The purpose of this investigation was to determine if death education has an impact on children's understanding of death. This study was a non-randomized trial of a single educational session on death concepts of 38 second grade children (mean age 7.78 years). The Smilansky Death Concept Questionnaire, a validated and published interviewing tool, was administered pre and post intervention to all study subjects to evaluate their understanding of death. Quality Nursing Care: The Nursing Home Residents' Perspective, Brenda L. Larsen Jan 1998

Quality Nursing Care: The Nursing Home Residents' Perspective, Brenda L. Larsen

Masters Theses

The purpose of the study was to determine what nursing home residents consider quality nursing care. The information obtained can provide nurses with knowledge about quality care perceptions in this population. Care thus could be planned and provided that would promote resident centered quality.

For this qualitative study a phenomenological approach was used. The investigator collected data via audio-taped interviews and field note observations. A grounded theory approach was used to uncover residents' perceptions of quality nursing care. The meaning was then disclosed by the process of description and thematic interpretation.

The shared experience of living in a nursing home …

Family Generativity And Generative Counseling: Helping Families Keep Faith With The Next Generation, David C. Dollahite, Brent D. Slife, Alan J. Hawkins

Faculty Publications

Counselors who are concerned with strengthening and healing relationships between generations can draw on the concept of generativity to assist them. This chapter invites counselors to grant a more prominent place for generativity in clinical work with families by (a) presenting the concept of family generativity as a logical extension of the generativity concept and (b) presenting some initial ideas on the new approach to clinical work designed to help families develop and sustain family generativity, which we call generative counseling. Generative counseling is illustrated by use of a clinical example, which is introduced briefly in a subsequent section …

Legal Ethics For A Fragmented Society: Between Professional And Personal, Allan C. Hutchinson Jan 1998

Legal Ethics For A Fragmented Society: Between Professional And Personal, Allan C. Hutchinson

Articles & Book Chapters

The legal profession has never been much loved. From Plato through Charles Dickens to Tom Wolfe, literature attests eloquently to its impugned status. As much envied as reviled, the reputation and prestige of lawyers is now considered by many to be at an all-time low. Its image as a noble and honourable profession is in tatters. Society tends to view lawyers as a rich and elite profession that is more interested in its own pocketbook than the public interest. The number of savage jokes about lawyers would be funny if they did not touch a raw nerve: after all, humour …

What Is Learned About Nontarget Items In Simple Visual Search?, John H. Flowers, Karen L. Smith Jan 1998

What Is Learned About Nontarget Items In Simple Visual Search?, John H. Flowers, Karen L. Smith

Department of Psychology: Faculty Publications

Human sensitivity to correlational structure between nontargets and likelihood of target presence in a visual letter-search task were studied in two experiments. In each of these experiments, the performance of subjects for whom the nontarget information was altered in the final trial block was compared with the performance of subjects for whom the nontarget information did not change. When stimulus strings were presented individually on a computer screen and subjects were required to make a yes–no decision about target presence (Experiment 1), the change in nontarget structure resulted in increased reaction times for target-absent trials. When subjects searched simultaneously for …

Reforming Child Custody And Access Law In Canada: A Discussion Paper, Brenda Cossman, Roxanne Mykitiuk

Articles & Book Chapters

In March 1993, the Department of Justice, Canada, published and circulated a public discussion paper on child custody and access. Building on the public responses generated by the 1993 paper and more recent public and political responses to the reform of federal child support law, the Department has been attempting to clarify its approach to developing reforms to the law and practice of custody and access. We have identified seven issues that are in need of further debate and consideration: (I) finalizing the basic objectives and principles of child custody law, (II) identifying the features of a child focused approach, …

Welfare "Reform": Com'in' Up On The Rough Side Of The Mountain, Loretta J. Williams, Roland Ward, Attieno Davis

The Journal of Sociology & Social Welfare

Through the lens of an innovative community-university partnership in the Greater Boston region, the authors analyze how welfare reform organizing overtook a resident-driven empowerment project. Since a major goal of the Chelsea/Dudley Partnership in MA is to support residents in exerting greater power over the practices and policies of community agencies, projects have been initiated in the city of Chelsea and the Dudley neighborhood of Boston to organize, and to strengthen, low income women by training them as welfare advocates. This paper examines how the efforts evolved, and how the community and the university partners are playing a key role …

Practicing Criminal Law: A Jewish Law Analysis Of Being A Prosecutor Or Defense Attorney, Michael J. Broyde Jan 1998

Practicing Criminal Law: A Jewish Law Analysis Of Being A Prosecutor Or Defense Attorney, Michael J. Broyde

Faculty Articles

Our secular society cycles as to whether it glorifies defense attorneys or prosecutors. Sometimes, we adore defense attorneys -- they are the lawyers who ensure that innocents are not punished, "L.A. Law" is the show to watch, and the attorneys to imitate. Other times, we revere prosecutors -- they are the lawyers who punish evildoers, "Law and Order" is the show to watch, and the attorneys to imitate. Jewish tradition recognizes the inherent ethical difficulties with the conduct of both types of attorneys.

