Gendered Aspects Of Migration: Law And The Female Migrant, Joan Fitzpartick, Katrina R. Kelly

UC Law SF International Law Review

Although female migrants share common goals and concerns, the gendered aspects of migration have been largely ignored by legislators and policy makers. This is illustrated by the regulation of migration for the purpose of performing domestic labor (the "maid trade") and migration to export processing zones, two predominantly female migration streams. The aim of this article is to expose the ways in which the legal regulation of migration reproduces and exacerbates the social and cultural inequalities that dis-empower female migrants. Are Same-Sex Prenuptial Agreements Enforceable In Florida? Posik V Layton, Law And Policy, Brett A. Barfield

St. Thomas Law Review

Posik v. Layton has Florida lawmakers, attorneys, and gay rights activists paying attention. The Supreme Court of Florida, however, declined to accept the invitation to sort out this muddled opinion from a murky area of the law. The dispute in Posik arose from a failed lesbian relationship between the parties, who had drafted a contract analogous to a prenuptial agreement. Under the contract, Layton would provide financial support for the pair, and Posik would provide domestic services and live the remainder of her life with Layton. An Evaluation Of The Causes Of Urban Poverty In America: A Cross Section Analysis, Juan Loredo

Masters Culminating Experiences (1993-2011)

In this study, I analyze and evaluate the determinants of poverty rate differentials among 77 urban centers in the United States, as described by Isabel Sawhill (1988). The regression results show that demographic changes, education, welfare programs, unemployment rates, per capita income and income inequality are the most important factors that have a strong statistical link to urban poverty rates. Based on my analysis, the crime rate is not a statistically significant determinant of the rate of poverty among American families.

This study was carried out in the Ankara Rehabilitation Centre over an eight month period. A total of 428 urine samples was collected from inpatients with long-term catheterization for diagnosis of bacteriuria. Urinary tract infection was detected in three hundreds and thirty-one samples. Escherichia coli was found to be the highest causative agent. Moreover in forty of these samples Providencia spp were determined as the fifth highest causative agent. This Providencia spp finding is important as it is the highest recorded in Turkey. Active oxygen species have been proposed to be involved in the aging process of the brain, therefore alterations in the activities of enzymes involved in the defense system against free radicals and other active species could substantially influence the aging process. The Measurement Of Sweat Intensity Using Anew Technique, M. Tunaya Kalkan, Ertugrul H. Aydemi̇r, Yunus Karakoç, M. Ali Körpinar

In this study, a new technique developed by us, called the "pad glove method" was used to measure sweat intensity in the palms of 15 patients with palmoplantar hyperhidrosis, and of 15 control subjects. Quantitative results in the hyperhidrosis group 2.1861±0.0836 grams/hour for the right hand and 2.2478±0.0961 grams/hour for the left hand, while in the control group were 0.3278±0.0419 grams/hour and 0.371±0.0501 grams/hours, respectively. The importance of bone marrow biopsy in Hudgkin's Disase is well known. The incidence of bone marrow involvement in Hudgkin's Disase varies from 2% to 29%. The presence of myelofibrosis is not sufficent evidence for a definitive diagnosis of bone marrow involment. Patients having myelofibrosis as a first symptom without pripherallympadenopathy must be distinguished from patients with idiopathic myelofibrosis. In this study, we examined the frequency of bone marrow involvement and the degree of myelofibrosis in Hudgkin's Disase. There is an ongoing controversy regarding shock wave lithotripsy (SWL) contraindicated during pregnancy (1, 2). While the effects of shock waves on a variety of cells in both clinical and experimental studies are well documented, their effects on the fetus remain to be clarified. In this study, we investigated the effects of SWL on the rat fetus. On the 8th, 11th, 14th and 17th days of pregnancy, 100, 250 or 500 shock waves were produced with a Multimed 2001 ELMED Systems Lithotriptor. The federal government of the United States developed a complex System of boarding schools for Native Americans in the 19(th) century. This effort was generally insensitive and often brutal. In spite of such brutality many students managed to negotiate and create new understandings of traditions and cultural autonomy while in such schools. Now, however, some former students remember their lives as students with mixed emotions. Drawing on oral history interviews and public official documents, the author examines the recreational and athletic life at the boarding schools and finds that students were, nevertheless, able to experience pleasure and pride in creating …

Junk Science - The Lawyer's Ethical Responsibilities, Dick Thornburgh

This article argues that many judges lack the capacity to distinguish between experts witnesses who make use of rigorous scientific research and those who rely on "junk science" - conclusions based on insufficient research. It notes that judicial standards for admissibility of expert testimony are not sufficient to prevent the introduction of junk science in to the courtroom. It concludes with a suggestion for a more rigorous process for vetting scientific evidence that is admitted in court.

Walking A Tightrope: Redrawing Congressional District Lines After Shaw V. Reno And Its Progeny, Donovan L. Wickline

The Supreme Court's decision in Shaw V. Reno forbade the drawing of congressional district lines so that minorities would make up a larger percentage of the voting population. This note explores the tension between this ruling and the section of the Voting Rights Act requiring that minorities be fully represented within their congressional districts. It argues that the two rulings do not necessarily conflict. It concludes that the Court should clarify the meaning and role of "compactness" in redistricting and provide guideposts for legislators litigants, and courts involved in the reapportionment process.

Age-related decline in intellectual abilities is domain-specific; that is, whether older adults show decreased intellectual performance depends on the type of ability being assessed (Foster & Taylor, 1920; Horn & Cattell, 1967; Kaufman, Reynolds & McLean, 1989; Sattler, 1982). Specifically, verbal abilities tend to decrease with older age (Botwinick, 1977; Cornelius, 1984; Horn & Cattell, 1967; Lachman & Jelalian, 1984). This prevalent finding has been labeled the "classic aging pattern" (Botwinick, 1977). Beyond mere descriptions, however, researchers have begun addressing explanatory mechanisms that underlie age patterns of intellectual decline, maintenance, and growth.
