Floral Sex Ratios And Gynomonoecy In Aster (Asteraceae), Robert I. Bertin, Maureen A. Kerwin Jan 1998

Floral Sex Ratios And Gynomonoecy In Aster (Asteraceae), Robert I. Bertin, Maureen A. Kerwin

Biology Department Faculty Scholarship

Gynomonoecy is the sexual system in which female and bisexual flowers occur on the same plant. This system has received little attention despite the considerable work on other plant sexual systems in the past few decades. Our study examines one hypothesized advantage of having two flower types on a plant, namely that this arrangement permits flexibility in allocation of resources to male and female reproductive functions. We examined 16 species of Aster (Asteraceae), a genus of gynomonoecious, perennial herbs. Plants in this genus produce heads consisting of a whorl of female flowers around a cluster of bisexual flowers. Among field-grown …

Practicing Criminal Law: A Jewish Law Analysis Of Being A Prosecutor Or Defense Attorney, Michael J. Broyde Jan 1998

Practicing Criminal Law: A Jewish Law Analysis Of Being A Prosecutor Or Defense Attorney, Michael J. Broyde

Faculty Articles

Our secular society cycles as to whether it glorifies defense attorneys or prosecutors. Sometimes, we adore defense attorneys -- they are the lawyers who ensure that innocents are not punished, "L.A. Law" is the show to watch, and the attorneys to imitate. Other times, we revere prosecutors -- they are the lawyers who punish evildoers, "Law and Order" is the show to watch, and the attorneys to imitate. Jewish tradition recognizes the inherent ethical difficulties with the conduct of both types of attorneys.

Jewish law recognizes that the societal imposition of the criminal justice system on citizens, who otherwise function …

Full Faith And Credit And The Equity Conflict, Polly J. Price Jan 1998

Full Faith And Credit And The Equity Conflict, Polly J. Price

Faculty Articles

As this Article relates, the current problem with interstate enforcement of injunctions and other equitable decrees is illustrated by the Court's confusion in Baker. The Court reached the correct result in the case before it, but the basic problems of "equity conflict" remain unresolved. Both the Court's opinion and the two concurrences were unsatisfactory because the Court failed to address the key underlying issue of whether or to what extent courts may rely on state law to enjoin extraterritorial conduct. Had the Court focused on this issue, I argue, it could have based its decision upon a more appealing rationale. …

Cloning People: A Jewish Law Analysis Of The Issues, Michael J. Broyde Jan 1998

Cloning People: A Jewish Law Analysis Of The Issues, Michael J. Broyde

Faculty Articles

This Article is an attempt to create a preliminary and tentative analysis of the technology of cloning from a Jewish law perspective. Like all preliminary analyses, it is designed not to advance a rule that represents itself as definitive normative Jewish law, but rather an attempt to outline some of the issues in the hope that others will focus on the problems and analysis found in this Article and will sharpen or correct that analysis. Such is the way that Jewish law seeks truth.

In the case of cloning-as with all advances in reproductive technology- the Jewish tradition is betwixt …

Aboriginal Title And The Division Of Powers: Rethinking Federal And Provincial Jurisdiction, Kent Mcneil Jan 1998

Aboriginal Title And The Division Of Powers: Rethinking Federal And Provincial Jurisdiction, Kent Mcneil

Articles & Book Chapters

The recent decision of the Supreme Court of Canada in Delgamuukw v. British Columbia calls for re-examination of a number of significant Aboriginal rights issues. The crucial role of oral histories in Aboriginal rights litigation was emphasized by the Court, and guidelines were laid down for trial judges to admit and give proper weight to that evidence. For the first time the Court addressed the vital issue of the content of Aboriginal title and provided direction on how that title can be proved. The Court also dealt with the constitutional protection accorded to Aboriginal title by s. 35(1) of the Constitution …

Salvaging The Welfare State?: The Prospects For Judicial Review Of The Canada Health And Social Transfer, Lorne Sossin Jan 1998

