In Memoriam: Father Bill Lewers, Jay Tidmarsh Jan 1998

In Memoriam: Father Bill Lewers, Jay Tidmarsh

Journal Articles

There is an old and famous Irish blessing, the last line of which runs: "And may you be in heaven half an hour before the devil knows you're dead." If anyone ever deserved to be happily ensconced in heaven for the proverbial half-hour, it is Bill Lewers.

For the last fourteen years of his life among us, Bill spent his considerable energy improving our understanding and awareness of international human rights. It became Bill's great passion. In 1983, Bill was appointed as Director of the Office of International Justice and Peace for the United States Catholic Conference. When he returned …

The Hidden Age Revolution: Emergent Integration Of All Ages, Matilda White Riley Jan 1998

The Hidden Age Revolution: Emergent Integration Of All Ages, Matilda White Riley

Center for Policy Research

Over the past 30 years my colleagues and I have been focusing on conceptual and empirical work (the aging and society paradigm) that does not create policies, but can inform them. The most immediate phase of this long cumulative history is leading us now to hidden changes in people's lives and social institutions that herald a new phenomenon world-wide--a phenomenon that may have momentous implications for the policies of the future. We call it "age integration" because it *integrates* older people with others of every age. When I come to the end of my lecture, I hope you will see …

Alcohol, Hormones, And Postmenopausal Women, Matthew P. Longnecker, Marilyn Tseng Jan 1998

Alcohol, Hormones, And Postmenopausal Women, Matthew P. Longnecker, Marilyn Tseng

Kinesiology and Public Health

Many women take supplemental estrogens after menopause, a practice called hormone replacement therapy (HRT). Moderate alcohol consumption may increase estrogen levels in women receiving HRT, potentially affecting their risk for various adverse health effects. Two recent studies, however, provide no strong evidence for an effect of alcohol on hormones in postmenopausal women. The possible association between alcohol consumption and risk of cancer of the breast does not appear to be mediated by estrogens. Both estrogens and moderate alcohol consumption have been associated with a decreased risk for cardiovascular disease; however, alcohol’s beneficial effect on heart disease does not appear to …

Jam For Justice Holmes: Reassessing The Significance Of Mahon, William Michael Treanor Jan 1998

Jam For Justice Holmes: Reassessing The Significance Of Mahon, William Michael Treanor

Georgetown Law Faculty Publications and Other Works

When courts and commentators discuss Pennsylvania Coal Co. v. Mahon, they use the same word with remarkable regularity: famous. Mahon has achieved this fame in part because it was the occasion for conflict between judicial giants, and because the result seems ironic. Justice Oliver Wendell Holmes, Jr.--the great Lochner dissenter and a jurist generally considered a champion of judicial deference to legislatures in the sphere of economic decision-making--wrote the opinion striking down a Pennsylvania statute barring coal mining that could cause the surface to cave-in. Sharply dissenting from Holmes's opinion was his consistent ally on the Court, Justice Louis …

Federal Regulation Of Tobacco Products And Products That Treat Tobacco Dependence: Are The Playing Fields Level?, Joseph A. Page Jan 1998

Federal Regulation Of Tobacco Products And Products That Treat Tobacco Dependence: Are The Playing Fields Level?, Joseph A. Page

Georgetown Law Faculty Publications and Other Works

Company A is thinking about launching a traditional tobacco product, perhaps a cigarette or a smokeless tobacco confection, with a new ingredient, ingredient level, or ingredient mix that in the past has never been sold. Company B contemplates putting on the market an innovative medication, medical device, or dietary supplement intended to help consumers to free themselves from physical dependence on tobacco products. Company C ponders the possibility of introducing a smoking product whose novelty derives from express or implied marketing claims that the product will decrease or perhaps even eliminate physical dependence on tobacco, or reduce other risks associated …

Quantitative Methods For Assessing Change: Application To Condom Use, Kerry E. Evers Jan 1998

Quantitative Methods For Assessing Change: Application To Condom Use, Kerry E. Evers

Open Access Dissertations

This study attempts to understand more about how to quantitatively assess longitudinal change within the Transtheoretical Model applied to the area of condom use among college students. A total of 215 sexually active male and female undergraduate students completed both assessments one month apart. Measurement development was conducted on the Condom Use URICA scale, which was then used in a cluster analysis. A four cluster solution was reliably replicated across two random samples (R2=.99), and the clusters were then examined in terms of their external validity using MANOVAs. The four clusters showed significant differences on variables associated with …