Jewish law recognizes that the societal imposition of the criminal justice system on citizens, who otherwise function …

Full Faith And Credit And The Equity Conflict, Polly J. Price Jan 1998

Full Faith And Credit And The Equity Conflict, Polly J. Price

Faculty Articles

As this Article relates, the current problem with interstate enforcement of injunctions and other equitable decrees is illustrated by the Court's confusion in Baker. The Court reached the correct result in the case before it, but the basic problems of "equity conflict" remain unresolved. Both the Court's opinion and the two concurrences were unsatisfactory because the Court failed to address the key underlying issue of whether or to what extent courts may rely on state law to enjoin extraterritorial conduct. Had the Court focused on this issue, I argue, it could have based its decision upon a more appealing rationale. …

Cloning People: A Jewish Law Analysis Of The Issues, Michael J. Broyde Jan 1998

Cloning People: A Jewish Law Analysis Of The Issues, Michael J. Broyde

Faculty Articles

This Article is an attempt to create a preliminary and tentative analysis of the technology of cloning from a Jewish law perspective. Like all preliminary analyses, it is designed not to advance a rule that represents itself as definitive normative Jewish law, but rather an attempt to outline some of the issues in the hope that others will focus on the problems and analysis found in this Article and will sharpen or correct that analysis. Such is the way that Jewish law seeks truth.

In the case of cloning-as with all advances in reproductive technology- the Jewish tradition is betwixt …

Who? What? When? Where? Personal Jurisdiction And The World Wide Web, Yvonne A. Tamayo Jan 1998

Who? What? When? Where? Personal Jurisdiction And The World Wide Web, Yvonne A. Tamayo

Richmond Journal of Law & Technology

Almost everyone, it sometimes seems, is "working on a Web site." The Internet, a seamless web of communication, has broken down barriers of distance and time among people. At the same time it has made increasingly porous the conventional boundaries between the tangible and the abstract. Many business entities have created their own World Wide Web pages on the Internet, in order to deliver their advertising messages instantaneously to potential customers anywhere in the world. Increasingly, lawsuits are being filed against these businesses engaged in electronic commerce.

Compuserve V. Patterson: Creating Jurisdiction Through Internet Contacts, Cheryl L. Conner Jan 1998

Compuserve V. Patterson: Creating Jurisdiction Through Internet Contacts, Cheryl L. Conner

Richmond Journal of Law & Technology

Throughout American legal history the adequacy of traditional jurisprudence has been tested by technological developments. The creation and expanded use of the Internet is the latest of these advancements. There are, however, characteristics of the Internet that distinguish it from past technological breakthroughs. These features include the difficulty of defining the Internet in traditional terms, the plethora of the contacts taking place, and the speed at which the Internet is expanding.

Congress And Deregulation: Federal Legislative Issues Past, Present And Future., Bill Robinson, Richard W. Blackburn, S.M. Henry Brown Jr., Mark C. Darrell

Richmond Journal of Law & Technology

I am Bill Robinson, and I am pinch-hitting for Mark La Fratta. Mark did something that caused him to have to go to Gary, I am not sure what it is. Perhaps, Mr. Brown will be able to tell us later on. In any event, it is a pleasure to be here. A couple of Saturdays ago, I was out sailing in an old boat I have, and we had wonderful winds. We were wasting in an area on the Rappahannock that I was not very familiar with, and we were just about to make our last tide in the …

Introductory Remarks And Keynote Speaker Address, Edward L. Flippen, Derek R. B. Bevan

Richmond Journal of Law & Technology

In other industries, experts may see up to four issues a day, but for us, the Conference is an opportunity to share ideas with colleagues, regulators, and others who shape national regulatory policy. For that reason, we have built into our schedule a formal gathering to discuss these issues, and we trust that all of you will take advantage of this meaningful opportunity. Of course, we have to thank Tony Gambardella and his committee for putting on such a wonderful program today, and I am pleasantly surprised that this conference is a joint- venture opportunity with the State Corporation Commission …

Dangerous Crossing: State Brownfields Recycling And Federal Enterprise Zoning, Michael Allan Wolf Jan 1998

Dangerous Crossing: State Brownfields Recycling And Federal Enterprise Zoning, Michael Allan Wolf

Law Faculty Publications

Urban policymakers over the past two decades have engineered a curious and potentially dangerous intersection of late 20th Century policies designed to foster the rebirth of America's distressed urban regions. First, we find widespread enthusiasm about the potential for reusing brownfields 1 (typically contaminated urban sites), which has stimulated an impressive range of initiatives at all levels of government. 2 Second, after more than a decade of sitting on the sidelines and watching the states battle over the ideal range of incentives that will most effectively drive inner-city redevelopment, the federal government finally entered the fray in the 1990s with …

Natural Resources And The Ninth Circuit Split, Carl W. Tobias Jan 1998

Natural Resources And The Ninth Circuit Split, Carl W. Tobias

Law Faculty Publications

Congress recently considered some proposals to split the Ninth Circuit, proposals that could have far-reaching effects on the environment, public lands, and natural resources. This Article first looks at some of the recent developments in Congress, particularly the authorization of a national study commission to examine the federal appeals courts. Professor Tobias predicts that the Ninth Circuit will be split during the next decade. He cautions against using political considerations to conduct legislative policymaking with respect to thefederal courts. He suggests that those concerned about the environment gather reliable information and explore alternatives to circuit-splitting. If Congress decides to bifurcate …

From Rio To Kyoto: A Study Of The Involvement Of Non-Governmental Organizations In The Negotiations On Climate Change, Chiara Giorgetti Jan 1998

From Rio To Kyoto: A Study Of The Involvement Of Non-Governmental Organizations In The Negotiations On Climate Change, Chiara Giorgetti

Law Faculty Publications

This Article analyzes the influence of non-governmental actors on the negotiations of the Framework Convention on Climate Change (FCCC or the Convention). In particular, it evaluates the methods employed by NGOs in furthering their substantive agendas, the interaction among various non-governmental actors, and the results of their efforts. This Article considers two kinds of NGOs: business and environmental. Environmental NGOs (ENGOs) are the self-defined representatives of environmental interests. They campaign for the strict reduction of all gases that induce climate change. On the other side, business NGOs (BNGOs) typically represent the interests of those industries that are involved in the …
