A One Term Tort Reform Tale: Victimizing The Vulnerable, Andrew F. Popper

During its spring 1997 term, Congress passed the Volunteer Protection Act and considered but did not pass the Biomaterials Access Assurance Act of 1997. The Volunteer Protection Act provides a wide range of tort immunities to volunteers working for charitable organizations. The Biomaterials Access Assurance Act would have provided tort immunity to biomaterials producers. In this Article, the author examines the origins and possible implications of both these tort reform proposals from a class-based perspective and within the broader context of the ongoing tort reform debate. Salvaging The Welfare State?: The Prospects For Judicial Review Of The Canada Health And Social Transfer, Lorne Sossin

The Canadian Health and Social Transfer ("CHST"), which came into force on April 1, 1996, contains no national standards relating to the quality of social welfare. The goal of this new transfer was to promote provincial flexibility in the sphere of social policy. The author argues that this flexibility may undermine the core of the Canadian welfare state. Given the preoccupation of the provincial and federal governments with devolution, welfare recipients must turn to the judiciary to determine the "bottom line" of the welfare state. Intentional Changes In Sound Pressure Level And Rate: Their Impact On Measures Of Respiration, Phonation, And Articulation, Christopher Dromey, Lorraine Olson Ramig

The purpose of the study was to compare the effects of changing sound pressure level (SPL) and rate on respiratory, phonatory, and articulatory behavior during sentence production. Ten subjects, 5 men and 5 women, repeated the sentence, "I sell a sapapple again," under 5 SPL and 5 rate conditions. From a multi-channel recording, measures were made of lung volume (LV), SPL, fundamental frequency (F0), semitone standard deviation (STSD), and upper and lower lip displacements and peak velocities. Loud speech led to increases in LV initiation, LV termination, F0, STSD, and articulatory displacements and peak velocities for both lips. Token-to-token variability …

Our subject, whether the religion clauses of the federal constitution should be amended, goes to the heart of relations between government and the practice of religion in our society. These relations deeply affect the health of both religion and government. When public officials persecute some religions and embrace others, the risks are political tyranny and rigid, unthinking, unfeeling, vapid religion. No one wishes that fate for us.

When most people ask whether the religion clauses should be amended, they are really asking whether judicial interpretations have become so misguided that Congress and state legislatures should intervene and invoke the cumbersome …

Peter Herzog's career-long interest in the European Communities makes it especially appropriate to include in this festschrift a contribution on what has become the principal mechanism for reforming the treaties that constitute those Communities. I refer of course to the "intergovernmental conferences," or "IGCs" for short. As this festschrift goes to press, the fifteen Member States are submitting the results of the latest IGC – the 1997 Treaty of Amsterdam – to their respective national ratification processes.

In recent years, crime and public housing have been closely linked in our political and popular cultures. Tragic episodes of violence have reinforced the notion that public housing is a milieu with rates of victimization and offending far greater than other locales. However, these recent developments belie the complex social and political evolution of public housing from its origins in the 1930s, through urban renewal, and into the present.

Stereotypes abound about public housing, its management, residents, and crime rates. In reality, variation is the norm, and it is these variations that affect crime. The study of crime in public …

Environmental Regulatory Influence And Product Innovation: The Contingency Effects Of Organizational Characteristics, Carol M. Sanchez, William Mckinley

This paper examines the relationship between environmental regulatory influence and product innovation in a multi-industry sample of manufacturing organizations. Our theory argues that the influence of environmental regulation on the level of product innovation in a manufacturing organization is at least partially contingent on the organization's internal characteristics -- in particular, its structural flexibility and production process flexibility. Hypotheses are derived from our theory and tested, and the results are consistent with the conclusion that structural flexibility and production process flexibility moderate the environmental regulatory influence-product innovation relationship. Financing intangible intellectual property in Canada presents some novel demands on lenders because of the interaction of provincial security schemes with federal intellectual property legislation. This article looks at the relative ease with which security interests in intangible property may be obtained under provincial personal property security regimes, and then at the various federal intellectual property statutes which exhibit more of a piecemeal approach to financing. In addition, a number of constitutional issues arise because of this jurisdictional split, and the article explores these issues, comparing the situation in Canada with that in the United States. Until recently, few have questioned the notion that the separation of uses in land use zoning is inherently correct. Many observers of the city are now suggesting that zoning, as it has been practiced in this country over the last 80 years, has created cities that are fractured and function poorly. Others propose that zoning should be reconsidered as a remedy for urban dysfunction. They suggest that the whole notion of zoning be rethought.

Problem . Fathers have been assumed to play an important role in the socialization and education of their children. The need to understand the influence and the role of effective fathers becomes especially important in a generation which views fatherlessness as one of the most harmful demographic trends. The Seventh-day Adventist Church considers fatherhood vital for the normal functioning of the family. The present study investigated how selected variables from family background, demographics, and characteristics of present family are related to fathering as measured by self-report of fathering dimensions, practices, and satisfaction.
