Evidence In The Global Village: The Promise And Challenge Of Computer-Assisted Research In Intercollegiate Debate, Pat J. Gehrke

Faculty Publications

The growing importance of research databases and the proliferation of evidence sources on the Internet have provoked responses from the debate community ranging from ecstatic hope to pronounced fear. The debate community should critically incorporate databases and the Internet into its research. The benefits of computer-assisted research are plentiful, if we can appropriately adjust as a community to the age of digitized research.

Rizal’S Morga And Views Of Philippine History, Ambeth R. Ocampo

History Department Faculty Publications

Antonio de Morga, lieutenant governor of the Philippines in the late sixteenth century, described the food of the indios as follows: Their daily fare is composed of: lice crushed in wooden pillars and when cooked is called morisqueta (this is the staple throughout the land); cooked fish which they have in abundance; pork, venison, mountain buffaloes which they call carabaos, beef and fish which they know is best when it has started to mt and stink (Retana 1909,174). Service-Learning Projects In Composition And Beyond, Thomas Deans, Zan Meyer-Goncalves Jan 1998

Service-Learning Projects In Composition And Beyond, Thomas Deans, Zan Meyer-Goncalves

Higher Education

All college teachers want their courses to be relevant and provocative, and to encourage students to be more active learners of the discipline, participants in the academy, and citizens in the wider community. As teachers of composition, we first experimented with combining community service with classroom teaching because it promised to advance teaching aims we value, especially making connections between academic courses and community needs, and between cognitive thinking and ethical social action. And we continue with service-learning projects because our experience and students' responses suggest a significant degree of success in meeting those goals. But we are certainly not …

Community Service-Learning In Teacher Education: A Report On Innovative Programs In New England, Beth Wohlleb, Robert Maloy Jan 1998

Community Service-Learning In Teacher Education: A Report On Innovative Programs In New England, Beth Wohlleb, Robert Maloy

Higher Education

As the strengths of community service-learning are becoming more recognized by educators at all levels, many institutions of higher education are incorporating CSL as a dynamic pedagogy into their teacher education programs. Many schools or departments of education encourage or require certification candidates to perform CSL as part of their teacher training as ways to learn about the teaching profession through the practice of teaching and reflection. Fewer schools integrate service-learning into their teacher education program in another way: by teaching preservice teachers how to use service-learning as a pedagogy with children in their own future classrooms. This second group …

Higher Education And Civic Responsibility, Alexander W. Astin Jan 1998

Higher Education And Civic Responsibility, Alexander W. Astin

Higher Education

It goes without saying that higher education plays a major part in shaping civic life in modern American society. Our colleges and universities not only educate each new generation of leaders in government, business, science, law, medicine, the clergy, and other advanced professions, but are also responsible for setting the standards and training the personnel who will educate the entire citizenry at the precollegiate level. Higher education institutions can also exert important societal influences through the scientific, technological, and cultural knowledge produced by their faculties. Building Bridges Iii - Personal Narratives, Incoherent Paradigms, And Plural Citizens, Berta E. Hernández-Truyol

UF Law Faculty Publications

This Essay, in three parts, explores bridge building among communities of color with the purposes of creating, maintaining, and developing alliances. The first part, Personal Narratives, shares with readers some cuentos (stories) as a method and path in which to position the lectors: to contextualize my frontiers and familiarize them with my daily travels through diverse and varied borderlands; the many communities with which I intersect and interact, and in which I live- all of them my communities; and in all of which I am both insider and outsider. Part II, Incoherent Paradigms, suggests that the prevailing race-based legal paradigms …

The Journal Of Jean Laffite: Its History And Controversy, Robert L. Schaadt Jan 1998

The Journal Of Jean Laffite: Its History And Controversy, Robert L. Schaadt

Provenance, Journal of the Society of Georgia Archivists

Whether defined as original order or the history of ownership, provenance is one of the guiding lights of the archival profession, the key that guarantees the validity of documents in the archives. Archival material is rarely questioned, and authorship is seldom a topic of intense discussion. One assumes that the signer of the letter penned it except when secretaries were known to have been employed. Perhaps as a profession, however, archivists are too trusting and rely too often on provenance as a guiding light.