Salvaging The Welfare State?: The Prospects For Judicial Review Of The Canada Health And Social Transfer, Lorne Sossin

Articles & Book Chapters

The Canadian Health and Social Transfer ("CHST"), which came into force on April 1, 1996, contains no national standards relating to the quality of social welfare. The goal of this new transfer was to promote provincial flexibility in the sphere of social policy. The author argues that this flexibility may undermine the core of the Canadian welfare state. Given the preoccupation of the provincial and federal governments with devolution, welfare recipients must turn to the judiciary to determine the "bottom line" of the welfare state. The author explores the various constitutional and administrative law grounds on which the federal government's …

Valorizing The Subjunctive: The Unfortunate Judicial Contribution Of R. V. Carosella, Jim Smith, Richard Haigh Jan 1998

Valorizing The Subjunctive: The Unfortunate Judicial Contribution Of R. V. Carosella, Jim Smith, Richard Haigh

Articles & Book Chapters

Nick Carosella owes his freedom from conviction on gross indecency charges not to a single judge or jury, but to two entities whom he has never met. These two-the Supreme Court of Canada and the Windsor Sexual Assault Crisis Centre-have transformed a handful of written notes into an ambiguous extension of the concept of relevance. The latter organization, by destroying the complainant's counselling records, forced the former to revisit, via the Charter, 1 the relevance of such records. At the end of the day, the fates of Carosella and his alleged victim seem almost incidental to the Court's latest installment …

The Relationship Between Treatment Programs And Recidivism With African American Delinquents Under The Age Of 14, Sonya D. Gray Jan 1998

The Relationship Between Treatment Programs And Recidivism With African American Delinquents Under The Age Of 14, Sonya D. Gray

Dissertations

Problem statement. African American youth are over-represented in the juvenile justice system, which fails to meet their needs. Research is necessary, therefore, to discover treatment alternatives that effectively address these delinquents' needs.

Methodology. This study examined the relationship between treatments and recidivism of 100 African American male delinquents under the age of 14. Recidivism was defined as any arrest, within a 3-year period, for either criminal or misdemeanor offenses, subsequent to the court's referral for the treatment programs named in the study. Only delinquents who were adjudicated for the first time in 1991 through 1994 were included in …

Variables That Discriminate Between Persisting And Nonpersisting, First-Year Undergraduate Students In An Open-Admissions, Multicampus, Commuter College System, Jeffrey David Hines

Dissertations

Problem. Most new undergraduate students begin college with the highest hope of finishing their educational programs. Unfortunately, a large number of students drop out prior to graduation. This is particularly true of nontraditional students who attend nonresidential commuter colleges. This study investigates the differences between nontraditional commuter students who persist through to completion, and those who do not.

Method. A total of 436 Davenport College students, 65 males and 371 females, was surveyed for this study. They were full or part-time, certificate, diploma, or degree-seeking students at one of five Davenport campuses: South Bend and Merrillville, Indiana; Grand Rapids, …

The Influence Of Social Integration, Religious Integration, And Religious-Social Regulation On Suicidal Behaviors Among Seventh-Day Adventist Youth, Elizabeth A. Hossler Jan 1998

The Influence Of Social Integration, Religious Integration, And Religious-Social Regulation On Suicidal Behaviors Among Seventh-Day Adventist Youth, Elizabeth A. Hossler

Dissertations

Problem. Since Durkheim's classic 1897 study of differences in suicide rates between Catholics and Protestants in Europe, much research has focused on the relationship between religion and suicide. Pescosolido and Georgianna (1989) have suggested that Durkheim's Catholic/Protestant paradigm may not work well in the more heterogenous religious culture within the United States. This present study used Pescosolido and Georgianna's (1989) social network theory to examine the influence of social integration, religious integration, and religious-social regulation on attempted suicidal behavior in Seventh-day Adventist adolescents.

Method. The data used for this study came from the Valuegenesis (1989) survey conducted by the Search …
