People Ex Rel. Gallo V. Acuna: Pulling In The Nets On Criminal Street Gangs, Edson Mcclellan Feb 1998

People Ex Rel. Gallo V. Acuna: Pulling In The Nets On Criminal Street Gangs, Edson Mcclellan

San Diego Law Review

In response to rising gang-related crime, California passed in 1988 the Street Terrorism and Prevention (STEP) Act. Among the tools it provides to prosecutors is civil injunction of gang behavior: a prosecutor may enjoin a range of otherwise legal conduct as well as conduct that is independently proscribed by the Penal Code. The first appellate challenge was People ex rel. Gallo v. Acuna, handed down April, 1995. The court modified slightly the terms of STEP to avoid vagueness and overbreadth and commanded that to bind a defendant to an anti-gang injunction "there must be some personal, individual participation" in the …

Investigation Of The Roles Of Toxin-Coregulated Pili And Mannose-Sensitive Hemagglutinin Pili In The Pathogenesis Of Vibrio Cholerae O139 Infection, Carol O. Tacket, Ronald K. Taylor, Genevieve Losonsky, Yu Lim Feb 1998

Investigation Of The Roles Of Toxin-Coregulated Pili And Mannose-Sensitive Hemagglutinin Pili In The Pathogenesis Of Vibrio Cholerae O139 Infection, Carol O. Tacket, Ronald K. Taylor, Genevieve Losonsky, Yu Lim

Dartmouth Scholarship

In this study, adult volunteers were fed tcpA and mshA deletion mutants of V. cholerae O139 strain CVD 112 to determine the role of toxin-coregulated pili (TCP) and mannose-sensitive hemagglutinin (MSHA) in intestinal colonization. Eight of 10 volunteers who received CVD 112 or CVD 112 ΔmshA shed the vaccine strains in their stools; the geometric mean peak excretion for both groups was 1.4 × 105 CFU/g of stool. In contrast, only one of nine recipients of CVD 112 ΔtcpA shed vibrios in his stool (P < 0.01); during the first 24 h after inoculation, 3 × 102 CFU/g was recovered from this volunteer. All recipients of CVD …

Worker Participation And Firm Performance : Evidence From Germany And Britain, John T. Addison, W. Stanley Siebert, Joachim Wagner, Xiangdong Wei

Centre for Public Policy Studies : CPPS Working Paper Series

This paper examines the Freeman-Lazear works council/worker involvement model against the empirical backdrop of two different industrial relations systems: the British voluntaristic system, and the German system of mandatory works councils. We find that in nonunion British firms worker involvement increases economic performance, but in the union firms there are negative effects. The implication is that local distributive conflict can cause the wrong level of worker involvement to be chosen, as predicted by the model. ln Germany, where centralized collective bargaining reduces local distributive conflict, we find that a mandate can be advantageous, again as predicted by the model. However, …

Is Hiv "Extraordinary"?, Jordan B. Hansell

Michigan Law Review

The Sentencing Reform Act of 1984 (the "Act") attempts to reduce inconsistencies in the sentences of defendants convicted of comparable crimes. The Act created a Sentencing Commission (the "Commission") and authorized it to promulgate a set of sentencing guidelines to steer judicial decisionmaking. To fulfill this mandate, the Commission drafted the Federal Sentencing Guidelines (the "Guidelines"), which Congress enacted in 1987. Although Congress wanted to eliminate sentencing disparities, it also wanted to allow some degree of individualized sentencing. To achieve the correct balance, the Commission created three categories of characteristics: those a court must consider in sentencing each defendant; those …

Realigning Corporate Governance: Shareholder Activism By Labor Unions, Stewart J. Schwab, Randall S. Thomas Feb 1998

Realigning Corporate Governance: Shareholder Activism By Labor Unions, Stewart J. Schwab, Randall S. Thomas

Michigan Law Review

Labor unions are active again - but this time as capitalists. The potential strength of union pension funds has long been noted, but until recently unions have held their stock passively or invested in union-friendly companies. In the 1990s, however, unions have become the most aggressive of all institutional shareholders. In most cases, it is hard to find a socialist or proletarian plot in what unions are doing with their shares. Rather, labor activism is a model for any large institutional investor attempting to maximize return on capital. Unions, union pension funds, individual union members, and labor-oriented investment funds are …

Force Planning Considerations For Army Xxi, William T. Johnsen Dr. Feb 1998

Force Planning Considerations For Army Xxi, William T. Johnsen Dr.

