The Multi-Racial State: When Are Preferential Policies Justifiable?, Anita Anand Apr 1998

Visible Minorities In The Multi-Racial State: When Are Preferential Policies Justifiable?, Anita Anand

Dalhousie Law Journal

This article outlines the circumstances in which the state is justified in implementing preferential policies in favour of visible minorities and describes an approach to policy formulation. The thesis is that visible minorities warrant preferential treatment in order to rectify past injustices and to redistribute advantages to visible minorities who are chronically poor. "Supply-side" over "demand-side" policies are favoured. Supply-side policies are preferable because they support substantive equality by ensuring that individuals have a minimum level of subsistence. If the goal of achieving substantive equality is to be achieved, the poor should also be entitled to benefit under preferential policies. …

Gays In Aa: How Do They Benefit From The Program Of Alcoholics Anonymous?, Madonna R. Riesenmy Apr 1998

Gays In Aa: How Do They Benefit From The Program Of Alcoholics Anonymous?, Madonna R. Riesenmy

Theses

Objective: Recovering gay alcoholics report that, although the experience of AA is beneficial for them, they have needs different from that of heterosexuals and place dissimilar demands on the program of Alcoholics Anonymous (Ratner, 1988, Paul, Stall, & Bloomfield, 1991). Some of these needs and demands are evidenced in the ways gay alcoholics make use of sponsors, meetings, and gay meetings (Kus, 1987, 1994, Hall, 1994). The present study examines the incidence of relapse and three aspects of recovery: sponsorship, meeting attendance, and attendance at gay meetings during the first year of recovery. Method: A group of gay recovering alcoholics …

Electrocortical Output And Hemispheric Contributions To The Alert State During A Sustained Attention Task, Treven Curtis Pickett Apr 1998

Electrocortical Output And Hemispheric Contributions To The Alert State During A Sustained Attention Task, Treven Curtis Pickett

Psychology Theses & Dissertations

This study investigated the relative electrocortical contributions of specified cerebral locations and the potential motoric influence of handedness in a biocybernetic feedback environment. Thirty six right-handed subjects engaged in two sixteen minute trials of a compensatory tracking task by guiding (via a joystick) a circle over a stationary target presented on a computer screen, performing one trial with their preferred (right) and one using their non-preferred (left) hand.

For each subject, a Macintosh computer interpreted electrocortical activity through an engagement index (20*beta/(alpha+theta)) and changed the task mode, i.e. manual (subject guides the task) or automatic (computer guides the task) as …

Campus Racial Climate Policies: The View From The Bottom Up, Michelle Hughes, Rick Anderson, Julie Harms Cannon, Eduardo Perez, Helen A. Moore Apr 1998

Campus Racial Climate Policies: The View From The Bottom Up, Michelle Hughes, Rick Anderson, Julie Harms Cannon, Eduardo Perez, Helen A. Moore

Department of Sociology: Faculty Publications

We review the debates over campus multicultural goals from the perspective of university officials and again from the perspective of the policy target: students. We then assess a sample of student policy opinions and the role of campus experiences and diverse racial/ethnic and socioeconomic backgrounds in shaping those opinions. Often descriptive, this provides insights on working with diverse student populations. We focus our research on students because student voices are often unheard in education. Administrators are assumed to “know better” because of their years of campus experience or professional training.

Review Of Texas Wanderlust: The Adventures Of Dutch Wurzbach By Douglas V. Meed, Cary D. Wintz

Great Plains Quarterly (through 2013)

Eight-year-old Emil Frederick "Dutch" Wurzbach arrived with his family in Galveston in early 1846 as one of the hundreds of German immigrants who sailed to Texas that year. He spent his childhood in central Texas, first at Fredericksburg, then in Austin, and finally on a farm outside Austin. At the age of eleven Wurzbach began a series of frontier jobs, largely with the army, herding livestock or working as a teamster supplying the scattered frontier posts south and west of San Antonio; he also served a brief stint in the Texas Rangers. He encountered legendary frontiersmen, fought Comanches and Apaches, …

Review Of Better Red: The Writing And Resistance Of Tillie Olsen And Meridel Le Sueur By Constance Coiner & Three Radical Women Writers: Class And Gender In Meridel Le Sueur, Tillie Olsen, And Josephine Herbst By Nora Ruth Roberts, Linda Ray Pratt

Great Plains Quarterly (through 2013)

HARVEST SONGS AND ELEGIAC NOTES

"Writing about living subjects, especially those with whom one feels political and personal solidarity, is a touchy, even painful business," begins Constance Coiner in the introduction to her book on Tillie Olsen and Meridel Le Sueur. Contemporary directions in scholarship have recognized that interaction and opened up the personal voice in the scholarly study. Putting aside the dream of disinterestedness, the scholar herself may become part of the subject. The traditions of an objective scholarship are especially hard to fulfill, even to honor, when the research is done in cooperation with a living author who …
