Did Military Justice Fail Or Prevail?, Robinson O. Everett May 1998

Did Military Justice Fail Or Prevail?, Robinson O. Everett

Michigan Law Review

The subject of war crimes is now receiving significant attention. On March 13, 1998, the United States Senate, by a vote of 93-0, adopted a resolution urging the President to call on the- United Nations to create a tribunal to indict and try Saddam Hussein for his "crimes against humanity." In the recent past, United Nations tribunals have tried crimes against humanity perpetrated in the former Yugoslavia and in Rwanda. With Administration backing, Congress has also recently enacted legislation intended to confer jurisdiction on the federal district courts to try certain war crimes of which American nationals are perpetrators or …

Analogical Problem Solving: The Differential Impact Of Type Of Training, Amount Of Practice, And Type Of Analogy On Spontaneous Transfer, Dune E. Ives May 1998

Analogical Problem Solving: The Differential Impact Of Type Of Training, Amount Of Practice, And Type Of Analogy On Spontaneous Transfer, Dune E. Ives

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

Research on analogical problem solving has delineated several factors that impact one's ability to spontaneously generate a correct solution strategy to a target problem. These factors include, but are not limited to, type of analogy provided to subjects (i.e., partial versus complete), the level of analogical problem-solving expertise, and the absence of or type of analogical problem-solving training (i.e., teacher-generated or learner-generated) provided to learners.

Recently, researchers have begun to focus on providing solvers with multiple practice opportunities and extending these opportunities over a systematically distributed period of time. When combined with analogical problem-solving training, these factors will augment the …

Late Pleistocene Glacial Chronology Of The Western Ahklun Mountains, Southwestern Alaska, Jason P. Briner May 1998

Late Pleistocene Glacial Chronology Of The Western Ahklun Mountains, Southwestern Alaska, Jason P. Briner

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

New glacial mapping and 35 cosmogenic 36Cl surface exposure ages, the first ever reported from Alaska, constrain the extent and timing of late Pleistocene glacial fluctuations in the western Ahklun Mountains, southwestern Alaska. Morphometric and soil relative-age data characterize two main drift units deposited during the Arolik Lake and Klak Creek glaciations, named herein. During the Arolik Lake glaciation (early Wisconsin), outlet glaciers emanated from an ice cap over the central portion of the Ahklun Mountains and deposited moraines at or beyond the modern coast. These moraines have slope angles averaging about 11° and crests averaging about 35 m …

An Investigation Of The Decision Making Strategies Of Learning Disabled (Ld) And Non Disabled (Nld) Adult Students Using Information Processing Theory: Implications For Educators., Alison Fulmer May 1998

An Investigation Of The Decision Making Strategies Of Learning Disabled (Ld) And Non Disabled (Nld) Adult Students Using Information Processing Theory: Implications For Educators., Alison Fulmer

Australian Journal of Teacher Education

This study investigated the decision making strategies of learning disabled (LD) and non-leaming disabled (NLD) adult students using the information processing model outlined by Kolligian and Stemberg (1987) and process tracing analysis. As predicted by Kolligian and Sternberg (1987), LD adult students were unable to selectively encode the problem or make selective comparisons and combinations of the dimensions; that is, they did not use "skilled omission". LD adult students searched exhaustively, used more information and demonstrated less variability in their search patterns than their non disabled peers. These strategies imply the use of compensatory decision models (e.g. additive model in …

A national survey of the attitudes of school psychologists regarding grade retention were investigated in this study. An attitudinal survey was sent to 500 members of the National Association of School Psychologists; the response rate was 49%. The results of the study showed that school psychologists tend to believe that retention is a harmful practice.

On Different Integrable Systems Sharing The Same Nondynamical R-Matrix, Zhijun Qiao, Walter Strampp May 1998

On Different Integrable Systems Sharing The Same Nondynamical R-Matrix, Zhijun Qiao, Walter Strampp

School of Mathematical & Statistical Sciences Faculty Publications

In a recent paper @Zhijun Qiao and Ruguang Zhou, Phys. Lett. A 235, 35 ~1997!#, the amazing fact was reported that a discrete and a continuous integrable system share the same r-matrix with the interesting property of being nondynamical. Now, we present three further pairs of different continuous integrable systems sharing the same r-matrix again being nondynamical. The first pair is the finite-dimensional constrained system ~FDCS! of the famous AKNS hierarchy and the Dirac hierarchy; the second pair is the FDCS of the well-known geodesic flows on the ellipsoid and the Heisenberg spin chain hierarchy; and the third pair is …

