The Declaration Of Independence In Constitutional Interpretation: A Selective History And Analysis, Charles H. Cosgrove

In 1845, antislavery constitutionalist Lysander Spooner argued that the Declaration of Independence was originally a legal constitution with a direct bearing on how one ought to interpret the status of slavery under the Constitution of 1787. In 1889, the congressional act establishing the states of North Dakota, South Dakota, Montana, and Washington required that their state constitutions "not be repugnant to the Constitution of the United States and the Declaration of Independence," as if the two documents were of a piece. Leaving The Door Ajar: The Supreme Court And Assisted Suicide, Melvin I. Urofsky

In June, 1997, the Supreme Court ruled that a constitutional right to assisted suicide exists in neither the Due Process nor the Equal Protection Clauses of the Fourteenth Amendment. But while a federal right does not exist, the Court made it quite clear that the states had ample leeway in which to fashion law on this issue; moreover, the concurring opinions of five Justices strongly implied that, should the states enact legislation that would severely limit end-of-life choices, the Supreme Court would revisit the issue. Mlb V. Slj: "Equal Justice" For Indigent Parents, Jason T. Jacoby

The United States Supreme Court recently decided that a state may not, consistent with the Due Process and Equal Protection clauses of the Fourteenth Amendment, condition appeals from trial court decrees terminating parental rights on the affected parent's ability to pay record preparation fees. In M.L.B. v. S.L.J., the Supreme Court found that, just as a state may not block an indigent petty offender's access to an appeal afforded others, Mississippi may not deny M.L.B., because of her poverty, appellate review of the sufficiency of the evidence on which the trial court found her unfit to remain a parent.

In the past three decades, the realm of environmental law in many Western countries, and internationally, has grown from a small baby crying for attention to a full-fledged, articulate adult, participating in a wide variety of international, regional, and national fora concerning the protection of the environment and the management of our natural resources. More recently, in many non-Western countries and especially in Asia, environmental law has begun to enter into adulthood, manifested by significant legislative initiatives, judicial activism and a resulting environmental jurisprudence, and the establishment and growth of environmental and resource management agencies.

Rose Ausländer was born Rosalie Beatrice Scherzer on 11 May 1901 into a German-speaking Jewish family. She spent her childhood in Czernowitz, the capital of Bukovina, a province of the Austro-Hungarian Empire. After World War I, Bukovina was incorporated into Romania, and at the end of World War II was annexed by the Soviet Union. Rosalie Scherzer studied literature and philosophy at the university in Czernowitz but never completed a degree, largely because of the family's poverty after her father's death in 1920. To help alleviate this economic situation, she emigrated to the United States in 1921 with lgnaz Ausländer. …

Portrait Of Success: A Situational Analysis Case Study Of Students Challenged By Attention-Deficit/Hyperactivity Disorder, Sandra Hundley Zimmermann

This study examined factors that encouraged and supported academic success for students diagnosed with Attention-Deficit/Hyperactivity Disorder (ADHD). Students with ADHD are often not academically successful and do not graduate from high school, due in large measure to ADHD symptoms of (a) impulsive and reckless behaviors, (b) alienation from significant others including peers, and (c) disorganization. Students in this study overcame symptoms of ADHD and were academically successful.

The situational analysis case study design for this research utilized both qualitative methods (interview, observation, and record review) and quantitative instrumentation. Five students with ADHD comprised the case study sample. Data from student, …

OBJECTIVE: We describe results from 284,503 mammographic examinations and associated diagnostic workups provided to medically underserved women in an ongoing nationwide breast cancer early detection program. MATERIALS AND METHODS: We report the results of mammographic examinations and diagnostic workups on 230,143 medically underserved women 40 years old or older who underwent at least one mammographic examination from July 1991 through June 1995. Mammograms were obtained in hundreds of mammography and clinical facilities throughout the United States, including community health centers, health department clinics, private practitioners' offices, university based facilities, and mobile mammography units. Marketing research has indicated that generational data can be very helpful. Generational factors provide a framework for understanding the marketplace. What Is A Vessel - A Three Prong Approach, Jeff Nemerofsky

Cleveland State Law Review

In the context of United States admiralty law, the definition of the word "vessel" has different meanings depending upon which statute has jurisdiction, the nature of the circumstances, and the characteristics of the person involved. There is no settled definition of the word. The Jones Act is a statute designed to cover seamen injured by the negligent acts of their employer, and is indicative of other admiralty statutes which, by their lack of a specific definition of the word "vessel," have created controversy in the judicial system.
