This research purports to answer the question "What results may be derived from a classroom study of family history?" From a review of literature by four score teachers, administrators, and curriculum theorists, Hayes has elicited claims of 65 specific results in eight different categories. The quoted authors perceived that the classroom study of genealogy and family history: (1) Affects in positive ways how students feel about non-family history; (2) Promotes the learning of several disciplines related to history; (3) Reveals the interconnectedness of human society, and encourages multiracial and multicultural understanding; (4) Improves scholastic skills; (5) Builds students' sense of …

[Introduction To] Honey, Hush! An Anthology Of African American Women's Humor, Daryl Cumber Dance
Bookshelf
The vibrant humor of African American women is celebrated in this bold and unique collection that the Miami Herald describes as "breathtakingly broad and deep."
In this "dazzling anthology" (Publishers Weekly), Daryl Cumber Dance has collected the often hard-hitting, sometimes risqué, always dramatic humor that arises from the depth of black women's souls and the breadth of their lives. The eloquent wit and laughter of African American women are presented here in all their written and spoken manifestations: autobiographies, novels, essays, poems, speeches, comic routines, proverbial sayings, cartoons, mimeographed sheets, and folk tales. The chapters proceed thematically, covering …

Global Labor Rights And The Alien Tort Claims Act, Sarah H. Cleveland
Global Labor Rights And The Alien Tort Claims Act, Sarah H. Cleveland
Faculty Scholarship
Are labor rights human rights? Are some worker rights so fundamental that must be respected by all nations, and all corporations, under all circumstances? If so, who has the authority to define such rights, and how should they be enforced? What is the effect on the global economy of enforcing international worker rights? These are some of the questions confronted by the authors of Human Rights, Labor Rights, and International Trade, a compilation of essays by an international group of scholars, labor rights activists, and corporate executives addressing contemporary topics in the dialectic among labor, trade, and human rights.
Truth In Codification, George P. Fletcher
Truth In Codification, George P. Fletcher

Some men think that the earth is round, others think it flat; it is a matter capable of question. But if it is flat, will the King's command make it round? And if it is round, will the King's command flatten it?
These are the words of Thomas More as interpreted by Robert Bolt in his play A Man for All Seasons. More invokes the issue of scientific truth to question Parliament's authority to determine whether King Henry VIII should be recognized as the head of the Church of England. The point is well taken. When the issue is scientific …
Dogmas Of The Model Penal Code, George P. Fletcher
Dogmas Of The Model Penal Code, George P. Fletcher
Faculty Scholarship
The Model Penal Code has become the central document of American criminal justice. It has had some effect on law reform in over 35 states. More significantly, it provides the lingua franca of most people who teach criminal law in the United States. Most academics think that the precise definitions of culpability states in section 2.02(2) are really neat, and they applaud the liberal rules that restrict the use of strict liability to administrative fines. Indeed, all things considered, for a code drafted with almost total indifference to what might be learned from European models, the Model Penal Code is …
Hands Off! Civil Court Involvement In Conflicts Over Religious Property, Kent Greenawalt
Hands Off! Civil Court Involvement In Conflicts Over Religious Property, Kent Greenawalt
Faculty Scholarship
In this Article, Professor Kent Greenawalt explores how civil courts can constitutionally resolve conflicts over religious property. Although the practical and theoretical significance of this part of First Amendment law has often been overlooked, issues concerning church property continue to raise difficulties for both the courts charged with their resolution and the church members who wish to avoid the courts' intervention entirely. This Article argues that the general approach of noninvolvement that the Supreme Court has advocated in this area is consonant with broader themes in religion clause adjudication. Within this more general approach, Professor Greenawalt considers the two alternative …
The Great Transformation Of Regulated Industries Law, Joseph D. Kearney, Thomas W. Merrill
The Great Transformation Of Regulated Industries Law, Joseph D. Kearney, Thomas W. Merrill
Faculty Scholarship
The nation's approach to regulating its transportation, telecommunications, and energy industries has undergone a great transformation in the last quarter-century. The original paradigm of regulation, which was established with the Interstate Commerce Act's regulation of railroads beginning in 1887, was characterized by legislative creation of an administrative agency charged with general regulatory oversight of particular industries. This approach did not depend on whether the regulated industry was naturally competitive or was a natural monopoly, and it was designed to advance accepted goals of reliability and, in particular, non-discrimination. By contrast, under the new paradigm, which is manifested most clearly in …

When I was living in New Haven a number of years ago, a miracle happened that drew people by the thousands to witness evidence of the Divine. A crucifix had been found to appear in the body of an oak tree in the middle of Worchester Square. I went – after all, how often do you get to see that kind of thing? Not surprisingly, at first I couldn't see anything but the usual trunk and limbs of a tree. Yet a believer took the time to show me what was really there, something that my untrained eye could not …

Identification Of Factors That Influence Physician Generated Referrals To Hospice Programs, Cheryl A. Hoerner
Dissertations and Theses @ UNI
The hospice movement is just over 20 years old in this country. Hospice programs are dependent on physicians to educate and refer their terminal patients to hospice care. The purpose of this study was to identify factors which influence physicians in rural Iowa to refer terminal patients to selected hospice programs. The study involved Medicare-certified hospice programs and non-certified programs located in rural communities in Iowa. One hundred and fifty licensed physicians were randomly selected to complete a 14-item questionnaire. A total of 86 questionnaires were returned. The survey tool addressed demographic information, as well as identifying factors that influenced …
President Clinton And The Rhetoric Of Time, Estrella Cedeno
President Clinton And The Rhetoric Of Time, Estrella Cedeno
Dissertations and Theses @ UNI
This study analyzes President's Clinton 1993 and 1997 inaugural addresses, and his use of time as a rhetorical strategy. Influenced by his situational constraints and based on a definition of the situation that emphasizes time as a paramount element, Clinton is able to articulate an inaugural rhetoric that instead of being passive and contemplative calls for action. In so doing, Clinton's inaugurals finds its uniqueness. I contend that Clinton's rhetoric of time gives meaning to the transformations of the post-industrial revolution and also serves as a form of social control.