New Criticisms Of The Libel-Proof Plaintiff Doctrine , Wayne M. Serra

This paper will explore the libel-proof plaintiff doctrine and examine it in light of traditional standing and jurisdictional principles. Part II of this paper discusses the origin of the libel-proof doctrine and its application. Part III explores the general requirements for diversity actions in the federal district courts, the application of state law to those actions, and the impact of the First Amendment on state libel law. Part IV discusses standing to sue principles and analyzes the libel-proof plaintiff doctrine in light of those principles. Part V discusses some criticisms of the libel-proof plaintiff doctrine. Finally, Part VI concludes that …

Will The Real Legislature Please Stand Up - A Response To Kulch V. Structural Fibers, Inc.: Clarifying The Public Policy Exception , Margaret M. Koesel, David A. Bell, Tracey L. Turnbull

Cleveland State Law Review

This Article briefly traces the history of the employment-at-will doctrine from its origins in the English common law through the present. It also examines the exceptions to this doctrine that have arisen during the twentieth century and, in particular, the "public policy" exception. Next, the Article analyzes how Ohio courts have narrowed the at-will doctrine since 1990. The Article then examines the Kulch decision and responds to a recent article that favorably analyzes Kulch. Finally, the Article concludes that this case is improperly decided because it usurps the right of the legislature to establish public policy in statutes and because …

Genetic Technology And Its Impact On Culpability For Criminal Actions , Marcia Johnson Jan 1998

Genetic Technology And Its Impact On Culpability For Criminal Actions , Marcia Johnson

Cleveland State Law Review

This article addresses only one issue, one which our judicial system ultimately must address: the criminal responsibility one will bear for committing a crime when the actions are determined by the actor's genetic make-up. Part I of the article traces the roots of genetic research from Darwinism to eugenics and Nazi racial purity theories. Part II reviews theories and studies which support the concept of genetic influence on social, particularly criminal, behavior. Part III considers the impact of the genetic revolution on our criminal justice system with special emphasis on the effect on our system's fundamental concept of free will. …

The Cy Pres Doctrine In The United States: From Extreme Reluctance To Affirmative Action, Frances Howell Rudko Jan 1998

The Cy Pres Doctrine In The United States: From Extreme Reluctance To Affirmative Action, Frances Howell Rudko

Cleveland State Law Review

Perhaps no legal principle illustrates the use of Fourteenth Amendment equal protection jurisprudence more poignantly than the relatively obscure cy pres doctrine. The ancient doctrine which allowed both courts and the Crown in England to change trust purposes when the original trust purposes proved no longer viable was adopted belatedly, sporadically and partially by jurisdictions in the United States. In Part I, the author illustrates how the United States jurisdictions differ from England in the requirement for charitable intent. Earlier cases reveal the United States, unlike England, has resisted relaxation of the requirement. In Part II, the author uses the …

The Tax Status Of Ohio Property Used For Low-Income Housing, Christopher P. Conomy Jan 1998

The Tax Status Of Ohio Property Used For Low-Income Housing, Christopher P. Conomy

Cleveland State Law Review

This Note argues that the rule denying property tax exemption to low-income housing units is improper. The rule is improper in three significant regards. First, as a matter of social and public policy, the rule is misguided, because it hinders the fulfillment of an important need in Ohio and in American society at large. Second, as a purely legal matter, the original rule denying exemption for these properties resulted as a mistaken application of the existing law regarding the definition of "charitable" use. The third, and most compelling reason, is that the legal basis underlying the original rule has undergone …

Roots/Routes As Arterial Connections For Art Educators: Advocating For Aboriginal Cultures, Rita L. Irwin Jan 1998

Roots/Routes As Arterial Connections For Art Educators: Advocating For Aboriginal Cultures, Rita L. Irwin

Journal of Social Theory in Art Education

Arterial and life connections for art educators. Arteries are muscular vessels carrying blood away from the heart to every part of the body, eventually bringing the blood back to the heart before venturing out again. Metaphorically, these pathways locate the heart as a home from which travel extends, repeatedly, expectantly as life itself. Symbolically, arterial connections pulsate with the notion of art, expressing art through life through art. To many people, and particularly Aboriginal peoples, art translated as cultural performance is found in the very pathways and bloodlines of their geographies and histories. However, these arterial connections are available to …

A Study Of The Attitudes Of Junior-High And Middle-Level Principals Toward Parent Involvement In Arkansas, Marian G. Lacey

Theses and Dissertations

The study is a replication of a study by Brittle (1994) that researched attitudes of elementary principals toward parent involvement in the Commonwealth of Virginia. The 1997 Arkansas study identified and analyzed the attitudes of middle-level and junior-high principals toward parental involvement. The population for the study consisted of all middle-level and junior-high principals in the state of Arkansas. Data were analyzed using descriptive and correlational statistics to answer the research questions. The study revealed how strongly Arkansas middle-level or junior-high principals believe in parent involvement. Information concerning the principals' perceived role in implementing and fostering parent involvement in their …
