Mr. Eck and Mr. Bovett examine the inequities and inconsis­tencies in Oregon dog control laws and due process concerns arising from them. The authors outline constitutional require­ments that need to be enforced to ensure protection against unreasonable government actions in cases involving these laws.

Recovery Of Common Law Damages For Emotional Distress, Loss Of Society, And Loss Of Companionship For The Wrongful Death Of A Companion Animal, Steven M. Wise

Animal Law Review

Mr. Wise analyzes experiential recognition of the bond that ex­ists between human companions and companion animals in the context of possible recovery of tort damages for the wrongful death of a companion animal. He demonstrates that companion animals are often seen by their human companions as members of the family (holding much the same status as children). He discusses historical aspects of the common law as they relate to current tort law in such cases and examines the tension that exists between principle and policy.

Section 870 of the Restatement (Second) of Torts provides a method by which a court might extend private intentional tort rights to nonhuman animal plaintiffs. Given our current scien­tific and experiential understanding of many species, com­bined with existing court procedures to ease administrability, such an extension of tort law is mandated.

Composition And Change Of Maritime Hammock Flora In East-Central Florida After 20 Years, Donald John Spence

Retrospective Theses and Dissertations

The vegetation of eight east-central Florida maritime hammocks studied in 1997 were compared to similar data collected over 20 years ago. Study sites are located in the northern half of the Indian River Lagoon system mostly within Canaveral National Seashore and Merritt Island National Wildlife Refuge. The upland hammock vegetation throughout the state generally has an oak-palm association, but here these species dominate. Results show that sabal palm, live oak, laurel oak, and pignut hickory, the four dominant tree species in 1976-77, are still dominant in 1997; however, there has been a loss in tree species richness. The problem of "decision making in the face of uncertainty" is how to regulate on the basis of incomplete information that has significant potential to be inaccurate. My primary goal is to clarify some aspects of such decision-making through surveying types of uncertainty inherent in information. I present a taxonomy for kinds of inherent uncertainty - a classification and description of the "faces"of uncertainty. A second goal is to identify which kinds of uncertainty can and cannot now be measured quantitatively.

A contextual assumption is that we need to evaluate decision rules for dealing with faces of uncertainty. As a …

The purpose of this research paper is to help policy-makers compare environmental interests to non-environmental interests. It involves calculating use and non-use values for a preserve—Nachusa Grasslands. Use values consist of direct values. Non-use values are indirect, option and existence values. The total value, containing only direct, option and existence values, is divided by the total costs of operating the preserve to determine a ratio (Dzurik and Theriaque 1996: 128). Narrative abilities have been shown to be highly correlated with academic success in children. Inferencing, one form of narration, has not been researched in children under the age of six. Information about inferencing abilities in children is important because is could help with the early identification of a language deficiency. This study was designed to help determine at what age children begin to infer information. Although medical technology has created many possibilities for increasing the quality and duration of life in many cases, its use must be appropriately and cautiously implemented. In Kenya, adolescent girls fare poorly relative to boys in an educational system characterized by enormous growth, deteriorating quality, and rising costs. Girls are more likely than boys to drop out of school prematurely and are less likely to do well on the primary school leaving exams that come at the end of grade eight. Using data from nearly 600 adolescents aged 12-19 in combination with data collected from 36 primary schools in which those adolescents reside, this paper investigates the effect of school quality on the likelihood of dropping out from primary school in three districts of Kenya. Demographers have known since the 1940s that standard measures of period fertility, such as the widely used total fertility rate, are distorted by changes in the timing of childbearing. Period fertility rates are depressed during years in which women delay childbearing and inflated in years when childbearing is accelerated. This problem is usually ignored because there has been no generally accepted method for solving it. This study proposes a method for removing the tempo distortions from the total fertility rate. Five categories of possible government influence on a nation’s fertility are explored: (1) through publicly funded programs that explicitly seek to affect family-size outcomes (2) through the legal order and system of public administration (3) through measures that affect economic opportunity, social mobility, and gender relations; (4) through public-sector expenditures and transfer payments keyed to age or family status; and (5) through the state’s supplanting of local beliefs and traditions with the symbols of national identity and through the parallel expansion of cultural frames of reference. This is the first of several editions of Quality/Calidad/Qualité that describe methodologies designed to assist family planning program managers and staff to self-assess the quality of services they are providing. These tools give program sponsors an opportunity to identify shortfalls in their service environment and propose solutions. This issue focuses on AVSC International's COPE (client-oriented, provider-efficient) methodology, a self-assessment tool that has now been used in 35 countries around the world.