The Contradictions Of Mainstream Constitutional Theory, Kimberlé W. Crenshaw, Gary Peller Jan 1998

The Contradictions Of Mainstream Constitutional Theory, Kimberlé W. Crenshaw, Gary Peller

Faculty Scholarship

For the last four decades, some form of "process" theory has dominated conventional constitutional theory, on the bench and in the academy. The organizing, usually implicit, background assumption is that the exercise of governmental power – whether by legislatures or courts – is to be tested for normative legitimacy against a set of procedures. Writing as critics of the basic framework of process theory, Professors Kimberli Crenshaw and Gary Peller discuss the contributions and constraints of a proceduralist constitutional law discourse. In light of direct democracy initiatives claiming the power of legislation, and a substantively conservative judiciary defining the "law," …

Physician-Assisted Suicide: The Problems Presented By The Compelling, Heartwrenching Case, Yale Kamisar Jan 1998

Physician-Assisted Suicide: The Problems Presented By The Compelling, Heartwrenching Case, Yale Kamisar

Articles

Now that the U.S. Supreme Court has upheld New York and Washington state laws prohibiting the aiding of another to commit suicide,2 the spotlight will shift to the state courts, the state legislatures and state referenda. And once again proponents of physician-assisted suicide (PAS) will point to a heartwrenching case, perhaps the relatively rare case where a dying person is experiencing unavoidable pain (i.e., pain that not even the most skilled palliative care experts are able to mitigate), and ask: What would you want done to you if you were in this person's shoes?

On The Meaning And Impact Of The Physician-Assisted Suicide Cases. (Symposium: Physician-Assisted Suicide: Facing Death After Glucksberg And Quill), Yale Kamisar Jan 1998

On The Meaning And Impact Of The Physician-Assisted Suicide Cases. (Symposium: Physician-Assisted Suicide: Facing Death After Glucksberg And Quill), Yale Kamisar

Articles

I read every newspaper article I could find on the meaning and impact of the U.S. Supreme Court's June 1997 decisions in Washington v. Glucksberg' and Vacco v. Quill.2 I came away with the impression that some proponents of physician-assisted suicide (PAS) were unable or unwilling publicly to recognize the magnitude of the setback they suffered when the Court handed down its rulings in the PAS cases.

Racial Disparities In The Delivery Of Health Care, Barbara A. Noah Jan 1998

Racial Disparities In The Delivery Of Health Care, Barbara A. Noah

Faculty Scholarship

This Article focuses on the role of conscious and unconscious racial bias in the delivery of care; it does not begin to address the larger issue of inadequate access to care at the outset. Improving access to health care for minorities will undoubtedly have a positive effect on these groups' overall health status; however, to the extent that racial bias in the delivery of care exists apart from problems of inadequate access, the disparity in health status between whites and African Americans will no doubt continue.

Part II of this Article describes racial disparities in a variety of health care …

Environmental And Occupational Exposure To Ultraviolet Radiation And Associated Health Risks, Thomas Daniel Tenkate Jan 1998

Environmental And Occupational Exposure To Ultraviolet Radiation And Associated Health Risks, Thomas Daniel Tenkate

All ETDs from UAB

Ultraviolet radiation (UVR) is produced by many sources, and for most people the sun is their main source of exposure. In the occupational environment there are also many artificial sources, of which welding arcs are the predominant and most intense. This dissertation represents a synthesis and interpretation of information (both empirical and review) that is contained in five journal articles. These articles address personal exposure, evaluation and control of UVR from both natural and artificial sources, and in particular exposure to UVR from welding arcs. This research has shown that workers in a welding environment have personal exposures to UVR …

Income Distribution And Health Outcomes: An Assessment Of The Role Of Poverty, Donna Rickert Jan 1998

Income Distribution And Health Outcomes: An Assessment Of The Role Of Poverty, Donna Rickert

All ETDs from UAB

Objective. To evaluate the relationship between relative and absolute income in the context of their respective influence on 10 measures of health status at the American county level. Setting. The 67 counties of the state of Alabama. Design. Cross-sectional ecological study. Relative income, i.e., income inequality, was indexed as the percentage of total household income received by the least well off 50% of households. Absolute income was indexed as the percentage of households below the federal poverty level. These two income measures, calculated for each county from 1990 census data, were used to specify and estimate a series of regression …