Sources And Chemistry Of Noₓ In The Upper Troposphere Over The United States, Lyatt Jaegle, Daniel J. Jacob, Yuhua Wang, Andrew J. Weinheimer, Brian A. Ridley, Teresa L. Campos, Glen W. Sachse, Donald E. Hagen May 1998

Sources And Chemistry Of Noₓ In The Upper Troposphere Over The United States, Lyatt Jaegle, Daniel J. Jacob, Yuhua Wang, Andrew J. Weinheimer, Brian A. Ridley, Teresa L. Campos, Glen W. Sachse, Donald E. Hagen

Physics Faculty Research & Creative Works

The origin of NOx in the upper troposphere over the central United States is examined using aircraft observations obtained during the SUCCESS campaign in April–May of 1996. Correlations between NOy (sum of NOx and its oxidation products) and CO at 8–12 km altitude indicate that NOx originates primarily from convective transport of polluted boundary layer air. Lightning and aircraft emissions appear to be only minor sources of NOx. Chemical steady state model calculations constrained by local observations of NO underestimate the measured NOx/NOy concentration ratio at 8–12 km altitude by a …

Particulate Sizing And Emission Indices For A Jet Engine Exhaust Sampled At Cruise, Donald E. Hagen, Philip D. Whitefield, Jonathan D. Paladino, Max B. Trueblood May 1998

Particulate Sizing And Emission Indices For A Jet Engine Exhaust Sampled At Cruise, Donald E. Hagen, Philip D. Whitefield, Jonathan D. Paladino, Max B. Trueblood

Physics Faculty Research & Creative Works

Particle size and emission indices measurements for jet engines, primarily the Rolls Royce RB211 engines on a NASA 757 aircraft are reported. These data were used to estimate the fraction of fuel sulfur that was converted to particulates. These measurements were made in-situ with the sampling aircraft several kilometers behind the source. Some complimentary ground measurements on the same source aircraft and engines are also reported. Significant differences are seen between the ground observations and the in-situ observations, indicating that plume processes are changing the aerosol's characteristics.

Adaptation Space: Surviving Non-Maskable Failures, Crispin Cowan, Lois Delcambre, Anne-Francoise Le Meur, Ling Liu, David Maier, Dylan Mcnamee, Michael Miller, Calton Pu, Perry Wagle, Jonathan Walpole

Computer Science Faculty Publications and Presentations

Some failures cannot be masked by redundancies, because an unanticipated situation occurred, because fault-tolerance measures were not adequate, or because there was a security breach (which is not amenable to replication). Applications that wish to continue to offer some service despite nonmaskable failure must adapt to the loss of resources. When numerous combinations of non-maskable failure modes are considered, the set of possible adaptations becomes complex. This paper presents adaptation spaces, a formalism for navigating among combinations of adaptations. An adaptation space describes a collection of possible adaptations of a software component or system, and provides a uniform way of …

Structure Of 5-Nitro-2-Tosylaminobenzaldehyde Di(Morpholin-4-Yl)Aminal Complex With Carbon Tetrachloride, V. N. Khrustalev, Sergey V. Lindeman, L. Yu Ukhin, G. I. Orlova, T. N. Gribanova, O. V. Shishkin

Chemistry Faculty Research and Publications

The 5-nitro-2-tosylaminobenzaldehyde di(morpholin-4-yl)aminal forms a stable complex with carbon tetrachloride in the crystal phase. X-ray structural study of this complex indicates an essentially shortened intermolecular contact of 2.89 Å between the oxygen atom of the nitro group and one of the chlorine atom of the CCI4 molecule. Quantum-chemical calculations by semiempirical AMI method showed that the formation of such complex did not cause considerable decrease of system energy or change of charge distribution in molecules. It was supposed that this associate has van der Waals character.

Field-Induced Transverse Spin Ordering In Febr2, O. Petracie, Christian Binek, Wolfgang Kleemann, U. Neuhausen, H. Lueken May 1998

Field-Induced Transverse Spin Ordering In Febr2, O. Petracie, Christian Binek, Wolfgang Kleemann, U. Neuhausen, H. Lueken

Christian Binek Publications

Weak first-order phase transitions from axial to oblique spin ordering in FeBr2 are evidenced by superconducting quantum interference device magnetometry in axial fields H1(T) above the multicritical point, Hm=2.4 MA/m, Tm=4.6 K, and below the antiferro-to-paramagnetic phase line, Hc (T), in agreement with recent specific-heat data [H. Aruga Katori, K. Katsumata, and M. Katori, Phys. Rev. B 54, R9620 (1996)]. The ordering of the in-plane moments is probably due to nondiagonal coupling to the longitudinal ones, both of which increase discontinuously at H1 (T) only under …