Books, Monographs & Collaborative Studies

The U.S. Army has moved along the path of preparing for the 21st century. This process began with the conceptual examinations and assessments carried out under the "Louisiana Maneuvers" and the Army's Battle Labs, and matured through the Force XXI process. The Army recently completed its first series of Advanced Warfighting Experiments that will shape the redesign and restructure of the future force, Army XXI, for the early years of the new millennium. While the broad outlines of Army XXI have been sketched out, many of the details remain to be filled in. Undoubtedly, these efforts will be influenced by …

Identification Of Mealybug- (Homoptera: Pseudococcidae) Resistant Turf-Type Buffalograss Germplasm, Jennifer Johnson-Cicalese, Frederick P. Baxendale, Terrance P. Riordan, Tiffany Heng-Moss Feb 1998

Identification Of Mealybug- (Homoptera: Pseudococcidae) Resistant Turf-Type Buffalograss Germplasm, Jennifer Johnson-Cicalese, Frederick P. Baxendale, Terrance P. Riordan, Tiffany Heng-Moss

Department of Entomology: Faculty Publications

Two species of mealybugs, Tridiscus sporoboli (Cockerell) and Trionymus sp., have emerged as potentially serious pests of turf-type buffalograss, Buchloë dactyloides (Nuttall) Engelmann. Sixty-two buffalograss selections were screened for resistance to these mealybugs in 4 greenhouse trials. Using a 1-6 rating scale (1 = no signs of mealybugs, 6 = >75% of tillers infested), 'Prairie' and '609' showed high levels of resistance to mealybugs, whereas several experimental selections, including 90-157,84-512 and 84-412, exhibited moderate resistance. Most selections were moderately susceptible, and 85-97 was highly susceptible with almost every tiller infested and plants near death. In field tests, mealybug infestations were …

Realigning Corporate Governance: Shareholder Activism By Labor Unions, Randall Thomas, Stewart J. Schwab Feb 1998

Realigning Corporate Governance: Shareholder Activism By Labor Unions, Randall Thomas, Stewart J. Schwab

Vanderbilt Law School Faculty Publications

This paper investigates the increased shareholder activism by labor unions and their pension funds, who are now the most aggressive institutional shareholders. Sometimes unions propose traditional corporate-governance measures through procedures familiar to shareholders. Only the union sponsor is novel. But recently unions have pushed innovative methods to get corporations to listen to shareholder complaints. These methods include mandatory amendment of corporate by-laws by shareholders and floor proposals submitted for a shareholder vote at the annual meeting. Unions as shareholders have conflicting roles. We distinguish union-shareholder initiatives designed to further unions' traditional organizing and collective bargaining goals from those that enhance …

Estimation Of Revealed Probabilities And Utility Functions For Product Safety Decisions, W. Kip Viscusi, William N. Evans Feb 1998

Estimation Of Revealed Probabilities And Utility Functions For Product Safety Decisions, W. Kip Viscusi, William N. Evans

Vanderbilt Law School Faculty Publications

Using survey data on consumer product purchases, this paper introduces an approach to estimate jointly individual utility functions and risk perceptions implied by their decisions. The behavioral risk beliefs reflected in consumers risky decisions differ from the stated probabilities given to them in the survey. These results are not consistent with a Bayesian learning model in which the information respondents utilize is restricted to what the survey presents. The results are, however, potentially consistent with models in which prior risk information is influential or models in which people do not act in a fully rational manner.

The Search For The Holy Grail In Ireland: Social Care In Perspective, Niall Mcelwee Feb 1998

The Search For The Holy Grail In Ireland: Social Care In Perspective, Niall Mcelwee

Irish Journal of Applied Social Studies

This article suggests that social care in Ireland is at a crossroads and that the Irish Association of Care Workers is now at a crucial stage of its twenty-six year existence. It acknowledges that a number of practitioners and academics have spent an enormous amount of time and energy attempting to convince their peers and the general public that social care deserves independent professional recognition, but with little real willingness to problematise the discipline of social care. I argue that social care practitioners and advocates will be forced to fully embrace change and become both more dynamic and proactive than …