New Limits For Neutrinoless Tau Decays, D. W. Bliss, Kenneth A. Bloom, Cleo Collaboration May 1998

New Limits For Neutrinoless Tau Decays, D. W. Bliss, Kenneth A. Bloom, Cleo Collaboration

Kenneth Bloom Publications

Neutrinoless 3-prong tau lepton decays into a charged lepton and either two charged particles or one neutral meson have been searched for using 4.79 fb-1 of data collected with the CLEO II detector at Cornell Electron Storage Ring. This analysis represents an update of a previous study and the addition of six decay channels. In all channels the numbers of events found are compatible with background estimates and branching fraction upper limits are set for 28 different decay modes. These limits are either more stringent than those set previously or represent the first attempt to find these decays.

Search For Color-Suppressed B Hadronic Decay Processes At The Υ(4S) Resonance, B. Nemati, Kenneth A. Bloom, Cleo Collaboration

Kenneth Bloom Publications

Using 3.1 fb-1 of data accumulated at the Υ(4S) by the CLEO-II detector, corresponding to 3.3×106 BB̅ pairs, we have searched for the color-suppressed B hadronic decay processes B0→D0 (D*0)X0, where X0 is a light neutral meson π0, ρ0, η, η′ or ω. The D*0 mesons are reconstructed in D*0→D0π0 and the D0 mesons in D0→K-π+, K-π+π0 and K …

Mammals [Of The Sand Hills], Patricia W. Freeman May 1998

Mammals [Of The Sand Hills], Patricia W. Freeman

School of Natural Resources: Faculty Publications

Of approximately 81 species of mammals present in Nebraska today, 55 occur in the Sand Hills, with an additional three species that are associated only with the Niobrara River. Nebraska as a whole is truly a crossroads for mammals because two-thirds of the species reach their distributional limits in the state (Jones, 1964). Most of these mammals are widespread species or are specific to the grasslands as a whole and are not affected by this sandy zone. Jones (1964) wrote that “only a few mammals are restricted to this area. Mostly it serves to filter western species moving east and, …

Chemically Mediated Foraging Preference Of Black Bears ( Ursus Americanus), Bruce A. Kimball, Dale L. Nolte, Richard M. Engeman, John J. Johnston, Frank R. Stermitz

United States Department of Agriculture Wildlife Services: Staff Publications

The role of chemical constituents in the foraging behavior of black bears (Ursus americanus) was investigated using two field studies. Vascular tissue samples were collected from Douglas-fir (Pseudotsuga menziesii) trees recently foraged by black bears. Samples were extracted and analyzed by liquid and gas chromatography to determine carbohydrates and terpenes, respectively. Chemical data were subjected to correlation analyses and multiple regression to examine if they adequately describe observed foraging preferences. Free-ranging black bears also were offered a choice of four test diets that differed in content of carbohydrates and terpenes. Results indicated that forage preferences were …

Paleocene Mammalian Biostratigraphy Of The Carbon Basin, Southeastern Wyoming, And Age Constraints On Local Phases Of Tectonism, Ross Secord

Department of Earth and Atmospheric Sciences: Faculty Publications

Mammalian fossils from two principal collecting areas in the lower Hanna Formation of the Carbon Basin comprise three faunas, the Grayson Ridge, Halfway Hill, and Sand Creek faunas. The Grayson Ridge and Halfway Hill faunas are diverse, consisting cumulatively of 29 mammalian species, at least two of which are new. The faunas are approximately equivalent in age and are either latest Torrejonian or earliest Tiffanian, or possibly sample both NALMAs. In any event, the faunas are very close in age to the lbrrejonian-Tiffanian boundary. Strata bearing the Grayson Ridge and Halfway Hill faunas were truncated by erosion, resulting in a …

Secured Lending As A Zero-Sum Game, David Gray Carlson May 1998

Secured Lending As A Zero-Sum Game, David Gray Carlson

Cardozo Law Review

This Article claims that law and economics literature made a profound mistake when it tried to adapt the Modigliani-Miller irrelevance hypothesis-famous in corporate finance theory-to the question of why it pays a debtor to issue secured debt as well as unsecured debt. The literature that is criticized claims that lending is a zero-sum game. If the debtor saves money from the secured loan, the debtor simply pays more later to an unsecured claim. Some "disturbing cause" must exist to disrupt the zero-sum game and render security interests rational for the debtor. The author rigorously shows, however, that the zero-sum quality …
